Mom Of Toddler Found Wandering Highway Pleads Guilty
Prosecutors To Seek Prison Time For 31-Year-Old

INDIANAPOLIS -- A woman whose 3-year-old son was found wandering on a busy highway pleaded guilty Monday to child neglect charges shortly before her trial was to begin.

Nancy Dyer, 31, was arrested Dec. 30 after motorists found her son running on Interstate 465 on the city's northwest side, wearing only a diaper and a T-shirt. Though the boy was not hurt, Dyer admitted in court that she was sleeping and did not adequately supervise him and his younger sister.

Marion County Prosecutor Carl Brizzi said his office would seek a two-year prison term for Dyer when she is sentenced Aug. 20, though it was possible that she might not be given any time in prison.

Brizzi said it was just happenstance that the boy was not hurt.

"That baby could have been struck on 465," Brizzi said. "We're pleased that she accepted responsibility for her actions ... that put her children in a life-threatening situation."

Dyer's bench trial on four counts of neglect of a dependent was to begin Monday. She pleaded guilty to three counts in an agreement with prosecutors.

"I think happened was she realized she was going to get convicted and she stepped up and she accepted responsibility," Brizzi said.

Prosecutors will argue for the maximum sentence of three years in prison, with one year suspended, Brizzi said. Dyer also might avoid any prison time at all, the prosecutor said.

She could have received up to six years in prison had she been found guilty in trial, 6News' Rick Hightower reported.

Authorities said at least six cars and a semitrailer swerved into other highway lanes to avoid the boy, who, after leaving the family's second-floor apartment, got around a fence and onto the highway about 200 yards away.

The children were taken into protective custody when investigators brought the boy home and found Dyer asleep and her 2-year-old daughter eating spaghetti that had been tossed into the trash the night before. The apartment was piled with trash and had what appeared to be human waste or dirt smeared on walls, according to police reports.

The boy also had left the apartment without his mother's knowledge two days earlier and was walking barefoot in a parking lot when employees of the apartment complex alerted police, authorities said.

The children now are living with other relatives while child welfare authorities determine Dyer's suitability as a parent. Dyer is allowed supervised visits with the children.

They need to DETERMINE her suitability as a parent???? The woman sleeps while her kids eat out of the garbage can in a sh*t encrusted room and run around on the highway...... and they arent SURE if shes a fit parent???????? Ummmmm HELLO??? Answer the phone, its OBVIOUS calling!
