Default McDonald's sued over nude pic leak

A man who left his phone in a McDonald's restaurant is suing the company after nude pictures of his wife leaked on to the internet.

Phillip Sherman forgot to take the device with him when he left the Fayetteville, Arizona store in July. According to the lawsuit, employees found the phone and promised to secure it until his return.

Sherman and his wife Tina are now suing McDonald's Corporation, the store manager and the franchise owner after pictures on the phone were posted online.

The couple are seeking $3 million (£2 million) in damages they claim were incurred by embarrassment, suffering and the cost of having to move house.

First of all if you have nude pics of your wife on your phone you should use the security phone lock feature. So that if you are an idiot like this guy and leave your phone behind no one will be able to look into the phone cause it will be locked. What a moron.

Well, I think that both parties are to blame here, 50/50...him for leaving his phone in the restaurant, and the employees for posting the pics; whatever he might win in the suit (assuming that he wins), he should only receive half of the money

they should probably just be suing the individuals responsible for the leak, rather than the whole corporation. the employees offering to keep the phone secure for him wasn't part of business. posting the pictures was definitely illegal.

also, i wouldn't say that this is the guy's fault. leaving the phone behind didn't give anyone the right to open it up and go through everything saved on there. you don't exactly see all the pictures just by glancing at the outside of it.

Exactly! Who takes nude pics of their WIFE and leaves them on their phone??? He's probably freaking out because it ISN'T the wife and knows she's going to find out!

And yes - I have mine password protected at ALL times. Don't need a $40,000 phone bill if I lose it - and this clown had even more to lose.

In this day and age, it's his own fault and I hope the court throws this right out, laughing at him.

When I started to read this, I had no sympathy for the guy because I figured that maybe it was a fellow customer who posted the pics, but considering the fact that it was an employee of the chain, I think he has every right to sue. As Sarah said though, I also don't agree with him suuing the whole chain. I don't think an entire corporation should be held responsible for something that a couple idiots did. I could understand him suuing the particular McDonalds where it happened, but definitely not McDonalds as a whole.

Generally speaking, a place of employment is responsible for its employees actions on the job, so, the suit is valid...but, he should share responsibility 50/50
