The prosecution totally botched this case. Rugge and Hoyt were not even called to testify.

Yes that happened in the trial of Jesse Rugge where he was acquitted of murder but was convicted of kidnapping and sentenced to life in prison with parole eligibility after 7 years so far he has been turned down for parole twice. Whereas Graham Pressley was acquitted of kidnapping at his first trial but the jury hung on the murder charge. At his 2nd trial he was convicted of 2nd degree murder but was sentenced as a juvenile as he was 17 at the time of the murder (he turned 18 less than 3 months after the murder) he was sentenced to stay in a juvenile facility until he was 25 and was released in 2007. In a plea deal with the state, William Skidmore pled guilty to kidnapping and robbery and the murder charges were dropped. Skidmore was released in April of this year. The shooter Ryan Hoyt was convicted of first degree murder and sentenced to death.
Not surprisingly Marlins I disagree with your theory. It is not surprising to me at all that the prosecution did not call Hoyt and Rugge to testify. What motivation would they have to testify? Even if they had been given a subpoena to testify, they would have refused. Hoyt has no motivation to testify as he is on death row and it would benefit him in no way to testify as the prosecution cannot offer anything. The same can be said for Jesse Rugge who is in prison as well serving a life sentence for kidnapping and the prosecution does not have the power to offer him a sentence reduction or whatever. The best they could have offered him was a recommendation for parole to the parole board for his parole in exchange for his testimony but it appears the prosecutors did not do that. I would not say the prosecution blew the case by not calling Hoyt and Rugge to testify as they had no motivation to testify and even if forced to come to court they both probably would have taken the 5th. To be honest, out of all of the defendants I always felt the state had the weakest case against Jesse James Hollywood. |

Most, if not all death rows the inmates get cells to themselves. San Quentin's death row is hardly luxurious but yeah if I had to be locked up I would rather be on death row than be in general population. Also, in California, a judge cannot overrule a jury recommendation of LWOP. In fact the jury did not recommend LWOP they just did not unanimously agree on death and because of that, under California law Hollywood cannot death, the LWOP sentence is basically automatic because the jury agreed on the special circumstance. If they had not agreed on the special circumstance then he would have got 25 to life for the murder plus sentences for whatever else he was convicted of that I imagine would be run consecutively. However now it does not come into play. Basically the LWOP sentence is automatic because of the special circumstance finding, however Hollywood has not formally been sentenced yet. Formal sentencing is set for October, I guess it was put off that far because Hollywood's lawyers are going to make a motion for a new trial and some other motions so the trial judge is giving them sometime to do that.
Well, actually in terms of LWOP, Hollywood will not be sleeping in an open pod per se. In California, inmates that are serving life sentences, the lowest security classification they can get is high medium, so Hollywood will at best be sharing a cell with one other person. In fact, my guess is because his case is so high profile, he will probably wind up in protective custody and it would not surprise me if he got a cell to himself for fear that he would be assaulted and perhaps killed in general population. My guess is Hollywood will wind up at Corcoran State Prison which is where many high profile inmates wind up if they are in need of protective custody. However Hollywood regardless if he is in protective custody or not will not be in open pod sleeping because his security classification would be too high for that given his sentence. However as I said earlier, Hollywood is getting LWOP. A judge in California can override a jury's death recommendation and sentence a person to LWOP instead but they cannot override a LWOP recommendation and sentence a person to death. That is how it is in most states with the death penalty. In fact, if I remember right in only two states can a judge override a jury's life recommendation and sentence an inmate to death, those are Florida and Alabama. In fact I believe Alabama and Florida (and possibly Virginia) are the only states where a jury's death recommendation does not have to be unanimous. |

So Hollywood of horrors may have it better than I thought at Cochran state prison.
He may actually have it better in Cochran PC than at San Quentin because San Quentin's death is old and falling apart while I'm pretty sure Cochran is a newer prison. But his PC in Cochran will still include another inmate who is also in PC I'm pretty sure. But I'm pretty sure he would have had more in cell privileges on death row like private cell, commissary brought to your cell, and a tv in your cell. He won't get all that at Cochran but he will still have it a lot easier than he should. |

Also California death row inmates don't have to have prison jobs. I agree with other posters Hollywood would get his ass kicked in prison. I do feel sorry for the woman he was engaged to in Brazil. He used her and impregnated her in an attempt to avoid extradition. I feel sorry for her and her son. Both are victims of Hollywood.
