Madderest Chardon school shooter T.J. Lane appealing his life sentence (with Notice of Appeal)

http://www.cbsnews.com/8301-504083_1...urder-charges/

(CBS/AP) CHARDON, Ohio - An Ohio teenager charged with killing three students in a high school cafeteria last year pleaded guilty to aggravated murder charges Tuesday, one day before the anniversary of the deadly shootings.

T.J. Lane, 18, pleaded guilty to three counts of aggravated murder, two counts of attempted aggravated murder and a single count of felonious assault. Prosecutors agreed to drop the possibility of the death penalty, and Lane will likely be sentenced to life in prison.

Prosecutors said Lane fired 10 shots at students at Chardon High School, east of Cleveland, on Feb. 27, 2012. Lane, who was 17 at the time, was prosecuted as an adult. Lane attended an alternative school for students who haven't done well in traditional schools. He was at Chardon while waiting for a bus.

Both the defense and the prosecution sought court-ordered psychiatric testing for Lane to determine if he would be competent to stand trial.

Before the case went to adult court last year, a juvenile court judge ruled that Lane was mentally competent despite evidence he suffers from hallucinations, psychosis and fantasies. He withdrew his plea of not guilty by reason of insanity on Tuesday.

Investigators said Lane admitted shooting at students but said he didn't know why he did it. Prosecutors said Lane took a .22-caliber pistol and a knife to the school and fired at a group of students in the cafeteria.

His sentencing is scheduled for March 19.

Injured, but physically recovered: Joy Rickers and Nate Mueller. Nate was amongst the group who was just in Washington D.C. to testify about gun control.

Survived, but is still paralyzed from the waist down. Nick also attends Auburn Career Center part-time, where my dad works. He drives a specially made car that fits his needs. He's not in any of the classes my dad helps teach, but my dad sees him in the school parking lot every once in awhile. They're on a "hi, how are you?" basis.

Shooter Sought At Coastal Carolina University
Twitter post: 'Shooting is not ongoing'
Author: By CNN Staff

(CNN) - Police were searching for a gunman who shot a person Tuesday night on the campus of Coastal Carolina University in Conway, South Carolina. The incident took place at 7:22 p.m. at University Place Apartments, which is one of the school's residence halls, Doug Bell, a school spokesman, told CNN. The suspected shooter left in a vehicle, said Bell, who added that the school was asking students and university personnel to stay inside.

The victim was taken to Grand Strand Regional Medical Center in Myrtle Beach, he said. "The shooting is not ongoing," the dean of students' Twitter page said. "Police continue to search for one suspect. Stay indoors." More than 9,000 students attend the school, which is located on 630 acres about 15 miles northwest of Myrtle Beach. Coastal Carolina University was founded in 1954 as Coastal Carolina Junior College. It became an independent university in 1993.

Thomas Lane III has appealed his life sentence for shooting six students at Chardon High School.

The 18-year-old Lane, also known as T.J., was sentenced March 19 to three life terms without parole.

His appellate attorney, Michael A. Partlow in Kent, filed paperwork April 18 with the 11th District Court of Appeals.

The reason listed for the probable issue for review is simply “juvenile bindover and sentencing.”

Partlow did not immediately return a phone call Monday afternoon for further comment. Partlow is an appointed attorney because Lane was found to be indigent.

Geauga County Prosecutor James Flaiz said the appeal was not a surprise.

“I feel strongly the judge’s sentence will be upheld and we will vigorously defend the sentence and work on the appeal in our office,” the prosecutor said.

Throughout the hearing before Geauga County Common Pleas Judge David L. Fuhry, Lane smirked and wore a white T-shirt with the word “Killer” writen in black pen. The shirt was similar to what he wore the day of the shootings.

“The hand that pulled the trigger that killed your sons now masturbates to the memory,” he told the victims’ family members in the courtroom. “(Expletive) all of you.”

Then he stuck his middle finger up at the packed courtroom.

Lane, who originally pleaded not guilty by reason of insanity, entered the high school on Feb. 27, 2012, and fatally shot 17-year-old Russell King Jr. and 16-year-olds Demetrius Hewlin and Daniel Parmertor. He wounded three others.

Nick Walczak, now an 18-year-old senior, was left paralyzed from the waist down. Nate Mueller, also a senior, was grazed in the ear by a bullet. Another victim, Joy Rickers, has since graduated.

Against his trial attorneys’ advice, Lane pleaded guilty to three counts of aggravated murder, two counts of attempted murder and felonious assault.

Lane, who was not eligible for the death penalty because he was 17 at the time, was a student at the alternative school Lake Academy in Willoughby. He was at Chardon High that day to catch a bus.

A civil suit against Lane that was filed by the families of the three boys who were killed remains pending in Lake County Common Pleas Court.
