Kate's New Situation (i know nobody likes Kate but hey read it anywayLOL)

This is my first fan fic. It hasnt really gotten anywhere yet but it will. Enjoy!


Its a sunny day in San Francisco. Jinny and Magda are at their desks looking over some papers. CD and Nate are discussing a case. And Captain Kaitlyn McCafferty is awaiting the arrival of her sister Elizabeth, her brother-in-law Carlos, and her young niece Melissa. Kate is going to have her niece, whom she's never met, stay with her, while Melissa's parents go on a vacation to re-kindle their relationship.

***THE DIVISION 9:35 a.m.***

~Kate anxiously waits in her office, while the inspectors review their cases.~
~ A middle-aged couple and their teenaged daughter enter The Division~

"Hello, my name is Elizabeth Perez, this is my husband Carlos and my daughter Melissa. I am looking for Kaitlyn McCafferty. I am her sister" the woman says to Jinny. "Hi, I'm inspector Extead and these are Inspectors Ramirez, DeLorenzo, and Basso." says Jinny.
All the inspectors greet the couple and their daughter. "The Captain's office is right over there" Jinny says as she motions to the office. "Thank you" says Elizabeth. As they enter the office, Kate smiles and stands up. She gives her sister as well as her brother-in-law a hug. Melissa, Kate's niece, however is hiding behind her father.
"I see you're a little shy there" Kate says smiling. "Don't be shy Mel" Elizabeth says. "Eh, she'll get over it. She has to stay with me for a week anyway." says Kate. "Well, we'd better go Liz. Its been nice seeing you agin Kate. Sorry its so short" says Carlos. With a sad look on her face, Melissa gives each of her parents a hug and a kiss goodbye. "I love you guys" Melissa says. "We love you too. Don't be sad. We'll be back in a week. It's ok." says her mother. "Be careful guys. I love you" says Melissa.
Carlos, Elizabeth, and Kate all exchange hugs. Melissa gives her parents one last hug and kiss goodbye and again says "I love you."
Melissa's parents leave the division and she is left with her Aunt Kate and all of her luggage.
"Hey, Melissa, C'mon. I want to introduce you to some people here." Melissa follows Kate to where everyone is seated. "These are inspectors Extead, Ramirez, DeLorenzo, Basso and officer Washington. "Um..hi" Melissa says looking toward the ground. All the inspectors greet her and do their best to make her feel welcome.

***15 MINUTES LATER***

~Charles enters the division. Magda and Jinny have left to investigate a double homicide. Nate and CD are discussing their case. Raina is making a few phone calls concerning the double homicide that Magda and Jinny are investigating. Kate is doing some paper work and Melissa is quietly sitting in the corner of Kate's office. Charles enters Kate's office.
"Good morning Kate. I wanted to go over some...." Charles trails off and is looking straight at Melissa. "Uh...Kate?" Charles says motioning Kate to step outside for a moment.
"Yes Charles?" Kate says. "I'd like to know who that young lady is and why she is here in your office." Charles says sternly. "Well, she's my niece. I'm taking her while her parents go on vacation. I'm taking her back to my house on my lunch break. Ok?" Kate says. "Yeah, Ok Kate. I guess we'll talk later." Charles says. Charles begins to walk away. "Oh Charles, and another thing." kate says. Charles turns around and looks at Kate. "Yes Kate?" he says. "This is my office and i'll have whoever I please in it. Got it?" Kate says with a hard look on her face. "Ahem!...Yes Kate" Charles says looking a bit nervous and then walks away. Kate returns to her office and sits down.

***THE DIVISION: 3 HOURS LATER 12:50p.m.***

Melissa is seated in the same spot she's been in for the past three hours listening to music. Kate is finishing up some paper work. Kate checks her watch and looks at Melissa. "Ready?" Kate asks. "Uh...I...uh...guess so" Melissa replies . Melissa then grabs her luggage and follows Kate out of the Division.

***KATE AND MELISSA IN THE CAR***
"So, how old are you?" Kate asks. "Eleven. I'm gonna be twelve." Melissa answers in a soft, low voice. "Oh, I see. Y'know, you look just like your father. Your father is Puerto Rican right?" Kate says. "Yeah." Melissa answers back. "Magda, at the Division, is Puerto Rican. Your father...does he teach you Spanish at all?" Kate asks. "Nope. My father hasn't taught me any kind of Spanish, but I do like Spanish music and I'm learning Spanish in school." Melissa says. Well, thats good. How are you doing in Spanish?" Kate asks. "I do fine" Melissa answers. "Do you have a good teacher?" Kate asks.
~~Melissa starts looking extremely uncomfortable at this point in their conversation. She mumbles someting about her Spanish taecher and the conversation progresses along.~~
"So, how do you like living in New York? I used to live there, y'know." Kate says. "New York is fine. I'm missing it right now though." Melissa answers. Kate chuckles a bit and says "Yeah, well, you're only here for a week, so try not to get too upset. Ok?"

OK. Here's another part of the story:

***KATE'S HOUSE***

~~Kate and Melissa enter the house. Its a nice house. Melissa puts her luggage down and takes a look around. Kate motions Melissa to follow her. Kate takes her to the spare room next to hers.~~
Kate: This is where you'll be staying.
Melissa: OK
Kate:The bed has fresh sheets and everything. I'm glad you're staying with me. Its about time we got the chance to meet.
~~Melissa grins. Kate puts her arm around her but Melissa pulls away as if she is uncomfortable. Kate knows why, but she doesn't think its the right time to address the issue.~~
Kate: Are you ok staying here by yourself?
Melissa: Yeah, I'm fine...uh..Aunt..K-Kate.
Kate: Its ok. You can call me Aunt Kate or Kate or Captain. (giggles). Whatever you feel comfortable with.
~Kate gives Melissa a smile. Melissa smiles back.
Kate: Well, I'm headed back to work. I'll see you tonight. I'll bring dinner home. And call me if you need anything. The number is by the phone.
Melissa: Ok. Thanks
~~Kate leaves for work and Melissa is left alone in the house. Melissa snoops around a bit and then sits down in the living room to watch T.V.~~

***KATE'S HOUSE 8:00p.m.***

~Kate enters the house. Melissa is sitting on the floor watching t.v.~
Kate: Hi Melissa, how was your day?
Melissa: Eh, it was ok. I sat here all day watching t.v.
Kate: Yeah, I know what you're trying to say. I know my house is boring. You don't have to tell me.
Melissa: I never said that! You're puttin' words in my mouth. Geez!
Kate: No I'm not Melissa. But I know thats what you were thinking. (chuckles)
~Melissa sighs~
Kate: Well I brought dinner home. Some burgers and fries. Want some?
Melissa: Sure. But its not the healthiest thing in the world to be eating Aunt Kate.
Kate: I know but it was a quick thing.
Melissa: Yep(sarcastically)
Kate: What? Why are you being so sarcastic?
Melissa: Would you look at me Aunt Kate! I'm not the skinniest person in the world, y'know!
Kate: Well, neither am I! OK?
Melissa: Yeah, well, when you weigh 160lbs and you're trying to lose weight, you can't exactly afford to be eating burgers and fries!
Kate: Ok. Calm down. Just calm down. I know that your weight gets you down sometimes and I know its a serious issue for you, but you have to calm down sweetie.
Melissa: How did you know that?
Kate: Your mother told me.
Melissa:What else do you know? Oh God, I hope you don't know about...
~Kate interrupts her~
Kate: I'm not going to tell you what else I know. When the time comes, then I'll address the issue.
~~Kate and Melissa didnt talk while they ate dinner. They occasionally glanced at eachother but that was about it. After dinner, Kate takes a shower and Melissa is again left alone. She sat there on the couch and thought about what Kate might know about her past.
She thought: 'Oh God. She can't know. Its impossible. I know mom knows about it because it was pretty obvious. But would mom tell Aunt Kate?

***LATER THAT NIGHT 12:25a.m***

~~Melissa went to sleep. Kate was in the living room, on the couch going over some papers. The phone then rings.~~

Kate: Hello?...Oh my God. No! No that can't be. Oh God. (crying) When did this happen?....Oh. Oh God...What am I going to do?....Well, thank you for letting me know. OK. Bye Bye.

~~Kate sits down on the couch and tries to calm down. She thinks for a little bit.~~

She thought: I can't believe this happened. What am I going to tell her? HOW am I going to tell her?

~~Kate sighs. She gets up from the couch and heads towards the spare room in which Melissa is sleeping. Kate sits down on the bed and looks at Melissa sleeping. Kate starts stroking Melissa's face and hair. She gives Melissa a kiss on the cheek, trying to wake her. Melissa opens her eyes and looks at Kate. When Kate looks at Melissa, a feeling of hurt takes over her body, but Kate holds in her tears.~~

Kate: Hi Sweetie.
Melissa: Hi
Kate: How are you doing? How are you feeling?
Melissa: I'm fine
Kate: Uh, sweetie...I have to tell you something.
Melissa: What? What is it?

~Kate pauses. She looks hurt. She looks into Melissa's eyes.~

Kate: Honey, I just got a call from the airport. A plane crashed. Apparently it was your parents' flight. There are no survivors.

~~As Kate's words penetrated Melissa's ears, she began to sob. She put her head in her hands and just cried hysterically. Kate did her best to comfort her, but had never really been good at that.~~

Kate: Its going to be ok, honey.
Melissa: How can you say that?
Kate: Because I know it will be ok. I know its hard for you. Its hard for me too and I know we just met but we have to do our best to comfort eachother and be there for eachother.
Melissa: Why does everything always happen to me? I'm always the one who gets hurt.
Kate: Your situation could be worse.
Melissa: What are you talking about? My parents died and I'm stuck here with you! How could my situation be any worse?
Kate: You could've died too! Or you might have not had a place to stay! And who said you were stuck here? Noboday said I was going to.....keep you.

~Kate starts crying hysterically. Melissa is doing the same. Kate looks at her young niece crying and hurting. She begins to feel guilty.~

Kate: I'm sorry. I don't know why I said that.
Melissa: I don't care anymore. You can say whatever you want. Its not like you care about me.
Kate: Don't you ever say that!
Melissa: Why not? You don't know me. You couldn't possobly care about me.
Kate: That isn't true. I've cared about you since you were born.
Melissa: What do you mean 'since i was born'? You didn't even live in New York when I was born. You lived here.
Kate: Yes thats true, but when I found out that your mother was pregnant, I flew to New York to be with her. I was so excited for your parents. I spent everyday of your mother's pregnancy with her up until the day you were born. About a month before you were born, your mother was admitted to the hospital because she was having some difficulty with her pregnancy. While your mother was in the hospital, I.....your father and I...um...sort of had an affair.

Ok heres more of the story. this is after Kate confesses to having an affair with Melissa's father.

Melissa: What!?! (starts flipping out)
Kate: Honey, calm down. I know um its hard to take all of this in right now but I have to tell you. *sigh* Anyway...the day you were born, I got a chance to hold you.(smiles). You were so tiny. From the moment I layed my eyes on you, I loved you. When your mother returned home from the hospital she had to stay in bed. I took care of her and you. Your father helped. After a while, your mother realized that ther was something going on between me and your father. Your mother kicked me out and I was never given the chance to explain or do anything. I think thats when your parents' relationship started to go down hill.
Melissa: You! It was you!?! You're the one they were always arguing about? I can't believe this! I can't believe you! And you say you care about me? How can you say that?
Kate: Melissa, I do care about you. And I always have. Your mother didnt want anything to do with me after she found out. Therefore, I was never able to see you or anything. Your father and I stayed in touch though. We wrote letters back and forth and he would always send a picture of you.

~~Kate gets up, walks to her room and goes to her dresser. She opens the bottom drawer and reaches underneath the clothes in it. She pulls out a stack of letters and some pictures. Kate then walks back to the spare room where Melissa is.~~

Kate: See? I have your baby pictures and school pictures. I even still have your father's letters.
Melissa: I still cant believe this. I cant believe my father did that to my mother. I bet she was heart-broken. I cant believe YOU did that to my mother. You're her sister! Ew and I cant believe you did that to my father.
Kate: (laughs) Well sweetie, it happened. Its the past and we cant change that.

~~Melissa lays back down. Kate again, is stroking Melissa's hair and face and looking at the girl that lay infront of her.~~

Kate: Are you ok?
Melissa: No. I'm scared.
Kate: Why?
Melissa: Why do you think? My parents are dead and you had an affair with my dad.
Kate: I know its hard. It was harder for me to tell you.

~Melissa starts sobbing. Kate tries to comfort her again.~

Kate: Do you want me to stay here with you, hun?
Melissa: Yeah, I guess so.

~~Kate crawls into the bed with Melissa trying her best to comfort her. Melissa turns her back to Kate and tries to fall asleep, but is unable to. Kate eventually dozes off.~~

***3:45a.m.***

~~Melissa is laying on her belly looking around and occasionally at Kate. Kate opens her eyes and takes a brief look at Melissa.~~

Kate: Hi hun.
Melissa: I'm sorry. Did I wake you?
Kate: Oh no, you didnt. Whats the matter?
Melissa: I cant sleep.
Kate: Why not?
Melissa: What am I going to do? Where am I gonna go?
Kate: As far as I'm concerned, you're not going anywhere. You're staying here with me. OK?
Melissa: Yeah ok.
Kate: Melissa, honey....I know about your Spanish teacher.

~Melissa looks at Kate in disbelief~

Melissa: My mother told you, didnt she?
Kate: Yes. I know you're not very comfortable around females anymore. And I know your Spanish teacher was getting a little too physical with you.

~Melissa thinks about those times with her Spanish teacher. She begins to cry.~

Melissa: Yeah, my spanish teacher...he was a little wierd.
Kate: A little?He should've been arrested.
Melissa: I know, but I was scared.
Kate: OK, ok. Thats enough talk for tonight. Go to sleep. OK?
Melissa: Ok

~~Kate motions for Melissa to put her head on her chest. Melissa hesitates. Slowly she puts her head on Kate's chest. She could hear Kate's heartbeat. Melissa felt like she was home again, as if she were in her mother's arms.~~

Kate: (whispering) Its ok sweetie. We'll talk more tomorrow.

~Tears start rolling down Kate's cheeks. Melissa looked at her aunt. She wanted to cry too, but held it in. Kate starts rubbing Melissa's back.~

Kate: We're gonna be fine.
Melissa: I know

OK.. heres a lil more of the story:

***THE NEXT DAY- KATE'S HOUSE 10:35a.m.***

~~Melissa has just woken up. Kate is in the kitchen making breakfast. Melissa gets out of bed, goes to the bathroom and brushes her teeth, then heads for the kitchen.~~

Melissa: Hi Aunt Kate.
Kate: Hi Melissa.
Melissa: You're cooking?
Kate: What? You make it sound like I dont know how to cook.
Melissa: I thought you'd be at work or something.
Kate: I took a personal day so I could be with you.
Melissa: Oh I see.
Kate: I made arrangments so we could fly to New York to pick up your stuff and sign you out of school. We're gonna stay there for a few days.
Melissa: Um..Ok
Kate: Breakfast is ready. Sit down.

~Melissa takes a seat. Kate serves breakfast and seats herself directly across from Melissa.~

Melissa: Pancakes huh?
Kate: What? You dont like em?
Melissa: No, I didnt say that. I'm just trying to make conversation.
Kate: Oh, sorry for jumping the gun.
Melissa: eh, its ok
Kate: Listen, I wanna talk to you about your Spanish teacher and what we can do to get him arrested.
Melissa: Uh...um ok.
Kate: I was thinking that I can make a few calls to the local police department, around where you lived, and have them check the teacher out. Y'know, ask her a few questions. And then, when we go to New York and sign you out of school, you can say goodbye to everybody, including your Spanish teacher. If he tries to pull anything on you, we can have him arrested.
Melissa: So, you want me to set him up?
Kate: Well, yeah.
Melissa: I dunno. I'm scared.
Kate: Dont be scared, hun. Its just a thought. If works it works.
Melissa: And if it doent work?
Kate: If it doesnt work, then we'll have to think of something else.
