The jury finds her guilty, What do you think should have happened?

I am satisfied with the verdict. She got what she deserved. I do believe that she does suffer from mental illness, but I don't buy the fact that she didn't know what she was doing when she waited for her husband to leave for work, filled the bathtub, and dumped her children in one by one. Those poor, innocent children did not need, or want, to die. I hope she gets the death penalty. She'll die in a much calmer, more pleasant way than her children did, but at least she'll pay for her crime.

A lot of people i've talked with think that they should drown HER in a bathtub! That'll teach her!

This woman methodically hunted down each of her children, dragged them through the house as they struggled to get away, then held them under water under they died. She repeated this process until she succeeded in killing all of her children. I have no sympathy for her. Give her the death penalty.

When this story first broke, newswoman Katie Couric, while reporting the story, felt compelled to talk about the legal defense fund set up for Andrea Yates. Couric then twice repeated the phone number for those wishing to contribute to the fund as though Andrea Yates was the victim in this horrific crime! I'm sure the "Free Andrea Yates" crowd will be mobilizing before too long.

I was saddened when I heard she was found guilty. I know she drouned her kids, but she was homeschooling like 6 children, while she still had physchosis, and was having delusions that the devil was talking to her! I mean, her own HUSBAND, despite loosing his children has defended her till the very end, as have her doctors, who know her best. The people don't know her are the one's that think she should be found guilty, and the people who know her BEST think she was innocent! I just don't think she should've been found guilty, this is all my opinion.

One thing that sickens me about this country is that criminals have many more rights and advocates than their victims do. I personally feel no sympathy for Andrea Yates, or anyone who commits a crime.

She DEFINITELY should have been NOT GUILTY . There have been SO many phsychiatrists or phycologist that have described how mentally ill she was. Post Pardum Depression and Skitsafrinnia are both very horrible. My guess is that the jury got emotional at the description of the children's death so that they couldn't think clearly.

BTW, I don't think in a way that allows "opinions" . There is RIGHT and there is WRONG. She was OBVIOUSLY not guilty because of her problems. I know this is right. I know the opposite is wrong. Opinions only exist in other matters.

In case you don't think skitsafrinnia is horrible, I saw a show telling people about it on (I think) the discovery channel. One girl said she saw a hooded figure in black that sometimes SPOKE to her, or even try to KILL her.

Exactly. She should not have been left alone. Her and her husband both knew she was going to do something very drastic one of these days, and it just happened.

Sorry, but I don't think mental illness should be used as a way to get out of a crime like this. Fine, she was ill, but then why didn't anyone do anything about it earlier?? This wasn't her first case of postpartum depression or psychosis. Plain and simple, a.) something should have been done earlier to help her with her illness, and b.) she honestly should have been strongly advised NOT TO HAVE ANYMORE KIDS! (Was she ever?) But because none of it was done, 5 innocent children suffered. Perhaps they're in a better place now though.

My thoughts exactly, Dawsongirl. I do believe that Andrea Yates really is mentally ill, but that's still no excuse for what she did. She committed a heinous crime and she should pay the price for her actions. I'm tired of people claiming insanity for committing a crime. I think anyone has to be mentally warped to be able to intentionally harm or kill another human being.

This is precisely the reason I feel sorry for Andrea Yates as well as for her poor children.

I am not sure how I feel about what the verdict should have been. I think that for laypersons (the jury) to have to try to translate medical information into a legal setting is a very hard thing to do...

But from what I've heard of this case, there is absolutely no question in my mind that this women was sick. I am not convinced she was in control of her faculties when she did this. The psychiatrist on the news tonight said that postpartum depression can lead to psychosis, and that in these cases the psychosis has a tendency to get worse with each successive child.

There is room in my heart to mourn the loss of this woman, who was so obviously in need of help, and no one reached out her. If someone had tried to help Andrea a long time ago, say after the first or second child, this probably would have never happened.

Less than 1% of all crimes that go to trial use an insanity defense.

Only about 25% of that 1% are argued successfully.

In nearly 80% of that 25%, both the prosecution and the defense agreed on the appropriatness of that plea before trial.

The only reason people are "tired of it" is because those are the cases we hear about the most, because they are the most sensational.

They are far and away not the norm, despite what the popular media may lead you to believe.

For the most part, I agree with what's being said. The woman seriously had issues, HOWEVER, she knew what she was doing. She wanted her children out of the way. Therefore (by the laws of Texas) she was not insane.

I think insanity should only be applied to people that are seriously gone - that don't know what happened, that wonder what is going on, and what they've done. The insanity plea was invented to protect the insane, not cover up the guilty.

She had problems, but doesn't everyone who commits a crime? For the most part, I don't believe that Andrea was going through anything that deserved any kind of sympathy. She had a tough time, okay. There's still no excuse for what she did. None. No matter what the woman had gone through, murder is murder.

I don't personally agree with the death penalty, however there are exceptions. Ted Bundy deserved it. I have to say, if Andrea gets it, I won't be upset - justice will be done. If not by us, then by a higher power.

Just because she shouldn't have had more kids, and shouldn't have been left alone w/ them doesn't make her responsible for her mental illness.

What I kow what I beleive is correct. If you don't think the same thing about what you say, then for all you know your wrong!! Mental Illness is obviously a reason to be proclaimed non-guilty to anybody who has heard anything about it.

I'm not saying they didn't make some bad descisions. I'm just saying she should not have been proclaimed guilty.

It bothers me when people don't see the difference between apples and oranges. You're shouting past us on the board. Step back and think about what is being said and what you are saying. Who are you talking to when you say, "No one should kill their kids."? No one hear is allowing for that. The point is mental illness played a part in her actions, which makes this tragedy even that much more of a tragedy. There is always another matter to consider in instances such as this, and that is - why and how could this person have been so out of bounds, yet apparently no one noticed enough to keep from happening what happened. We need to try to learn from horrible tragedies in order to see them coming and attempt to prevent them in the future. Shouting past one another doesn't contribute much to that cause.

I agree with the verdict because if she was able to call 911 right away, and from what I heard doctors say it took a long time for her children to die, she could tell the difference between right and wrong. I agree that she had a lot of problems but that doesn't justify murder. MJF Fan, how can you think abortion is murder even if it was rape, and then defend Andrea Yates?

That is beside the point. If even with her mental illness she could tell the difference between right and wrong and therefore knew what she was doing, than she deserves to be punished.

The arugument could be made that anyone who intentionally takes the life of another human being is mentally ill. At what point do we draw the line?

If it had been the father (and he's no prize, either!) who had systematically killed each of those children, I wonder how many people would feel sorry for him, and call for leniency by the court? Somehow, I don't think nearly as many people would feel that sympathetic towards towards the father if he had been the killer.

She filled the bathtub with water, took her kids one by one and drowned them while they were struggling to get away, she then proceeded to lay all 5 of their lifeless bodies on the bed and call 911...now i would maybe buy into this whole "she didnt kno what she was doin" thang is she drowned one and then said "my gawd what have I done?!" but f*cking 5 and THEN call 911?! She knew what the hell she was doing and im glad she got life in prison so she can sit there and hafta live with what she did for the rest of her life. Dont get me started on her husband...to me, in his interviews, he acts like he understands why she did this and doesnt care that his children are dead. The woman was quite insane, but I believe she was within her limits to realize what she was doing.
That's FIVE kids, one by one, most of them fighting for their lives.
It's disturbing, really.
I don't know, I think doctors should find out what's wrong with her. To find to deep reason to what triggered her "killing" streak.
I do believe she needs major help, and if she has to spend the rest of her life receiving it, fine.

But I don't think we should compare her to Jeffery Dahmer. He was just SICK in that sane sort of way. Which is worse than the insane way.

A reminder: you wrote that quote in reply to my reply that her mental illness should be recognized and considered and we should learn from it. I'm sure that she wouldn't be allowed to return to life as usuall. I don't know what the process is for someone who commits a heinous crime who is deemed to be mentally ill. I imagine that life in a mental institution would be no bed of roses though. And hopefully, someday, someone elses life would be spared because of whatever could be learned by studying Andrea Yates illness rather than locking her away and not learning anything about the symptoms of maddness, the clues to watch out for and maybe how to prevent the next Andrea Yates from carrying out murderous plots.

What else are we supposed to look at here? Are we just supposed to forget that she chased her children down the hall one by one tackling them, drug them to the bathroom and then held them under water until they were no longer moving? Are we supposed to just forget that when two of them were still breathing after she held them under the water she took them to the bedroom where she held something over their mouths to finish killing them?

She knew EXACTLY what she was doing when she murdered all of her children. She was sick, I'll give you that, but she knew what she was doing. If she didn't know it was wrong why did she call 911 and say so calmly that she had just killed all of her children. I'm sorry, she knew EXACTLY what she was doing when she killed her kids and personally I believe she should have gotten the death penalty. Oh well, one day, she will die and she will have to explain herself to the Final Judge. That will truely be her sentencing day.

And as for telling me to "Wake up" maybe it is YOU who needs to wake up here and see that she just KILLED all of her kids. Thank about that. Would you want her living next to you knowing that she has already killed all of her kids?

First let me start off by saying that in no way am I trying to justify what Andrea Yates did or excuse her actions in any way. I too am horrified with what happened. I just think there is a lot of misunderstanding about this case.

It is apparent from some of these posts that mental illness is a very misunderstood DISEASE. This lady had a disease. People act as if someone with a mental illness can turn it off and on or somehow control it or even understand what they are doing. As if she could somehow still think clearly during her psychotic state. That's just it – the definition of a psychotic illness is that the person is NOT thinking clearly or logically, and NOT in touch with reality. Do you really think that if she were sane she would have done what she did? NO WAY. I'm fairly positive this mother will be forever haunted by the awful fact that she killed her own children, something she would never have done had she been healthy.

I had the opportunity to watch a video of a psychotic person in a psychology class once. It was very eye opening. Trust me, psychotic individuals are not thinking rationally. Just watching this person on tape made me anxious because of how irrational and unstable they were acting. Psychotic people do weird things, scary things, and things that don't make any sense to you or me.

My point is, a psychosis could very well make someone do something as horrendous as killing their own children without truly knowing what they are doing. The fact that she called 911 doesn't prove she knew what she was doing. A psychotic person can still call 911. In fact, most sane, cold-blooded killers attempt to hide the evidence, or they lie about what happened, or they flee the scene. Most of them don't call up 911 and announce that they just killed someone. They don't want to get caught.

I am very saddened by this tragic story. These poor kids died because of a very ill person – it should have never gotten to that point. This is why mental illness needs to be treated as a real disease because it can have very serious consequences!! If you are able to say that she still knew what she was doing then you are denying the problem. If psychotic people know exactly what they are doing then they should be able to stop themselves right? Wrong. And by thinking that way we aren't going to prevent this from happening again.

I would feel anger towards my spouse and I'd also be really sad that my children died. I saw Russell Yates on Oprah today and he seems to not care at all that his five children are DEAD. He didn't even shed one tear nor is he mad at Andrea at all. He said that the reason they continued having kids even though Andrea was definately sick is because the Lord wanted them to have more. And he also felt it was okay because he was used to how she reacted after she had her kids so he thought they could treat it well. That seems so ridiculous to me to expect a mental illness after your wife has kids but then to not worry about it because he feels that it could be treated... but didnt he ever think it could get worse after having so many kids for her to take care of? It also seems like he didnt really do anything around the house. On some morning news show Andrea's family stated that he never changed a diaper. It is just shocking to me how unemotional he is.. how can you look at pictures of your five dead children and know that you're wife is spending life in jail and not cry at all? I dont think either of them are quite right in the head.

I would feel anger towards my spouse and I'd also be really sad that my children died. I saw Russell Yates on Oprah today and he seems to not care at all that his five children are DEAD. He didn't even shed one tear nor is he mad at Andrea at all.

I'm sorry, I just had to come back this topic. That man was OBVIOUSLY upset. He was very flat and distant and definitely greiving. Not everyone grieves by crying. Everybody does it differantly. I think Oprah was a bit mean to him.

These people's minda work in weird ways when they have these mental illnesses. Her calling 911 is no t proof. Everybody who knew her well (her docters, family, etc.) could tell she was ill.

I'm not saying they didn't make bad descisions. It's clear that they did and I don't have a high opinion of them. I just think she should not have been declared guilty.

Let me ask you a yes or no question MJFfan.

Did she or did she not take the life of her 5 children?

Yes, she did.

Well, if she did, then she is guilty of murder. What other conclusion is there?

I'm not trying to speak for MJFfan but I just wanted to add something.

I don't think there is any denying that she committed murder but there are different degrees of murder. For example, if someone broke into your home, pointed a gun at you, threatened to kill you and therefore you shot and killed them to protect yourself, would that be murder? Yes it would. Should you be declared guilty of murder in the courts? Depends on what type of murder you're being charged with. Should you get the death penalty? I don't think you should.

I am not trying to say that killing in self-defense and killing due to a mental illness are the same thing. My point is that murder is not so black and white, and the punishment should not be either.

Sorry to resurrect a "dead" post, but I just wanted to say that I am 100% behind everything that Lynn said.

Great job Lynn, on stating your opinion in a thoughtful, clear, and polite manner, and I agree with everything you said! And BTW, I have also watched videos of phychotic people in Psych class, and I agree with everything you said about those too.

Yea I was gonna look for this topic....

I just read the book "Breaking Point" by Suzy Spencer. It's all about the whole Andrea Yates thing. These people....lordy. Their 5 year old son was still in diapers! Rusty's mom came to their house every day for 2 months. One day she found Andrea randomly filling the bathtub with water and she said "We might need it." I mean, the man knew his wife was messed up, why would he leave her alone with 5 kids in the first place?!? I suggest you people read that book. There are people from NASA (where Rusty work) who say that he went out with his friends for lunch and was happy and laughing and having a jolly ol' time like, as they put it, "his wife just burned his dinner." Wouldn't someone with half a heart at be the least be upset and not...giddy? Mrs. Garret couldn't laugh after her dad died!!

Once again, I totally reccommend reading that book! I know so much more now...

I haven't read "Breaking Point" but I have read reviews. They're, for the most part, positive but they say that the book was rushed. It's depressing that the writer and the publisher rushed something onto the market, when it was written about such a sad, awful tragedy. The writer takes on the greed and denial of the insurance companies and society, while committing a distatseful offense herself-- sacrificing quality and detail by rushing her story in order to publish a book before it was finished. I'm not disagreeing with Nancyrules that reading the book could be an eye opening, learning experience about mental health. It's just that rushing the book has to have left some wrong impressions and seems crass.
