Exclamation Lindsay Lohan Sentenced to Four Months in Jail

http://www.people.com/people/article...484385,00.html

By Ken Lee

Friday April 22, 2011 08:00 PM EDT

After a topsy-turvy day in court, Lindsay Lohan was found in violation of probation – and sentenced to four months in jail – on Friday, for allegedly stealing a $2,500 necklace.

The actress, who was allowed to post bail, was also sentenced to 480 hours of community service by a Los Angeles judge.

Lohan, 24, arrived at Lynwood Jail at approximately 5:30 p.m. PT in a sheriff's vehicle – her fourth trip to the facility – where she was given an orange jumpsuit and, according to a sheriff rep, will be released "in the very near future," most likely Friday night.

Earlier in the day, Lohan, 24, scored a legal victory when Judge Stephanie Sautner reduced her felony grand theft charge to a misdemeanor, explaining she was "giving [Lohan] an opportunity," because reducing charges for nonviolent defendants frequently happen in more serious cases than Lohan's.

Because of the reduction, Lohan was granted $75,000 bail for the probation violation while pending appeal.

Lindsay Lohan Free on Bail After Receiving 120-Day Jail Sentence
By Sharon Knolle
Posted Apr 23rd 2011

Lohan is facing her fourth go-round in jail after being sentenced to 120 days for violating probation with her alleged necklace theft in January.

How this -- and her upcoming trial -- will affect the role she just landed in Gotti: Three Generations, is not clear.

She is currently free after posting her $75,000 bail last night.

Although the judge, Stephanie Sautner, saw "a level of brazenness" and intent in Lohan's actions regarding the necklace, she reduced felony grand theft to a misdemeanor level, saying, "I'm going to give her an opportunity."

Sautner also sentenced Lohan to 500 hours of community service, to be served at the county morgue and a women's shelter, with the hopes of giving the actress "a dose of perspective.'

A trial date of June 3 has been set on the misdemeanor charge, with a pre-trial date of May 11.

Whether Lohan will spend the entire 120 days of her jail term is also not clear.
Last year, she served only 14 of a 90 day sentence.

Now is she actually going to serve time with the other criminals or will she be given special treatment because of who she is???

Lohan is considered a "high profile inmate" so her time in jail will most likely be in protective custody with no contact with any of the other inmates.

Her last stint in jail was in protective custody.

Unknown at this time.

I guess it depends on how long she actually stays incarcerated. Unless the studio revokes her deal she's officially still on board the project.

She's gotta take responsibility and take punishment instead of having the lawyers push her out of being punished.

Lindsay Lohan to Plead No Contest to Theft Charges, Hopes to Move On With Her Life
By PopEater Editors
Posted May 2nd 2011

Lindsay Lohan is ready to move on from her troubled past and has reportedly decided to plead no contest to her misdemeanor theft charges, our friends at PopEater report.

Sources told TMZ the actress's lawyer Shawn Holley is expected to go to Judge Stephanie Sautner as early as this week to present the plea. Lohan's trial date is currently set for early June.

The actress has been sentenced to 120 days in jail and 480 hours community service stemming from a probation violation connected to her jewelry theft case.

The actress and her lawyer are banking on the judge not throwing additional jail time on top of the plea.

According to TMZ, L.A. County Sheriff's Department spokesperson Steve Whitmore said he believes Lohan would likely serve three weeks of her four-month sentence due to overcrowding.

Lohan's actions mirror her attitude on "The Tonight Show with Jay Leno", where she admitted she wants to perform her community service and put this chapter of her life behind her.

The actress is attached to star in the upcoming Gotti: Three Generations, with John Travolta.

Lindsay Lohan Set to End Theft Case Today With No Contest Plea
By PopEater Editors
Posted May 11th 2011

Reversing course to avert a trial, Lindsay Lohan is expected to plead no contest in her grand theft case on Wednesday, a move that would keep her out of jail and put the star back on course to revitalizing her career.

Not that she'll actually show up to court, though. Lohan is not required to appear at this hearing because her charge -- swiping a necklace from a store -- was reduced last month from a felony to a misdemeanor.

Judge Stephanie Sautner did determine that Lohan violated her 2007 probation from a DUI arrest and sentenced the star to 120 days in jail. She spent only a few hours inside after her lawyer, Shawn Holley, filed a notice of appeal for the four-month jail sentence. No further action on the appeal was ever taken.

At the time, Judge Sautner decided not to dismiss the case altogether, saying, "I'm going to give her an opportunity" to prove her innocence in a trial."

The actress recently turned down a pair of plea bargain offers in the theft case.

Lohan is looking to get back to work on her comeback and was recently cast to play the wife of John Gotti Jr. in Gotti: Three Generations, a biopic of the crime family.

The film is scheduled to begin production later this year in New York.

Sofia Kaman, the owner of Kamofie & Co., testified in court that Lohan stole a $2,500 necklace from her store on Jan. 22. She told Judge Sautner that Lohan had been coming into the store all week to look at items, but never bought anything.

She waited to report the necklace stolen because the actress had said she'd be back in a day to buy something else.

After a police report was filed, authorities reportedly waited until she was photographed wearing the necklace before deciding to pursue charges. A friend of the actress turned the necklace in to the Pacific Division of the LAPD on Feb. 2.

Lohan claims that the necklace was loaned to her -- and that her stylist simply forgot to return it in time. Kaman says she did not have any agreement with Lohan allowing her to leave the store with the necklace.

Lohan was officially charged during a hearing on Feb. 9.

After pleading not guilty, Judge Keith Schwartz lanced into the actress for not taking the charges seriously. "If you violate the law again, I will remand you with no bail," he told her. "Things will be different."

The actress, who remains on probation in a 2007 drunken driving case, is accused of taking the necklace roughly three weeks after she was released from three months of court-ordered rehab at the Betty Ford Center.

Lohan has gotten her fill of jail time in recent years, ranging from 84 minutes to 14 days. Her early releases have been due to overcrowding and state-mandated credits for time-served.

Lindsay Lohan Pleads No Contest to Misdemeanor Theft Charge
May 11, 2011
by Rich Juzwiak

Lindsay Lohan pleaded no contest Wednesday to a misdemeanor theft charge involving a stolen necklace, the Los Angeles Times reports.

The actress, who did not attend the hearing, was sentenced to three years probation and shoplifting counseling.

The plea comes three weeks after Lohan was sentenced to 120 days in jail and 480 hours of community service for violating her probation from her 2007 DUI case as a result of the alleged necklace theft.

However, she is expected to serve a fraction of her jail time — perhaps about 14 days — due to jail overcrowding.

There's no word yet on when the actress will begin serving her jail sentence.
