12-year-old boy and father charged with beating elderly man at Delray Beach Target

A sweet-faced 12-year-old boy beat down an 83-year-old man Sunday in a Target parking lot in Delray Beach, with his father joining in to help finish the job, police say.

Police on Thursday arrested the Delray Beach teen along with his father, Barry Hochstadt, 53.

Investigators say father and son got into a fight with the 83-year-old victim in the parking lot of the Target at 1200 W. Linton Blvd. as they were backing out of a parking space.

After an argument between the victim and Barry Hochstadt, his 12-year-old son got out of the car and reportedly told the man he would "beat the (expletive) out of you" if he continued arguing with his father.

The elderly man told him to get back into the car, saying he was too young to get into such arguments.

The youth responded by pushing the man to the ground and punching him several times in the face, police say. His father, Barry, got out of the car and kicked the man in the groin, according to an arrest report.

The pair drove off, and despite allegedly changing the license tag on their vehicle "to conceal their identity," police were able to track them down to a residence in the 200 block of Northeast Fifth Avenue.

Questioned later by police, both father and son admitted to getting into a fight with the elderly man, the report said. But both claimed the man had attacked Barry first.

Police did not give the name of the victim, whose vehicle also was damaged, according to a Delary Beach Police release.

Police arrested both on charges of battery on an elderly person and criminal mischief.

Barry Hochstadt was taken to the Palm Beach County Jail and his son was taken to the county's Juvenile Assessment Center.

This morning, Palm Beach County Circuit Judge Krista Marx ordered Barry Hochstadt held in lieu of $3,000 bail, with an option to leave jail under supervised release.

Staff writer Eliot Kleinberg contributed to this story.

Just for the record, the two assailants live at 295 NE 5TH AVE in Delray Beach according to the County Property Appraiser's web site:

"I know an activity that we can do together during the holiday season, son. Let's go to the Target parking lot and beat up little old men."

Merry Christmas...in jail.

Moral of the story: Just keep walking if someone is backing their car out of a parking space and it dosen't hit you.

Hardly. You don't hit an 83 year old man and/or kick him in the groin. I don't care if he does hit you first (which he probably didn't). There are places you don't go in this world, and that's one of them.

Not defending them being violent, neither side should be, but for all we know the old man could be a jerk.

according to witnesses he told the guy to slow down and asked him why he almost ran him down, then told the boy to get back in the car.

I don't know why, but it seems like everyone that drives a Corvette is a jerk.
