Yes, I agree, Marvin Gabrion is NOT an innocent man. I am pro defense and looking at everything in this case I can safely say. I mean Gabrion would have you believe Rachel Timmerman turned up dead and the other guys just happened to 'disappear'. Basically everyone that had first hand knowledge of this Marvin Gabrion seemed to 'disappear'. The two men who went missing, their bodies have not been found but I am sure they are dead and I am sure Gabrion killed them.
What his appeals appear to be more about, this is based off of the opinions in federal court that I have read, is that Gabrion is arguing he could not be tried in federal court. He says that the scene where Timmerman's body was found was not on federal land. That is what he was arguing. He is on the federal death row and he wants this case to be thrown out. He is arguing he should have been tried in state court and Michigan does not have a death penalty at the state level, only for federal crimes can you have a potential death sentence. That is why Gabrion was tried in federal court in the first place and not in state court, because this crime was so brutal that they decided to try him in federal court and see if he would get the death penalty and he did. |
