Did Jay Leno (or his writers) steal a joke from Fox News?

That's certainly what the hosts of "Red Eye", the network's late night show, accused Leno of doing on Saturday.





First, host Greg Gutfeld played a clip of a May 26 joke from Leno:

"Bad news for the state of California. The Supreme Court will force the state to release something like 46,000 convicts because of prison overcrowding. But the good news: it looks like the Oakland Raiders will have more season ticket holders!"




Gutfeld and co-host Andy Levy thought the joke was suspiciously close to one that Levy had made two days earlier on "Red Eye."

Levy had said, "Supreme Court orders tens of thousands of California prisoners released. This actually might help the Raiders start selling out their home games again."

"Wow Andy! I can't believe you traveled to the future, stole that joke from Jay, then traveled back to tell it on 'Red Eye,'" Gutfeld joked.






It's not the first time Leno has been accused of lifting material.

Last November, he was forced to credit a VH1 blogger for coming up with a Taylor Swift joke.

I was watching the night that happened. I love that show. Who knows what happened. I know Jay writes a lot of his own jokes, but he has a staff of writers, so someone else may have lifted the joke.

It seems to me Fox News must have better things to do with their time and energies than to pick a fight with Jay Leno over a joke. Besides they say that imitation is the sincerest form of flattery. They should feel honored that the Tonight Show thought their joke was funny enough to copy!

It's not FOX News. It's a comedy type panel show. They're not picking a fight with Leno. They were laughing and making jokes about it. Still, I don't agree that a person should feel honored if Leno steals their joke. It's frowned upon in the industry. It's not considered flattery. If your name is in the credits, that changes everything.
