Default Young Boy Served Alcohol At NY Diner

(CBS) NEW YORK An Applebee's restaurant in New York City gave a 5-year-old boy a beverage he won't be able to drink legally for another 16 years. The boy's mother is taking Applebee's to court.

Cynthia Pereles can't understand how someone put Long Island iced tea into her son Seth's kiddie cup instead of the apple juice he ordered.

Seth took two sips and immediately spit it out, but then he couldn't stop laughing and started licking bread baskets.

Paramedics took Seth to the hospital to be rehydrated and he is OK.

But his mother is suing for $75,000.

"I think that they handled it in a really unprofessional way and they just showed no care, no concern whatsoever," Cynthia Pereles said.

Applebees admitted the mistake, but had no comment on how Seth could have been served alcohol.

This behavior is normal after a few drinks. Just ask TJL.

Kidding aside, that's an unfortunate mistake. I tended bar for years, and I can't see how that could have happened, especially since it's served in a kiddie cup.

how do you accidnetly put long island ice tea in a sippie cup? I might be able to understand it if you were serving the kid the tea in a regular cup, cause afterall, apple juice and long island ice tea and look very alike in a cup... but no in a SIPPIE CUP

That does show pretty pathetic management on the staff's part. And if it was intentional, that's awful. But, I'm not really that disturbed by this. I mean, I know people who give babies alcohol for teething, and who put it in their kid's cough syrup to make them sleep when they don't feel well. I don't understand how she can get $75,000 when nothing happened to the child? I understand her being upset by the mistake, but $75,000 for an accident where her child was unharmed?

She might want to watch her own drink....
