Default Michael Skakel why is he not in jail?

this is the last news on the courts second decision for the court up hold his conviction. So why let him stay free? I do not get if his lawyer has another appeal pending. Enough is enough this is a waste of money already!

I understand your frustrations whole heartedly, but he is entitled to appeal these decisions. I know previous posters have actually engaged in conversation with Skakel and questioned his guilt in the matter-- I am not one of those posters. I firmly believe he killed Martha and he belongs back in prison.

If this case makes it to Amazon Streaming (Season 8), I bet the text update on it will be 1,000 words long and it will take 10 minutes to read (LOL!) so many twists and turns in this case!!!!!

He should be back in prison by now. Once the motion for reconsideration was denied the conviction is now official again.

My guess is because of his familial relation, they won't let it go on Amazon streaming. But I could be wrong.

I used to think the same about his familial relation. But technically, he is a family member of a Kennedy in-law and not an actual Kennedy. Maybe that's splitting hairs, it might not make a difference.

I'm too lazy to look it up at the moment but I don't think the Martha Moxley case aired until later seasons, like when the show moved to CBS. I think it will be a while before we find out if it goes to Amazon.

I'm pretty sure that this case aired in the mid-90s...about 20 years after the murder. So that would still be the NBC years.

I have no doubt that this case will be shown on Amazon. UM helped reignite attention in this case and it's a pretty significant one for the show that resulted in an arrest and conviction.

I haven't read up on this case in awhile, but my impression was that his brother Thomas could just as easily have been involved.

I can see why Michael was convicted though. The mental picture of what Michael was doing in the tree must have had a profound effect on the jury. A very disturbed young man.

As someone vaguely local to this case, I'll give you the feel for what people I've spoken to think about this.

His alibi was more a subject of mocking than one of horror. Everyone around that I've discussed the case with saw it as a completely see-thru attempt to account for any DNA that may have turned up. (It has also been discussed that masturbating in a tree is probably not the safest option. Never do anything you don't want to have to explain to the triage nurse in the ER and all that. I'll spare you the more salacious comments about it.)

This appeal is ridiculous. Yes, Mickey Sherman is a less than ethical lawyer as his record reflects, but he was known for his courtroom shenanigans long before Michael Skakel hired him. I suspect that's WHY he hired him.

If anything was appealable, it was the juvenile court issue, and the state won on that. I'm not sure how I feel about that in the abstract, but in this particular case, I think justice won.

Also, that weird story about Kobe Bryant's cousin being in Old Greenwich with 2 friends from the Bronx is just that, weird. I'm not sure where I read that all three men were African American, but I know I did somewhere. Even now Old Greenwich is pretty darn white, but in 1975, there is no way 3 black male teenagers could have been wandering around without someone noticing.

I, too, am annoyed he's not in jail.

That's a common tactic to create reasonable doubt. It was arguably especially appropriate here since Tommy's alibi was proved not to be credible. The court in the habeas petiton found that Sherman's choice not to employ that tactic mounted to a failure to provide constitutionally guaranteed counsel because it was a tactic that could very well have lead a jury to acquit Skakel. The state Supreme Court saw it a differently though.

Oh, I know it's a common tactic, but it's still ridiculous. There's no doubt in my mind Michael said not to blame Tommy, which may be where the ridiculous Kobe Bryant cousin story came in.
