Kazaa Sues RIAA - from Broadband Reports
"Turning the tables slightly, the makers of Kazaa file a lawsuit against the music industry. According to Sharman Networks, the RIAA has been logging into to file trading networks to track down file-traders; the hitch being they're doing so in part by using Kazaa-Lite, a spy-ware free and unauthorized version of the original client. Sharman also continues to claim that the RIAA is violating antitrust laws by stopping the company from distributing legitimate content (demos, legal films) via the file-sharing network. Meanwhile a mistake by the RIAA's identification methods has fueled the fires of RIAA critics; the industry recently withdrawing one of many recent subpoenas after mistakenly identifying a 65 year old woman as an illegal sharer of rap MP3's. Though the RIAA has no evidence of the woman doing anything wrong, they issued one of their traditionally friendly responses to the gaff. "Please note, however, that we will continue our review of the issues you raised and we reserve the right to refile the complaint against Mrs. Ward if and when circumstances warrant." Note: The woman mentioned above uses only Apple MacIntosh computers, which are incapable of running Kazaa or any compatible software. see story at SlashDot |

oh, and apparently the case above of the RIAA suing the wrong person is not the only one - there have been others reported where apparently ISP records had the wrong IP address, and unsecure 802.11 networks had possibly been used .... |

Perhaps the RIAA Wouldn't of used Kazaa Lite if there was no spyware with Kazaa itself lol...

I dont think Kazaa has a corporate license anyways - I believe it says that it is for personal use only - and so any use for commercial purposes is violating the license agreement

GO KAZAA!
I hope Kazaa or anyone for that matter finds more legal stuff they can bring up against the RIAA! I hate the RIAA- and I'm in the UK- I just hate any company doing what the RIAA do. I was just thinking of something- a little girl was sued for downloading nursery rhymes and tv themes? Well- alot of those tv themes may not be widely available on cd- and the RIAA's site doesn't actually help much in finding titles- so if some of their music they own the rights to is out of print- shouldn't the public have the right to download? There are alot of songs out of print that I download-if the RIAA don't want rights violated it's their responsibility to provide the songs. I also thought that people MUST buy albums to hear certain songs- well, then they're being FORCED to pay for a product they don't want (the rest of the songs)- so couldn't the RIAA and music labels offer a 'no-frills' customised disc of their artists at low prices? |
