Girl Arrested After Doodling On Desk To Sue
Family's Laywer Says School Officials Overreacted

Posted: Saturday, April 3, 2010
Updated: 1:53 pm CDT April 3,2010

New York -- A 12-year-old girl who was hauled out of her New York City school in handcuffs for doodling on her desk has started legal action against the city over her arrest.

A lawyer for Alexa Gonzalez filed legal papers seeking $1 million in damages, saying the Queens girl was subjected to overly harsh treatment.

Alexa was arrested at her junior high school in February after scribbling "I love my friends Abby and Faith" on her desk with an erasable marker.

Her family's lawyer says school officials overreacted by calling the police.

The Department of Education acknowledges the arrest was a mistake. The city's legal department has declined to comment on the lawsuit.

Oh No

I guess it says something about enforcing classroom discipline when these
wimpy teachers and faculty have to call 911 on a simple matter.

Maybe because they can't legally swat them with a ruler.

WTF!!!!!!!!!!!!!!!!!!!!!!!

All she did was draw on her desk. I am for teachers taking strong action against students who are troublemakers, but come on.

This teacher should learn to relax, or find another line of work.

From what I understand, the girl's family is filing a $1M lawsuit. The Police & Bd. of Ed are now admitting they goofed (you think!!!!!!). I hope the family does get a nice settlement, and more importantly, a very personalized (and sincere) apology to the poor little girl. (geez, the way the bozos overreacted you'd think she was planting a bomb or something) sheesh

Oh No

It's about time they took a stand against students being creative! That last thing we need in schools is students using their brains to express themselves creatively!!

Wow, they always used to threaten us in school saying if we wrote on school property there'd be consequences...but I don't think anyone ever expected this. Good Lord...and it's not like she even wrote anything explicit. People are idiots.

I agree with all of you, plus it was an ERASABLE marker, which means it was not permanent.

Overreact much?

"I love my friends Abby and Faith"

For cryin out loud, it wasn't even "hate speech"!!

I've seen school desks with stuff CARVED in them... with knives (when I was in 4th grade... it was an old school, with old desks).

And they're arresting a girl for THIS???

Too bad Phoebe Prince's teachers didn't get this involved with what was going on with her (she's the Massachusetts girl who committed suicide in January because she was forever on the receiving end of bullying from classmates). Nah, they couldn't do anything about the bullying that was administered by those kids... but let's arrest this girl for writing on her desk.

Wow. She didn't write anything explicit so what's the problem?!
I understand that it's the school's property and that it's disrespectful, but she's freaking 12.

And she used an ERASEABLE marker!!! All they had to do was ask her to erase it. No need to make a federal case out of it!

Exactly, the school was definitely in the wrong. Even if she wrote with a permanent marker, she should've been at most responsible for the clean up. That said I think the family is entitled to somthing, but a million dollars is ridiculous.
