Angry One of my friends is going to jail

one of my friends is going to jail, they haven't sentenced him yet, but it could be up to 10 years, for being at the wheel when his best friend was killed.... HE WASN'T AT FAULT. This really ticks me off. Why is he getting sentenced when it wasn't his fault? He's also dealt with a lot of personal demons in the 2 years since this happened. He was sober when this happened, and it also caused him to spiral into depression. I don't get why he goes to jail for 10 years (well, the max), if he gets 10 years, he will be 37 when he gets out, and he just finished college to get a law degree... do you think he'll become a lawyer in 10 years, especially with a crime record. 9 years of college wasted so he can manage a McDonalds? I thought he had a lot of promise too, he was so driven and really busted his butt working 3 jobs at once to support school.

I don't get the justice system. My friend will be in jail from 3-10 years over NOT being at fault for someones death, while Vince Neil of Motley Crue was drunk and at fault and got all of 30 days in the slammer because he's a celebrity?

Ummm, I probably need to hear more facts, but how could he be at the wheel when his friend was killed and not be at fault? Was he speeding or driving recklessly?

Well, thats why they have investigations. If the police do the investigation right and he's innocent like you say he is, then he has nothing to worry about.

It sounds like he's already been convicted though. BuffySlayer79 said he is up for sentencing.

If an innocent person is going to jail, this is incredibly sad.

I have heard of people going to law school with felony records. It could still happen for him. I hope he gets out early and can continue with his original plans.

Negligent homicide. Learned about it in law class. No matter what they did or didn't do wrong in a car crash, both parties ALWAYS claim blame.

Oh, my mistake--I thought he was going to law school. Well, I have heard of people going to law school AFTER felonies, and I know they still can get jobs after they graduate. I agree, with the sentiment of "who will hire him," but it still could be possible. I wish him the best of luck.

Well, I don't know about that. Being in a crash doesn't necessarily indicate neglegence. What if, for example, Car A is following all the rules of the road, and an oncoming car, Car B swerves into the opposite lane, crashing into car A, and killing the driver of Car B. How can Car A be to blame? They didn't do anything neglegent.

I don't know about the case of BuffySlayer79's friend, of course, so I can't say if it was neglegence on both parties or not.
