hey guys, this is a fanfic that comes after "Virgin Territory" and before "Intervention" , just to let u know http://www.sitcomsonline.com/ubb/smile.gif

Warning: this fanfic contains subject matter dealing with sexual assault. (note: it's after the ep where jin was in jail...)

***JINNY'S APARTMENT***
The alarm clock went off at 6:45am and Jinny Exstead rolled over to hit the snooze button. She knew she had to get up, take a shower, and get to work, but each day was a struggle to get out of bed. She felt horrible and worthless. Ten minutes later the alarm clock went off again, and Jinny sat up and turned it off. Her hair was disheveled from sleeping and her eyes were puffy. You could tell that she had been crying.

Getting out of bed, she looked at herself in the mirror and realized she didn't like what she saw. Starting to cry again, she picked up a boot from the floor and threw it against the mirror, shattering it into little bits.

***MAGDA'S HOUSE***
Magda Ramirez studied herself in the mirror. 'Not too bad today' she thought. Going over to her bed, she sat down and picked up the telephone to call Gabriel and let him know that Ben needed to be picked up from school today. Letting the phone ring, she glanced at her watch. It was 7:05 am. Jinny would be here in 20 minutes to pick her and Ben up.

When Gabriel answered the phone, Magda smiled to herself. She loved to hear his voice, even though she didn't want to admit it to him. "Hey Gabriel." She waited for his reply and then went on. "Yes... just calling to let you know that Ben needs to be picked up from school today. Uh huh. Thanks. Yes Gabe, you too." Hanging up the phone she went into her son's room and checked to see his progress.

***JINNY'S APT***
Jinny walked out of bathroom in her robe. Her hair was still wet and even the shower didn't hide the fact that she had spent most of the night crying. She just couldn't shake this feeling she had inside her... this feeling of disgust. It had been two weeks since Magda came and bailed her out of jail. Two weeks since she had refused tests. Two weeks since she was raped. Sighing, Jinny searched around for some clothes for her to wear. She didn't even care what she wore anymore... it didn't matter.

'Maybe I should tell someone' she thought for the millionth time since Magda brought her home. Then she shook her head. She knew she wouldn't tell anyone what really happened. Ever. They would just confirm the fact that she was worthless and deserved it. Sitting down on her bed, Jinny started to cry again. 'I need a drink' she thought and took out a bottle. Taking a few swigs, Jinny felt better and slowly got dressed.

***MAGDA'S HOUSE***
Magda looked at her watch. It was 7:30, and Jinny was 5 minutes late. Just as she picked up the phone to call her there was a knock on the door and Magda went to answer it. When she did she was concerned about what she saw. There was Jinny, her hair still a little damp, her clothes not ironed, and wearing sunglasses that almost covered up the fact that she had been crying. But Magda noticed. Magda had noticed this almost every day for two weeks. Almost every day since she brought her home from jail.

'I wish she would talk to me' she thought as she put on a fake smile and told Jinny to come inside. "Benjamin! Jinny's here! We have to go!" Magda grabbed her coat and took one last look at Jinny. She didn't know what to do. Jinny looked so sad, but every time she asked Jinny if something was wrong, she snapped.

Jinny noticed Magda looking at her and knew what she was thinking. 'She's thinking I look horrible and disgusting... well, she's right.'

Ben walked out into the living room and Magda smiled at him. "Ready?" Ben nodded, and Magda, Ben, and Jinny walked out of the room in silence.

***The Division***
Jinny and Magda walked into the division at 7:56am. CD and Angela were already there, working on a case. Jinny walked over to her desk and sat down. Taking off her sunglasses, she forgot about how she probably looked until she caught Magda staring at her. "What?!" she said angrily. She didn't have the strength to deal with this today.

"Jinny... are you ok? You've been..." Magda didn't know what to say. All she knew was that her best friend looked like she had lost everything important to her in the world. "You've been..."

"I've been what, Magda? Please... do enlighten me." Jinny stared at Magda, almost daring her to speak. Magda said nothing, and after awhile Jinny just sighed and looked away. "That's what I thought..."

Captain McCafferty walked out of her office. She was glad to see that everyone was here, but when she saw Jinny, her heart fell. She didn't know what to do about her.. she didn't know if it was drinking or something else that was affecting her performance, but whatever it was it had to stop. "Cases" she announced and went over to Jinny and Magda.

Magda looked up as the Captain came over and smiled wearily. She knew the Captain saw the difference in Jinny too, and she was worried about what the Captain would say... she didn't want Jinny to do anything irrational. "What do we got, Cap?"

"Female... age 29. Currently at the hospital. Claims she was raped after a night on the town. The doctor's found excessive amounts of alcohol in her system..." Captain looked at Magda and Jinny. Magda seemed to be absorbing the information on a factual basis. Jinny, on the other hand, looked on the verge of tears. Not knowing what to do, she went on. "We need you to go over with a sketch artist and get a sketch of the guy... as much as she remembers. And get her full medical report... find out if the conclusions are simultaneous with a rape."

Magda nodded and grabbed for her coat and the file. As the captain walked away she looked towards Jinny. Tears were rolling down the brunette's face and she seemed unaware of anything around her. Magda was worried... something was going on... and she thought she knew what it was. But again, every time she brought it up, Jinny just snapped at her and it got them nowhere. Sighing, she decided just to go over and get Jinny's attention and worry about it later.

When Magda touched Jinny on the shoulder, she jumped and uttered a little scream. Everyone in the room turned to look at her and she remembered where she was. Feeling the tears running down her face, she quickly wiped them away with the sleeve of her shirt and turned towards Magda. "Don't do that." She didn't know what else to say... didn't know what to say to explain her behavior. Instead, she got up from her chair and nodded towards the door, leaving Magda to follow her.

***THE HOSPITAL***
By the time Jinny and Magda arrived at the hospital, Magda was extremely worried about Jinny. There were no sarcastic remarks, no chit chat. Nothing. Magda was sitting next to a woman who looked as if she lost all hope... she looked worse than she did when she found her in jail two weeks ago.

That thought brought up the same question Magda had been asking herself since she found Jinny... was Jinny raped? All the signs pointed to it. The cop described how they found Jinny... her pants and underwear around her ankles... her jacket still on... unconscious... she refused tests. Magda's head was swimming and it wasn't until Jinny said "we're here" for the third time that she noticed.

Jinny couldn't do this. She couldn't go into this hospital and deal with this. She didn't want to talk about rape... that was the last thing she needed. Knowing, however, that people would suspect even more if she refused this case, she went along. Stepping out of the car, she looked over at Magda, who was staring at the hospital. "Ready?" She tried to say it without a waver in her voice, but she failed.

Magda heard the voice of a scared child when Jinny spoke that one word. She knew the answer to her own question just from that one word. "Yeah" she said, and started walking towards the building. She couldn't look at Jinny... if she did, Magda knew she's start to cry. Her best friend was raped... she knew it. 'But how do I get it out of her?' she questioned herself as they walked into the building.

***HOSPITAL ROOM***
The hospital room was barren. Meagan looked around the room and wanted to die. She had never thought she'd end up like this... never. A tear ran down her face as she thought about what had happened to her the night before.

*~*flashback*~*
Meagan was sitting at one of the local bars... she went there a lot lately. In fact, after she lost her fiance in that fatal car crash, she'd been there everynight... and that was over a year ago. Since then, alcohol had been her savior, and she'd had plenty of gentlemen callers... but she would never have sex with them... only other things.

As she was sitting at the bar, a man came up to her. He was good looking... dark hair, piercing eyes and a slight gotee. Smiling, Meagan looked at the seat next to her, and he took it as an invitation to sit down. "Hey."

"Hey" the guy moved closer to Meagan and blew in her ear. She knew she shouldn't do this, but Meagan was good at playing games.

"So what's your name, good looking?" Meagan knew what to say.. when to say it.. everything. And this guy was definitely taking it, hook, line, and sinker.

"Joe." he said with a grin. "Wanna... join me in the bathroom?"

Meagan was used to this. She's often go into the bathroom for some makeout sessions, then hurry out, leaving the guy paying for her tab... and this sucker was no different. "Sure" she smiled and winked at him. By this point she was way beyond drunk and she stumbled into his arms. He held her up as he walked her to the bathroom.

*~*end flashback*~*

'But this time it didn't end like usual' she thought and started to cry again. This time she went into the bathroom with him and he forced her to have sex... she was too drunk to fight him off. As Meagan thought about last night, she didn't notice two women entering the room, and when they spoke, they startled her.

"Meagan?" Magda quietly spoke. The woman jumped. "I'm Magda Ramierez... this is Jinny Exstead... we're with the SFPD." Magda looked the girl over. It was obvious something bad had happened to her. She looked vulnerable, depressed, haggard... she looked like Jinny did. Magda stifled a gasp as the thought struck her; she didn't want to think about that now.

When Jinny saw the girl laying in the hospital bed, she wanted to throw up. She couldn't be here. 'Why did I convince myself that I could do this?' she thought to herself, as she avoided the woman's gaze.

"We're here to get a statement from you about what happened... a.. um..sketch artist will be in shortly." Magda pulled out a notepad and tried not to think, but Jinny's expression caught her eye, and her thoughts immediately went back to her best friend.

Meagan looked at the officers. The one, who spoke, seemed very professional about things, but also sympathetic. The other one... looked scared. 'Scared?' Meagan thought 'Of me?' The thought made the tears come again, and she quickly wiped them away with her hand. "I..." she started, but broke down crying.

Magda was jolted back to reality when the woman on the bed started to shake with sobs. Walking closer, she tried to console her. "Hey Meagan.. it's ok... we believe you. And we're here to help. I know it must be rough... I know." Magda now stood by the side of Meagan's bed.

Meagan looked up at Magda and for some reason felt that she could tell her and she would believe her. Sighing, Meagan started... telling the whole story.

"... and then... he... forced me.." Meagan started to cry more, and Magda was there to hold her hand while she told the story. After about a minute, she was able to go on. "He forced me to have sex. I didn't want to. I cried.... and... I said no..." she trailed off, crying again.

Magda knew instinctively that the girl was telling the truth. "Hey...that's good for now, Meagan, ok?" She patted the woman's hand and turned to her partner, whose face was ashen. Concerned, Magda walked over to Jinny and touched her arm. "Jin?"

Jinny looked at Magda with fear in her eyes. She didn't know what to do. Listening to that girls story was like listening to what had happened to her two weeks ago. "What... what did he say his name was?" she whispered in a voice it was almost inaudible. But Meagan heard it.

"Joe." she whispered back. She wondered what was going on with the one inspector... she didn't look well. As much as she was feeling horrible, she knew when someone was genuinely scared, and this inspector, Jinny was her name, was.

Jinny couldn't take it anymore. Running out of the room she just ran to wherever she could go. She needed to get out of here no matter what it took. Finally reaching a bathroom, she opened up one of the stalls and let loose. Tears came quickly, and she shook while she cried. She didn't hear the bathroom door open. "Why?!" she screamed at no one and hit the wall of the bathroom stall, causing it to shake on it's hinges. Sobbing even more now, she slid down to the floor, burying her head in her hands.

When Magda walked into the bathroom she could hear Jinny crying. Soon afterwards she heard Jinny's outburst and the sobs following it. Rushing over to the stall door, she knocked on it. "Jinny? Hun.. it's me." The crying slowed, and Magda could tell Jinny was trying to stop, but she couldn't. "You can cry Jinny, I know what's wrong..."

Jinny couldn't believe what had just came out of her partner's mouth. 'How could she know?' she thought, and then she realized that was a stupid question. Magda had seen her these past weeks. She had seen her in jail too. Her sobs got harder and her body shook more. She couldn't hide it anymore and letting it loose felt so good.

Magda leaned against the door. She could tell her friend was finally letting it all out and she wished she knew what to do... what to say. "Jinny... can you open the door?" is all that she came up with, however. To her surprise it worked.

When Jinny opened the door, Magda took her into her arms and hugged her. Jinny just stood there, sobbing on Magda's shoulder. "I... I can't do this..." she stammered "I can't live like this..." Jinny held onto Magda tightly, not wanting to let go of the one person she thought still cared about her.

Magda held Jinny and rocked her back and forth. She still didn't know what to say, but she would try anyway. "Jinny... do you want to talk about it?"

Jinny let go of Magda slightly and looked at her. Wiping her tear-stained face, she nodded wearily. "Not here" she managed to whisper as more tears fell from her eyes.

Magda took Jinny into her arms again and led her towards the door. "Let's go home... to my place. You can tell me there, ok?" Jinny nodded, and Magda manuvered Jinny through the hospital and out to the car.

***MAGDA'S HOUSE***
Magda looked at Jinny who was laying curled up on the couch. Not wanting to push her, she just rubbed her back, trying to ease Jinny's crying a little. They had been like this for at least a half hour now, and Jinny was slipping further and further into a depressive state.

All Jinny could do was think. She kept reliving that night over and over again. 'If only I hadn't drank so much' and 'If only I never went out to the alley with him' kept flashing across her mind. She felt imbobile... stuck somewhere that she couldn't escape from. She didn't deserve the attention Magda was giving her... she never deserved it. Her mother knew that. 'That's why she did it' Jinny thought, and wanted to die. There were no way around these feelings... she just didn't want to be here anymore.

She kept thinking about her life... how she had made herself a target for sex. Everyone knew she slept around. Everyone knew she drank until she couldn't feel. Everyone. She never wanted it to be like this, but she was so worthless that that's what it ended up being anyway. 'I thought when I made inspector things would change' she thought. But they hadn't... they had just gotten worse. She had to deal with the fact that she was a horrible cop on top of the fact that she had a horrible life... she didn't know how Magda delt with her. 'Magda.'

The thought brought her back to facing what was going on. Here she was in Magda's apartment crying about her life. Who deserved to hear this stuff? Jinny looked up at Magda who hadn't taken her eyes off her. "Mag... I..." she looked down and closed her eyes. The images flashed on her brain again and she grimaced. "I was drunk..." she began.

When Jinny started to talk, Magda took her hand and squeezed it reassuringly. She knew this was hard for her, and every word out of her mouth was a step towards feeling better, so the more Magda did to comfort her the more would come out.

Jinny felt Magda's hand and knew she had to continue. All of this was pent up for way too long. Taking a breath, she continued. "And we went out back... and..." she paused, remembering vividly the moment *Frank* left and she was left alone with *Joe.* "One guy.. Frank.. left.. and Joe..." Jinny couldn't go on. What he had done to her made her body shiver... she had never felt so alone and scared before in her life.

Magda noticed Jinny hesitating. "Jin, hun, you don't have to go on if you don't want to." Magda knew that just the mere fact she was admitting something would help a little... she just wished that she knew what to do.

Staring off into space, Jinny sighed. She knew she had to go on... to tell Magda what *Joe* did to her. "Mag.." she said waiting for her to squeeze her hand again. When she did, Jinny continued. "Joe was kissing me... and he started to take my... pants off" Jinny was crying harder again, but she kept going, her voice barely above a whisper. "I pushed him away... he didn't like that. He... he pushed me down on the ground. He... oh god..." Jinny buried her head in her hands. "He hit me... and finished pulling.. oh god.. I said NO, Magda, I said NO!!!" Jinny screamed, sitting up for the first time and hitting the couch with her fist.

Magda gathered Jinny up in her arms and slowly petted her head, murmuring "It's ok, Jin... I'm here..." over and over again.

When Captain Kate McCafferty recieved Magda's call, she was just about to leave for lunch. Picking up her purse and heading for the door, she was interupted by the phone. Sighing, she walked over and answered. "McCaffery. Hi Magda. What? Why?" she paused and listened. Magda wanted her and Jinny off the rape case. When Magda told her what was happening now, her face got pale and she dropped her purse onto her desk. "I'll.. be right there. Call her dad, Magda. (pause) Oh ok, good."

Kate McCaffery decided to forgo lunch that day... she needed to get over to Magda's apartment right away. 'God... I had no idea...' she just kept thinking as she made her way there.

***MAGDA'S HOUSE***
Magda hung up the phone and made her way back to the couch where Jinny lay staring off into space. It had been over an hour since Jinny had told her what had happened, and she hadn't moved from that spot. In fact, except for periodic bouts of crying, she hadn't moved at all. Magda was worried... she wouldn't even talk anymore. It was like she shut down everything except the things necessary to keep her alive.

Crouching down, Magda looked into Jinny's face. "Hey... Jinny??" Nothing. Not even the slightest sign of recognition. Sighing, she got back up and started to pace. "I guess the only think I can do is keep talking to you Jinny. You know it's not your fault... not the rape, not your mother... you know that right?" Magda looked at Jinny, but there was no reponse. "Jinny... god Jinny.. please say something!!!!"

Magda was screaming at her. That much she knew. But she couldn't concentrate on anything. She couldn't respond, she didn't have the energy. All she *did* have the energy to do was think, but she didn't want to. Thinking meant crying, and crying was bad. She didn't deserve the right to cry... everything was her fault. Everything.

Magda gave up screaming and went over to Jinny again, just sitting next to her. After a few minutes there was a knock on the door and Magda got up to get it. When she opened the door, there stood Casey and John Sr., both with tears in their eyes. She had just called them to tell them about Jinny, and she could tell they were taking it hard.

John Sr. walked over to his daughter and the tears he was trying to hold back came so forcefully now there was nothing he could do to stop him. There was his little girl.. his Jinny girl... laying there looking like all of the life was taken out of her. Kneeling down, John Sr. took his daughters hand in his own and spoke. "Jinny girl... it's me. It's gonna be ok, Jinny."

Casey stood and watched his father and sister. He couldn't afford to lose his sister... he just couldn't. When Jinny didn't respond to his father's words, Casey lost it. 'I can't look at her like this' he thought and turned away.

'My dad's here' Jinny thought. She could feel his hand over hers and it comforted her a bit. 'I need to talk' she thought... but she couldn't. It took too much, so instead she just stared. Jinny kept feeling her father squeezing her hand and she hoped he wouldn't stop... she needed that right now.

Magda looked at the father and daughter in her living room. She felt helpless. A knock on the door stirred her from her thoughts and she went to answer it. This time it was Kate. Magda smiled wearily and let her in.

Kate walked into Magda's apartment and found Jinny on the couch, her dad kneeling in front of her, and Casey standing in the middle of the room, avoiding looking at his sister. "Hey Casey. Hey John."

John turned up from his daughter and saw Captain Kate McCafferty standing there. He was grateful that she had come even though he knew Jinny was a handful. "Kate.." he barely got the word out, he was crying so hard. After nodding, he looked back down at his daughter, who still hadn't moved. He just kept squeezing her hand.

Casey whirled around and looked at his sister again, then at Magda and Kate. He didnt' know what to do. There had to be *something* they can do. Instead, he turned to Kate and Magda. "Help her!!! For God's sake... SOMEONE HELP HER!!!" Casey turned towards his father and his sister and rushed over to them. Picking Jinny up, he tried to get her to look at him, but her head kept lulling off to the side. "JINNY!!! Oh God... Jinny...."

'Casey' thought Jinny as she was aware of being sat upright. She tried to look at him, but again she couldn't. 'I want to look at him!!!' she screamed to herself, but with no luck. Tears started to stream down her face, and her body was once again racked with sobs.

"She's crying! She's doing something!!" Casey said excitedly. He hugged Jinny. "Jinny.. Jinny.. please...."

Kate stood there watching all of this in silence. She had never seen anything like it. Jinny was so strong... so stubborn. This wasn't like her at all. "We should take her to a hospital."

John Sr. looked at Kate McCafferty and knew she was right. He didn't need his little girl suffering like this. Edging Casey out of the way, John picked up Jinny and cradled her in his arms. 'She's so light' he thought as he carried her towards the door.

Magda watched as Jinny's dad lifted his daughter up and walked towards the door. Casey stood there crying, following his dad. 'I guess this is it' thought Magda as she grabbed her keys and headed out the door with the captain behind her.

***THE HOSPITAL***
Magda, Kate, Casey, and John Sr. sat in the waiting room of the emergency room. They had just taken Jinny off on a gurney into one of the rooms. None of them said anything to each other. Casey was crying, John was staring out into space, Magda was biting her nails, and Kate was staring at her hands.

A nurse came out of the emergency room door. She was young, about mid-twenties, with blonde hair. She seemed tired and worn-out. "Exstead?" she asked, her voice weary.

"That's us!" John Sr. lept to his feet and walked over to the nurse. Casey, Magda, and Kate followed him. John was a wreck... he couldn't understand what was wrong with his baby girl, and he wanted to find out and tell her it would be okay. "How is she?"

"Well, the doctor would like to see you... all of you" she said, as she motioned towards the doors.

Magda held her breathe. Even she didn't know what was going on with Jinny, and now she would find out. Following the others into the emergency room where Jinny was being held. When she saw Jinny, her eyes welled up with tears. There was her best friend, laying on the hospital bed looking so small and fragile. 'I've never seen Jinny like this' she thought, and she looked away, crying.

Casey almost passed out when he saw his sister. Her face was as pale as a ghosts and she was enveloped in her bed so tightly it was almost as if she'd disappeared. He held his hand up to his face, not knowing what to do or say... that wasn't his sister in that bed.

When Kate entered the room, she gasped. The scene in Magda's house recently didn't even prepare her for this. Laying in the bed was one of the most head-strong, stubborn, cops she had ever worked with, but it wasn't her. Jinny Exstead wouldn't be lying there looking so.. broken. 'But she is' thought Kate, and she too turned away.

John Sr. went right to his daughter's side and held her hand. He looked into her eyes, and saw a faint recognition spark there, but she was still listless. Tears started to pout down his face again. "Jinny girl? Honey?" Again, there was no response. She just lay there as if not in the world anymore.

"Umm.. Mr. Exstead?" the doctor was by his side. "She's not going to respond..."

"Why not?!" Casey yelled at the doctor. This wasn't like Casey at all, but he couldn't help feel the way he did. Jinny was his big sister. Jinny was the strong one. If she broke down, how could he ever survive?

The doctor looked at Jinny's family and friends and felt bad for them. It was obvious they didnt' know exactly what they were dealing with. "Well.. she's depressed. Extremely so. When she came here we gave her some medication, but I'm not sure how good that'll do her for awhile." He looked around again at the faces that stared at him, then continued. "I'm recomending hospitalization... in a clinic..."

John Sr. interupted the doctor. 'How DARE he tell me that my little girl is going to be locked up?!' he thought, angrily. "Just wait one minute here, doctor. I think we can handle this JUST FINE ourselves... just... tell us what we need to do!"

The doctor sighed and looked down. "I know that's how you're feeling, Mr. Exstead, but I assure you she would be better off in a clinic."

"That's what YOU think... tell me, doctor... WHY do you think that?! Don't you think WE can take care of her?!" John was losing it. He didn't want them to take Jinny away.. he couldn't lose her to some... clinic.

Magda watched in silence. She could see both the doctor's and John's point, although she tended to agree with the doctor... Jinny needed some kind of help. She glanced over again to where her best friend was lying and saw again how lifeless she looked. 'She needs help' she thought to herself, as she turned her attention back to the doctor.

"Listen. I'm not saying you can't. But Jinny is DEPRESSED. This sort of depression can lead to all kinds of things... including suicide." The doctor didn't want it to come to this. He knew the issue of suicide was a horrible notion to any family.

Casey went limp and started to cry. At the mention of suicide, his thoughts wandered back to his mother. He had been over a friends house that day... Jinny had found her. 'God, I can't think about this' he thought, but it was no use. The pain was still there, and now he was in danger of losing Jinny too. "Dad..." he managed to get out, before returning to sobbing.

John Sr. turned around to the sound of his son's voice. He knew was Casey was thinking about, and so was he. Sighing, he knew what he had to do and nodded to the doctor. "Okay. Where... where do I sign?" John looked down at the floor and a single tear fell down his cheek. 'All I want is my Jinny girl back' he thought, as he waited for the doctor's response.

Kate McCafferty stood watching the scene unfold. She was grateful John Sr. had given up his end of the fight, and knew exactly why. Kate was a young police officer when John's wife and Jinny's mother had killed herself... she remembered the day, where she was when she heard the news, and how heartbroken she had been. She was a close friend of the Exsteads, and the news was shattering.

"Let's go out into the hall" the doctor said "we'll discuss arrangement there. The doctor led the four of them out of the room and closed the door behind them, leaving Jinny all alone in the room.

Jinny didn't know where she was, all she knew was that she was alone. Completely alone. The fatigue that her body had developed at Magda's was still there, although it was slowly starting to wear off. Something was preventing her from thinking though. In a way that was a blessing in disguise, but she didn't like the feeling. Slowly, she drifted off into sleep... thinking about absolutely nothing.

thank you everyone for your kind words. and thank you adele and anyone else who said it was realistic (hug-a-tree i think)... i know it is too, trust me, that's why i decided to write it. oh, and thx to glitterbabie 4 helping me make that decision too (she actually gave me the depression idea... and i ran with it) k, here's more:

***THE DIVISION***
Magda sat at her desk trying to concentrate, but it was hard. It had been two days since she helped take Jinny to the hospital and today she was driving her to the clinic... for a minimum of four weeks stay. Sighing, she got up and headed towards the coffee machine where CD was standing. "Hey CD."

"Mornin'" CD noticed that Magda looked worn out. She wondered what was going on... and hoped everything was okay at home. Looking around the division, she noticed Jinny wasn't there and it was already 9:30. "Hey...where's Jinny?"

At the mention of Jinny's name, Magda's face fell. She knew this time was coming, when CD and Angela wondered where her partner and best friend were. 'I'm just not prepared for it' she thought, then decided with the direct approach. "She's... in the hospital."

CD almost dropped her coffee mug. Had she heard right? Jinny was in the hospital? "What for?" CD's face was a mask of concern, as she waited for Magda's response.

"She's.. depressed, CD. I'm taking her to a clinic at 13:30." Magda's eyes teared up. Her best friend was depressed? How did this happen? 'I know..' she thought 'It's all his fault.' She couldn't hold back the tears anymore and they fell from her eyes. Reaching up to wipe them away she felt CD's hand on her arm.

"Hey... it'll be okay. She'll get better..." CD trailed off. She really hoped she was right. 'I would've never expected to hear that Jinny was depressed... so depressed for one of those mental hospitals.' Realizing what she had just called what Magda referred to as a *clinic,* CD gasped out loud.

Looking at CD quizzically, Magda finished wiping the tears from her face. "What was that for? The.. little gasp?"

"Oh nothing... just... what's this... clinic?" CD knew she needed to choose her words carefully.

"It's... well, it's basically a mental hospital, CD." she said. Magda couldn't believe the words she had just uttered. She had never wanted to say those words, and now that she did everything seemed so different... so 'hopeless?' Magda shook her head and silently walked back to her desk, leaving CD to stare after her.

***THE HOSPITAL***
Jinny lay in her bed looking at the blank wall. Her mind was a haze, but she could think again... a little. And she had some strength back. Slowly raising her arm, she looked at her watch. It was a little past ten. 'Magda will be here soon' she thought, and the tears came again.

She knew where she was going, and she didn't want to go there... but she also knew she had no choice. 'I can't function like this. I don't want to function.' Looking towards the door, she realized the only think she could do would be to wait for Magda to come here. 'Magda... she's going to see me... like this...' The thought made her cower in her bed even more. Her best friend was not supposed to see her like this.

Just then there was a slight knock on the door, and even though Jinny was looking in that direction, she was so lost in thought she didn't see Magda until she was almost in front of her.

"Hey you" Magda said with a slight smile. Jinny still looked fragile and worn-out, but she looked a little better. 'Only a little' she thought to herself, and had to fight not to cry.

"Hey" was Jinny's response, spoken in such a low whisper that Magda almost could hear. avoiding Magda's eyes, Jinny folded her hands in front of her and stayed silent.

The puerto rican looked at Jinny with pain in her eyes. 'She must be scared' she thought, and moved closer, taking one of Jinny's hands in hers. "How're you feeling?" she asked tentively, knowing it wasn't the best subject in the world.

Jinny looked at Magda's hand and a tear ran down her cheek. She didn't know what to say. If she told Magda the truth, she'd just feel like she was pushing her feelings off onto someone else. Sighing, she opted for a safe response. "Not too good." It was true. She didn't feel too good... but in reality she felt as if she was swimming in a sea of darkness with no way out.

Magda looked down at her partner. She knew Jinny wasn't completely telling the truth, but she didn't want to push it. Letting go of Jinny's hand she walked over to where her best friend's suitcases were. "You ready?" she didn't know what else to say or do, just that she needed to get Jinny there as fast as she could and get out of there. 'What am I thinking?' thought Magda 'She's my best friend.' Still, the thought that she just wanted to not deal with it kept creeping back.

Jinny watched Magda with listless eyes. Sitting up carefully, she swung her legs over the side of the bed and stood up. Diziness overtook her and she had to steady herself for a second. "Sure" she replied to Magda's question, even though the *clinic* was the last place she wanted to go. 'What am I trying to do, fool myself? It's a loony bin!' The thought made her cry and she sat back down on the bed, her head in her hands.

Hearing Jinny's sobs, Magda turned around and her heart fell. She couldn't believe that she had just been thinking about giving up on Jinny.. about just leaving her. Walking over to her best friend, she embraced her, feeling her shirt getting wet with Jinny's tears. "It's ok, Jin... you won't be there that long. And I'll come and visit, ok?" Magda stood back and looked at her friend. Jinny wasn't looking at her, so she grabbed her chin and lifted it up. What she saw in her eyes broke her heart. Jinny was so afraid.

When Jinny looked into Magda's eyes, she could sense something, but she didn't know what. Sighing, she pulled her head away from Magda's grasp and got up.

Just then the doctor walked in and nodded to Magda. "Hey Jinny! How ya feeling?" He knew he needed to be cheerful... this girl was beyond depressed. 'And rightfully so' he thought to himself. He had read her file more carefully after he had gotten her father to sign the release forms. When she was 14 her mother killed herself and she found her. Her dad drank. She was just raped. He couldn't imagine what she was going through.

Jinny looked up at the doctor that walked into the room and muttered "fine" as she walked towards her suitcases. He didn't know what she was going through... he had no clue. He just pretended. No one knew. No one. Reaching down and grabbing one of her suitcases, she started towards the door, not paying attention to anyone.

"Jin, wait!" Magda called and Jinny stopped. Magda turned to the doctor. "I signed the papers to pick her up, so we'll be going." Turning away from the doctor she caught up with Jinny and led her out the door.

***MENTAL HOSPITAL***
Magda pulled up to the entrance to the very clean-looking building that she was told to come to. Waiting outside were two nurses, both dressed in extremely white uniforms. Magda's heart started to pound as she looked over at Jinny, who was staring down at her hands again. "Hey Jin, we're here." She tried to sound cheery, but she knew it sounded fake, hollow. Cutting the engine, she opened her door and got out Jinny's luggage.

The nurses came over to the car and smiled at Magda. The taller of the two had brown hair and she spoke first. "Welcome. I take it she is the patient?" she asked, pointing to Jinny who was still in Magda's car.

Magda nodded to the nurse, and set down Jinny's bags, which were quickly picked up by the shorter, blonde nurse. "Should I go get her?" The brunette nurse nodded, and Magda went over to the passenger side of her car and opened the door.

Jinny stepped out of the car into the sunlight and squinted. 'Here I am' she thought, and frowned. Slowly following Magda, she took in the two nurses that stood by the entrance waiting for her. Lowering her gaze again, she stopped in front of them. 'Get me out of here' was all she was thinking.

"Here, let me take you inside, Jinny" the blonde nurse said. "We have her clearance, so we'll take it from here."

Magda turned to her best friend and hugged her. "Hey... I'll visit, ok? It's not that long..." Jinny nodded at Magda's words as Magda watched Jinny follow the nurse into the building and disappear. Turning to the brunette nurse, she asked "When are visiting hours?"

The nurse smiled at Magda. "Well, unfortunately, you won'tbe able to visit Jinny for the first week. But after that, between the hours of 12-2pm and 7-9pm."

"What do you mean I can't see her for the first week?" Magda looked past the nurse to the doors Jinny went through only moments before. "She... she's my best friend! She needs me!" Magda looked at the nurse with pleading eyes.

"I'm sorry, but it's hospital procedure." With that, the nurse walked away leaving Magda to stare at the building where her best friend was now locked in. "I'm so sorry Jinny" she said outloud to no one as she got into her car and drove away.

i sincerely apologize for not posting more sooner... i was going through some things and now that i have those things under control i can post more! so.. here ya go:

***MAGDA'S CAR***
Magda sat in her car at a red light, thinking. She knew she shouldn't have let Jinny go to that place... she knew it was bad news. 'But maybe it isn't' she said to herself. Just then her cell phone rang, jostling her out of her head. Picking up the phone she answered. "Ramirez."

CD was on the other end, inviting her to come to Anchorside with her, Ang, and cap. At first Magda wanted to decline the invite, not wanting to deal with their questions about Jinny and everything that had happened. Then she decided that what she needed most now was to be around people she knew and trusted. "Ok CD.. I'll be there at 10:30 tonight." Hanging up her phone, she drove the rest of the way home thinking about what she was going to tell them about Jinny.

***THE DIVISION***
CD hung up the phone and glanced at Angela and the Captain, who were waiting by her desk. "She's coming. At 10:30." CD smiled. She was relieved that Magda had agreed to come tonight. She knew that she had just put her best friend into a mental hospital, and CD didn't want Magda to become withdrawn too.

Captain Kate McCafferty nodded, and walked back into her office shutting the door. Sitting at her desk, she sighed. She couldn't believe that one of her officers was in the situation Jinny was in. She also knew that when Jinny was released she'd have to go through an endless number of psychological evaluations to make sure she could be out on the streets again. Picking up her phone, she dialed a number and let it ring.

***JINNY'S DAD'S HOUSE***
The phone was ringing and John Sr. hurried to answer it. "Hello?" he said as he brought the reciever to his ear. "Oh.. hi Kate... Yes, I know..... I'm sure she'll be alright... Uh huh... When?... Alright, I'll keep you posted."

He hung up the phone and ran his hand over his face. He still couldn't believe what had transpired over the last few days... still couldn't grasp that Jinny was in a hospital. Going to the refigerator, he pulled out a beer and popped the tab. John finished the whole can in one gulp, then reached for another.

***ANCHORSIDE: 10:34pm***
Magda opened the doors to the familar restaurant and bar, quickly spotting her coworkers. Walking over to them, she put on a smile and waved. 'Ok.. this is it Mag... this is when you tell them all about Jinny.' Reaching her seat, she sat down. "Hey guys.. sorry I'm late... I had to wait for Gabriel to come over to watch Ben."

"That's ok.. we just got her ourselves." Angela said and smiled. She had heard from CD about Jinny's hospitalization and felt bad for everyone involved.

CD smiled back at Magda and reached for her drink. Bringing the glass to her lips, she sipped slowly. When she was finished, she decided that she would break the silence. "So..." she started.

"So.. yes, Magda, how is Jinny doing?" the Captain continued for CD feeling that she didn't want to go on. When the question was asked, Kate immediately saw Magda's face dro a little.

"Well.." started Magda, folding her hands in front of her. "When I picked her up today she was a little better... look-wise, I mean. And she talked to me." Magda looked at the Captain, who nodded for her to continue. "So I took her to the hospital and there were two nurses to greet us. One of them took Jinny inside and the other stayed outside breifly to talk to me." Magda's eyes started to tear up when she told the next part. "When I asked that nurse when visiting hours were, she told me no one could visit Jinny for the first week.. but after that..."

Magda was cut off by CD, who was visibly angry. "What?! You can't VISIT her for the first WEEK?! That's the most important week! She'll..."

"She'll think I deserted her. She'll hate me." Magda looked down at her lap and then back up at her three coworkers, who all seemed both worried and angry. "I... I left her in that... that PLACE!"

Kate leaned over the table and placed her hands on top of Magda's. "You didn't know... and... she's getting help." Kate didn't believe her own words about the help. She knew plenty of people in her time that were isolated, even for a little bit, from family and friends and it was a detriment to them.

After Kate spoke those words, the silence was eerie. Nodding, Magda got up. "I'm.. gonna go get a drink. Anybody want anything else?" After they said no, Magda walked over to the bar and got the bartenders attention. "Hey.. yeah... I'll have a..."

She was interupted by a man with light brown hair and a slight gotee. "Hey... I'll get that for you, if you want."

Magda turned around to the man that had offered to by her a drink. When she saw him, something about him seemed familar. "Um.. no, that's ok" she said, turning back to the bartender.

"Ok.. but if you change your mind, just remember me... my name's Joe." The man smiled.

Magda froze. 'THIS is Joe?!' she thought to herself,and then realized why he looked familar... because she had heard his description and seen his likeness sketched before. "Joe, huh?" she asked, trying to play it cool. "Where ya from?"

"Around. Hey... you sure you don't want me to buy you a drink?"

"Well... maybe... the next one." Magda smiled and turned her attention back to the bar. "Margarita." After getting her drink, she hurried back to her table and almost missed her seat. "Joe's here." she said out of breathe. "You know... the guy that.. raped Jinny."

CD stared at Magda in astonishment. She hadn't known why Jinny had broken down a few days ago. Glancing at her partner, she saw that Angela had the same shocked expression on her face.

The Captain couldn't believe what she was hearing. "Don't drink that" she said to Magda quickly. "I'm setting up a bust... you willing to play the target?"

Magda was more than willing. She knew her friends and coworkers would be there to stop anything, and she wanted to get this bastard. "Yes."

"Ok..." the captain started to tell the other three what was going down... and they listened intently to every word.

When the captain was done, Magda slowly got up from her seat and feigned drunkeness. Walking over to the bar, she spotted Joe and walked over towards him. "Hey.." she said, slurring her words slightly. "You still wanna buy me that drink?"

Joe smiled. "I got a better idea... why don't we go into the bathroom and fool around a bit?" The girl looked skeptical, and Joe quickly added "Don't worry.. we won't go any farther than 3rd" and he winked.

Magda smiled and nodded. 'Well, this is it' she said to herself as she followed Joe into the bathroom. Once they were inside, Joe started kissing her forcefully and feeling her body. She wanted to throw up... this was the guy that ruined her best friend.

Joe moved quickly... he knew he had to. Moving down to the girls pants, he started to unbutton them, but felt her resist. Whispering into her ear he said "I wouldn't resist if I were you... this is gonna happen whether you want it or not."

Magda started to protest and tried to push Joe away from her, but he kept going. 'Come on, guys!' she thought.

CD and Angela were standing on opposite sides of the door, and when they heard Magda's increased protests, CD nodded to Angela and they burst into the bathroom. "Freeze!" yelled CD. "Stop what you're doing and put your hands up!"

Joe froze and put his hands up. 'I wasn't doing anything wrong' he thought, as he smiled to himself. Just then, he noticed the girl that he had been having his way with walk over to the cops like she knew them, and his smile faded.

"You're under arrest for the rapes of Meagan Smoyer and Jinny Exstead. You have the right to remain silent..." CD read Joe his rights as Angela cuffed him. Magda gathered her clothes together and stared at Joe with disgust.

***MENTAL HOSPITAL***
Jinny sat in her room wondering why no one had visited her... why Magda didn't come inside with her. She didn't blame them, but she still wondered. Getting up from the bed, she walked over to the window in a daze and looked out. She wanted to be home... no matter how much she hated her life, she still wanted to be home.

A nurse came into her room. She looked at Jinny and shook her head. "Lights out was 20 minutes ago, Jinny."

Jinny turned around and looked at the nurse with a blank expression. Lights out? They had a lights out here? She sighed and got into bed, thinking that maybe sleep was the best thing... it would make her forget... or so she hoped.

"That's a girl" the nurse said too sweetly. "Tomorrow you'll start your therapy. And I believe your test results are in." The nurse turned toward the door, but was stopped by Jinny's words.

"Test results?" She was confused. When did she have any tests done? Trying to remember, she found she couldn't... a fog was penetrating her mind.

"The tests you had when you entered the hospital, Jinny." The nurse felt it was best to be completely up front with the girl in the room. "The STD tests, the pregnancy tests, and the other blood work." Turning around again, she walked out the door.

Jinny stared after her as the nurses words made an impact. 'I was raped.' She remembered everything now, and she started to cry again.

***THE DIVISION***
Kate sat at her desk past everyone else that night. It had been three days since they had caught the guy who had raped both Meagan and Jinny. Meagan had already made a positive id, so they had him in custody until Jinny got released. She was going over paperwork and knew she had to leave soon, but she had so much to do.

***JINNY'S DAD'S HOUSE***
John Sr. was sitting on the sofa watching the television when the phone rang. Sighing, he got up and answered it. "Hello?" At first he was greeted by silence, but then a small voice penetrated the line.

"Daddy?" Jinny's voice was small and weak. She sounded so far away and lost. John Sr. had trouble keeping his control.

"Jinny, hunny.. is that you?" He steadied himself and waited for her response. It took awhile before it came, but what she asked broke his heart.

"Why don't you come and visit me, daddy?" A tear fell down John Sr's face, and he wiped it away. He couldn't believe that no one had told his little girl that they weren't allowed to see her for at least another 3 days.

"Jinny... they didn't tell you we aren't allowed to see you for the first week you're there?" John Sr's question was answered by a soft sobbing on the other end. "Jinny... Jinny listen to me... I'm getting you out of there, you hear me? It's gonna be okay." He waited out his daughters sobs and finally, after five minutes said goodbye again and hung up the phone.

***THE DIVISION***
Kate was getting ready to leave when she heard a knock on her door. "Come in" she said wearily. When she saw Jinny's dad she knew there was something wrong.

"Kate... I'm sorry it's so late. I stopped by your house but no one was there.. so I came here." John Sr. sighed and ran his hand over his head. "We have to get Jinny out of there. She can't stay there... she's getting worse."

Kate nodded and sat back down at her desk. She wondered what had made John so upset that he came to her for help. "What happened, John?"

"I... I got a call from Jinny..." he managed to get out before tears filled his eyes. "She sounded... so lost and hurt. And she asked why I didn't visit her. They didn't TELL her, Kate!" John Sr. sat down and put his hands. "We gotta get her out of there" he mumbled.

Kate agreed with everything John was saying. She knew that there were loopholes and Jinny could get out of that place.. it would just take a lot of effort. And she was willing to bet that John was ready to put all the strength he had in getting his daughter out of there. Her thoughts were interupted by her phone ringing. Startled, she picked it up. "McCafferty."

"Captain?" Jinny asked softly. Kate's eyes got wide and motioned for John to get up.

"Jinny? Yeah... it's me." She waited for a response, and when she didn't get one for over a minute, she asked again "Jinny?"

"Yes." That was all Jinny said, but Kate could hear her crying. 'Dear God' she thought 'What is going on?' She looked over at John, who had a worried expression on his face.

"Jinny... I know your scared, and upset, but your dad and I WILL get you out of there, ok?" Kate listened to the phone, straining, and barely heard the muffled yes before the phone clicked off.

***THE HOSPITAL***
John Sr. and Kate walked into local hospital and went up to the receptionist on duty. It was already 8:30pm and they needed to get Jinny out of the "clinic" tonight.

"Excuse me.. miss?" John Sr. asked cordially. "Can you tell me where I can find Dr. Harold Jenkins? He assessed and treated my daughter here last week..."

"Of course. I'll page him for you." The receptionist took the phone off the hook and pressed a button. "Dr. Jenkins to the front recep. desk. Dr. Jenkins to the front recep. desk." The woman smiled and nodded to the seats across from her. "He should be here any minute.. please.. sit."

John Sr. sat on one of the chairs and Kate sat in another. Within a few minutes, Dr. Jenkins had arrived, and they both stood.

"Mr. Exstead... this is a surprise." the doctor said, and smiled slightly. He didn't know why John was here, but something must be up.

John Sr. looked at the doctor, and began. "I want my daughter out of that place." His face grew into a cold mask as he waited for Dr. Jenkins to reply. When he did, he proceded with caution.

"Mr. Exstead... Since you signed your daughter in, you CAN sign her out... BUT I will still recomend it, and so will the hospital so..."

John cut him off, disreguarding any pleasantries. "I want her out TONIGHT." He wouldn't budge. He would stand here all night and all tomorrow and however long it took to get his daughter out of there.

"Well, I can see that, but even if you sign the papers it will take them at least two weeks to go through. I mean.. the only way you can get her out tonight is if you have a police order..."

Kate, who had remained silent up until this time, finally spoke up. "That... won't be a problem."

***MENTAL HOSPITAL***
Kate and John Sr. went to the front gates of the hospital with a police order in hand and verification that he had started the procedure to get his daughter out of there. When they got to the desk, they were greeted by a nurse and a guard.

"May I help you?" the nurse said, smiling.

"Yes." John said "I'm here to get my daughter."

"I'm sorry, but I wasn't aware of a discharge today..."

"I have a police order. She's getting out of here." John Sr. looked at the nurse, who suddenly looked alarmed and angry at the same time. Handing the paper to her, he watched her as she studied it. Glancing at Kate, he hoped that his Jinny was okay.

The nurse looked at the police order. 'Jinny Exstead' she thought, and then knew who it was. Grimacing, she looked back up at John and Kate. "Right.. this way..." She lead them to Jinny's room and opened the door.

Jinny was laying curled up in her bed staring out into space and didn't even notice anyone entering the room. Her mind was completely fogged and she didn't want to be here. She wanted her daddy.

The nurse spoke up "I really don't think this is a good idea..."

John Sr. ignored what the nurse was saying and hurried over to his daughter, picking her up and kissing her head. "Jinny, it's me. You're going home." Recognition flashed over Jinny's face, and John Sr. knew his baby would be okay.

***JINNY'S DAD'S HOUSE***
John Sr. had just set Jinny up in her old room... she already looked more peaceful there. Promising to be back with some water and soup, John left his girl and went into the kitchen. He was rummaging through the cabinets when he heard the doorbell. Walking over, he opened the door and there stood Magda.

"Hey... I hear you got her out..." was all Magda could say as tears brimmed in her eyes. When John Sr. motioned for her to come in, she did. "Where is she? Can I see her?" Magda was anxious to see her best friend and partner again... she felt so bad for leaving her at that horrible place.

John Sr. nodded and smiled. He was glad Magda was here... she could definitely help Jinny get back... he knew it. "Come on.. I'll take you to her." He lead her to Jinny's room and knocked before entering. Jinny was laying on her bed, but she wasn't staring out into space, she looked.. alive.

Magda ran over to her friend and hugged her... and Jinny hugged back. "Jinny... I'm SO sorry.. I didn't know, and..." tears welled up in Magda's eyes and she just stopped as Jinny hugged her tighter.

When Jinny saw Magda, her spirits lifted a little. She had missed her so much. Hugging her felt like she was back in the world somewhat. Finally, letting go, she sunk back down into her bed, exhausted. "It's ok, Mag." she said softly. "I'm tired... I need to sleep."

Magda and John Sr. nodded and quietly walked out of the room. When they got to the living room, John spoke. "The only way I got her out was because of a police order... they're going to fight it. But I'm taking her to an outpatient therapist.. so she'll get help. I'm not letting her back there." John Sr's eyes were wet with tears as he said this. He knew he would keep that promise.

Magda smiled. "Good. She's looking better already..." and she meant what she said. Jinny was still in a deep depression, but somehow... somehow she would fight it.

9 WEEKS LATER!!!!!!!

***THE DIVISION***
Magda, CD, Angela, and the Captain were at the division at 7am that morning. At 7:40 they were done what they needed to do, and waited.

"I can't believe she's coming back today...I'm so happy!" Magda said to no one in particular, but she knew everyone else felt the same way. She had been there with Jinny throughout her recovery, and while she was still slightly depressed and cynical as all hell, she was better. Better enough to be on the streets again.

Angela looked at Magda and wondered how she did it... how she stayed so strong throughout the whole thing. 'I guess she's just a strong woman' she thought, as she sat at her desk. "Yeah.. it'll be good to have her back."

CD was quiet. She was happy that Jinny would be coming back, there was no question about that, but she knew Jinny would never fully recover from what had happened to her... she definitely knew. Sighing, she got up from her desk and walked over to Mag. "I can't wait to see her, Mag. I really can't." CD smiled and walked towards the coffee machine.

Captain Kate McCafferty knew this was an amazing day. She had hoped it would come sooner, but she was glad that it finally did come. Jinny, even though no one knew it, had a special place in her heart... and she worried about her like she worried about her own daughter. Smiling, she added her own thoughts. "Exstead's back. And don't worry Mag, I already have a case for you two."

It was 7:56 when Jinny walked in the doors of the division. What greeted her brought tears of joy to her eyes. There were balloons and decorations and a cake and a banner that said *Welcome Back Jinny' on it. Smiling, she looked at Magda, then at Angela, CD, and cap. "Guys.. you.. you shouldn't have..." she was all choked up... and happy... happier than she'd been in a long time.

"Cut the cake, Jin! I'm starving!" Magda yelled and smiled. She was glad to have Jinny back... so glad.

Jinny picked up the knife and sliced into the cake, giving the first piece to Magda, who hugged her so tight she almost couldn't breathe. "Mag... Mag... you're cutting off my circulation..." Everyone laughed... the old Jinny was back. She would be a little different, but she was still back.
