Angry Husband Sent To Prison After Giving Wife AIDS

CLEVELAND, Ohio--- A local man is sentenced to five years behind bars after failing to tell his wife he was HIV positive.

Monday afternoon, 51-year-old Fernando Castro of Beachwood, apologized to his wife and her family before learning his punishment. "I would like to apologize to my wife and ask her to forgive me for what I've done," said Castro.

In the state of Ohio, it is against the law for people with HIV to have sex with others without disclosing their status. Castro pleaded guilty to felonious assault. Prosecutors say the attempted murder charge was dropped.

Castro was diagnosed with HIV in 1993. Two years later, he started dating his current wife, but never once did he tell her was infected with HIV.

Last year, his wife went to the hospital. She said at first doctors thought she had cancer. She soon learned she was had full-blown AIDS. Following Monday's sentencing she said, "Five years is nothing. He gave me a death sentence. He gave me a death sentence. I'm going to die of this disease."

Castro's first wife died of AIDS. According to prosecutors, it's unclear who contracted it first. Instead of telling his second wife the truth, Castro lied and told her his first wife died of cervical cancer.

Castro made sure his son from his first marriage was tested for HIV. Despite taking 3 or 4 medications several times a day for more than a decade, he never disclosed to his current wife that he was infected.

Although he was facing a maximum of eight years in prison, Cuyahoga County Common Pleas Judge Tim McGinty sentenced him to five years behind bars. He will also serve three years of post release control.

This is why I believe blood tests should be MANDATORY before a couple gets married!

My question is - why wasn't she suspicious when she saw him taking all that medicine for all those years?

And five years?If she might die because of this, how only five years?Can't say I'm shocked though.

I am not a cheat and a runaround, but if I were and I got AIDS, I would stop immediatly and tell every one of my lovers so they can get themselves checked. Then I would never have sex again.

Maybe you can have sex, just extremely protected and not long.I don't know

Anyway, I really hope that guy is sorry.It's not right, but he could have psychological issues of being desperate for sex.Five years seems like kind of getting off the hook though......

I don't know... having protected sex with someone HIV positive is playing with fire for sure since protection is not 100% certain.

I can honestly say if I knew someone were HIV I'm not doing it with them.


and yeah, five years seems light for this.

The justice system may have been lenient in only giving him a 5 year sentence but the man is HIV positive so in reality he does have a death sentence.
