Littleton, Colo. -- A Colorado teen was recently arrested after he checked out a DVD from a library and forgot to return it, Denver TV station KMGH reported.Aaron Henson, 19, claims it was an honest mistake, saying he checked out the DVD and then inadvertently packed it while moving.
It’s worth about $30, but it has ended up costing the Hensons hundreds of dollars and many headaches.

The teen was arrested during a traffic stop on Interstate 70 a few weeks ago on a failure to appear warrant from the city of Littleton, said Allen Henson, Aaron's father.Allen Henson got the call at home and couldn’t believe it. His son was in jail for an overdue DVD from Littleton's Bemis Library.“This is a clear violation of his right to due process,” Allen Henson said.

According the family, Aaron had packed up the DVD, “House of Flying Daggers,” as he was moving last fall. The library said it sent notices to Aaron Henson's old address and left two messages on his cell phone. “He never got any of those notices or anything. He says he never got a phone call from the library, never got a message from them,” Allen Henson said.

The Hensons ended up paying about $460 for the $30 DVD: $200 to get Aaron out of jail, $200 to get his car out of the impound lot and $60 in court fees. All charges were dropped, but the arrest remains on Aaron’s record. The family is now working to get the arrest erased from his record.
Littleton Mayor Doug Clark said the city plans to change its policy on overdue DVDs and books as a result of the case. "We're not going to arrest people who don't return $30 DVDs," he said.

Honestly sometimes the Library system can be dysfunctional. I accidentally lost a DVD and so of course I went to the Library to replace it. When I asked how much it would cost they said their list price which was $29.99. When I went to a store nearby I found a brand new copy of the DVD for $11 but they told me I couldn't just replace it - I had to pay the $30. Well in this economy, besides from a pt. of logic, this was so nutty I called my local councilperson and complained - my CM - who is just great -intervened and the Library (finally) let me replace the used video with the brand new unopened one.

That's pretty extreme for an overdue DVD. I hope the arrest gets off the kid's record. When I was in high school the librarian in my high school was horrible. She would make bitchy comments if a book was overdue one day.

Instead of arresting kids who have overdue books, how about going after the real trouble teenagers who are commiting crimes.

Man it's tough enough to get kids to go to the library these days. Do they have to scare them off like this? And like Mickey said there are better things for the people involved to do with their time and resources.

And police catch those criminals when they are able to. In this case, they
had to arrest the boy because there was a warrant for his arrest. What
were they supposed to do, ignore that warrant?
I think some of us were hoping the Police would use some common sense and realize that the warrant wasn't warranted.

I did not read the article fully until recently, but the arrest warrant was actually for failure to appear. It seems he was fined for the overdue DVD and did not appear in court like he was supposed to, so a warrant was issued for his arrest. If he had just appeared in court to pay his fine, there would not have been a warrant issued for his arrest and everything would have been fine. I am still glad the law got changed, but it was still his fault he got arrested. I have removed my previous comments because I made them without knowing the whole story.
