Things are looking a bit brighter for actor Matthew Fox. Just days after his former "Lost" co-star Dominic Monaghan accused him on Twitter of beating women, the female bus driver who claimed Fox punched her in the chest and groin area has dropped her lawsuit against him. J. Norman Stark, the attorney who represented Heather Bormann, told TMZ that the actor did not settle the suit. Bormann had sued for more than $25,000 for assault, battery and inflicting emotional distress. According to legal documents obtained by TODAY.com, the case was dismissed with prejudice, and Bormann is "permanently barred from filing any additional claims or counterclaims" in the case. Court documents obtained by TODAY.com also show that Stark withdrew as her attorney on April 10. The motion states that Bormann had "intentionally failed and refused to provide full and timely cooperation and information vital and necessary to the prosecution of this case," which made it "impossible" for her lawyer to continue representing her. The document also notes that Bormann refused to honor their agreement to have her pay the out-of-pocket expenses. The alleged assault occurred last August in Cleveland while Fox was in town filming "I, Alex Cross." Bormann claimed the actor was drunk and punched her after he tried to board the private party bus she was driving, even though he was not a guest.
