COOKEVILLE, Tennessee (AP) -- A father gave his 10-year-old daughter a Christmas present that would make Santa blush.
Now Daryl Hill wants to know why an MP3 video player he bought at a Wal-Mart in Sparta was preloaded with pornography and explicit songs.
Hill bought three of the players as Christmas presents for his children. He said one of the devices had apparently been returned to the store from a previous owner who loaded sex clips and songs with lyrics about using drugs.
"Within 10 minutes, my daughter was crying," Hill said Thursday. "I wish I could take the thoughts and images out of her head."
Hill questioned why Wal-Mart Stores Inc. would sell used merchandise as new, which he said violates its own policies.
A company spokesman said in an e-mail to WSMV-TV of Nashville that stores are not supposed to return opened packages to the sales floor and that the matter was under investigation.
Hill said he declined Wal-Mart's offer to replace the MP3 player. He said he has already bought his daughter a new one and is hanging onto the controversial one until he talks to a lawyer.
Dean Winchester 12-28-2007, 06:33 PM the guy is a man, surely he enjoyed watching the porn for himself once he confiscated it from his daughter, LOL.
Anyways, places sell open box items all the time, what's wrong with that? The Ipod I bought was open box, and I got a four year warrenty on it as well as a $50 giftcard from buying so.

.
LOL, why the heck was she watching it for 10 minutes and enough to make her cry? I think he just made that part up. When i was 10 years old, i knew what porn was and i sure as heck never cried about it. I might have laughed at it but that's it. I didn't grow up in a broken home or anything, its just something kids discover while flipping thru channels, etc. If i was the 10 yr old, i'd just show my parents and have them bring it back. The last thing i'd do is watch it for 10 freakin minutes.
junecleaver 12-28-2007, 07:31 PM As for Wal-mart, I dont understand why they dont check returned items. There could be a freakin bomb planted in a box and they'd never know.
Ireneparalegal 12-28-2007, 07:33 PM It says "within 10 minutes", NOT that she watched it for ten minutes. It sounds like from the time she opened the package, to setting it up and actually discovering the porn is the time it took.
Dean Winchester 12-28-2007, 07:44 PM shows the difference between girls and boys. A 10 year old boy would be "wow, thanks dad, you're the coolest!!!" if he got an mp3 player loaded up with porn and gangsta rap

Would you please be serious? This is a disgraceful and shameful matter. Who
knows how long that little girl is going to be traumatized by this? And to even
suggest that the father secretly enjoys watching porn is nothing short of a
slap in the face to countless good fathers everywhere. You ought to be
ashamed of yourself.

I guess it depends on the type of porn. If it was just normal porn (not all them weird fetish/beastiality type ones) she shouldn't be traumatized. She's also almost a teenager so I mean, if you've gone that long and not been exposed to porn, then you are extremely sheltered.
Ireneparalegal 12-28-2007, 08:22 PM Five years from now that girl will be telling this story to her girlfriends. ;)

traumatized by porn??? I was a ten year old once myself, and I could attest that many of the boys in my class were obsessed with sneaking peeks at Penthouse and Playboy magazine. 10 year olds aren't *that* innocent and pure. The father sounds like one of those types who is so overly protective of his children that most Disney cartoons are objectionable for a 13 year old in his eyes.... my older brother was that way with his kids (he wouldn't let his 13 and 15 year olds watch the ****ing Simpsons, and even today won't let his now 19 and 20 year olds on Myspace because he's afraid of them meeting "pedophiles", THEY'RE 19 AND 20 NOW!!!) and they rebelled big time once they reached a certain age.
You ought to be ashamed of yourself, you always sound so anti-social, you are completely devoid of any sense of humor and act like drying paint. Men and porn isn't necessarily a "bad thing", didn't you ever watch Friends? Monica and Chandler were married and she would even bring him porn to watch because she knew that even if he was her husband, he was still a man.

Well said I totally agree with ya. Heck, my fiance and I watch porn together sometimes, and I will admit i've watched it myself since i was 10 years old. You are right, the majority of red blooded american 10 yr olds are not that innocent, I dont care how adults think of them. Like i said, if you have a 10 yr old and up who will easily get traumatized by porn, they are not at all prepared for life's challenges as they age.
But guys, just remember, us girls watch just as much porn as you ;) Dont ever think we dont like it, its just the problem is that some girls won't admit it.

I know!!! ROFL!!! My brother came to town with family some years back and I spent time with my niece and nephew and we passed by a magazine with The Simpsons on it, and my nephew told me that their dad won't allow him to watch that show, even though he was 13 at the time

I am still curious exactly what type of porn it was to give her such trauma. Was it standard porn, or was it really off-the-wall? I am not much of a porn person but I will admit that at age 28, the "2 Girls 1 Cup" video made me cringe and feel disgusted. I could only imagine what a kid's reaction to it would be (for the three people who don't know what the internet phenomenon is.... it's a video where two girls feast on the most unedible thing possible like it's a milkshake). But if all she saw was standard porn, she must be really sheltered if she's "traumatized" by it, granted it's inappropriate for children but I wouldn't see why a kid would be scared by it when most 10 year olds seem to want to catch glimpses.
Dean Winchester 12-28-2007, 08:46 PM before anyone makes any assumptions about me, I can't stand porn, I think it's overrated and most of the time it's unsexy. I believe going too far takes sex appeal out of something, it's always better to tease then flash. I have only seen maybe two porns in my life (one straight, one gay) and both of them I just rolled my eyes through the horrific acting and over-the-top sex scenes. So I don't want anyone to think I'm defending porn, because I think it is garbage. I did see the 2 Girls 1 Cup video just to see what the fuss was about.

My brother is a bit like this, he stopped letting my niece watch Sailor Moon when he found out that in the original Japanese version, two of the girls are lesbians, even though they never do anything more shocking than holding hands!

I was 17 when South Park started, so I was already "age appropriate" when it started, but I do remember a few years earlier, a lot of kids in my class weren't allowed to watch Beavis And Butt-Head. There were two groups of kids in my eighth grade class (1993-1994), kids who loved B&B and kids whose parents wouldn't allow them to watch it.

B&B was actually banned before 11 pm after a five year old burned his parents house down because "fire fire fire fire" was one of Beavis' catchphrases early on, but then they banned those episodes immediately afterwards . So a lot of kids stayed up past their bedtimes to see B&B every night

I agree 100%. There's some porn that can be insanely disgusting, and it's hard to get those images out of the mind, especially for a young girl. I'll never understand people, to think that this is a laughing matter, is disgraceful to me. The father bought that item in good faith, that it wouldn't be packed with porn and filthy songs.
Chelsea 12-29-2007, 06:56 PM I think it's disgusting that a 10-year was subjected to porn or dirty songs, and I don't have my head up my ass.
I do wholeheartedly agree with that. Believing in that viewpoint isn't why someone would have their head planted up there - jokes aside I don't think there's anyone who *seriously* believes a 10 year old finding porn and gangster rap already loaded onto an iPod is a good thing. But, it's porn. A subject which, due to it's very nature is going to inspire a lot of silliness.

I want to know HOW all these iPods/iPod Boxes are being tampered with. THIS one had a note inside that said "Reclaim your mind the from the media shackles. Read a book and resurrect yourself. To claim your capitalistic garbage go to your nearest Apple Store." and had little mini booklets on "leading a more enlightened life"

I totally agree. I was looking at this thread all last night and couldn't believe what I was reading. I know one thing, I was never exposed to porn when I was 10 years old. I wasn't thinking about it. I guess I was sheltered. lol I know one thing, if I had a 10 year old daughter and this happened to her I would be livid. I get a kick sometimes, On the other topic, People say it's up to the parents to censor what their children watch but then when they do, they are sheltering them.

My father was a 6'2" longshoreman, with three daughters. He looked like John Wayne. He would have ripped someone's head off, if this happened to one of his 10-year old daughters. Not sure whose head, but he'd figure it out, lol.

well, Lee jumped on a huge soapbox and started chewing my head off for joking that if it was a 10 year old BOY instead of a girl, the responce would've been "wow Dad, you're the coolest" if he got an iPod loaded with porn and gangsta rap (which was meant to be a joke because I remember being a ten year old boy once myself and remembering the lunchroom chatter amongst boys). I'm glad I wasn't alone in thinking he was a little too defensive and worrying and needed to lighten up instead of worrying about "trauma" that the girl was going through, when 10 year olds aren't quite as innocent and young as people think they are. And if 10 year olds were that filthy in 1989-1990, I bet they're even worse today because that's how society has changed.

No soapbox or chewing your head off, he gave his opinion. He's entitled to do so, without ridicule. It wasn't a boy either. It was a little girl, not that it matters much anyway. I saw what Lee quoted by you, and it wasn't what you say here. If you and your buddies were filthy at 10, it doesn't mean everyone is now. Not every 10-year was or is like you, so you can't base anything on that. This was probably a sweet little girl.
You may not be alone, but not everyone agrees either. There's me, Lee, Sonny, Sarah, and Seth for that matter. I will say that I am extremely surprised at one member though. Completely shocked.

I've got countless stories of discovering porn when I was a kid. :lookaroun This was LONG before we had the Internet at home on a regular basis, to boot (close to 15 years ago).

I went to a Catholic school, which means if it was a Catholic school, then the public school kids were even worse. The kids on South Park had nothing on some of the classmates I knew back then. These were 10 year olds who listened to Metallica and N.W.A., watched slasher flicks, drew boobs on a daily basis in the class, talked about Penthouse and Playboy magazine all the time, and I even used to be ridiculed because someone asked if I'd had sex and I said no... and I was TEN. If Catholic school kids were that bad in 1990, I can only imagine how much worse they are today since it seems like more and more 12-13 year old girls are getting knocked up today than back then.
Unless this little girl was homeschooled, I am sure she was exposed to a lot of the filth that is called the fourth grade.
PZelda 12-29-2007, 08:32 PM Yeah
LOL I knew people who wacth South Park back in 1998 when they were my age LOL I wasl ike WTF?
I just got into it this past year, and have seen the first 8 seasons and the 11th
I watched Married... With Children a LOT when I was growing up, and was about 12 years old when it ended in 1997. When my parents were still married (this was 13+ years ago), my dad never had a problem with me watching MWC. Then all of a sudden when I was that age, he started getting his underwear in a bunch and wouldn't allow me to watch it. He was forgetting one thing - my mom had custody of me after my parents split up, and she didn't care what kind of TV shows I watched. As long as I didn't watch HBO or Showtime (she would get these channels on and off when I was growing up - so I remember when 'Sex and the City' debuted in 1998 - I watched the original run on HBO) when they had more adult-orientated stuff on at night.

Yeah, I was exposed to quite a lot when I was growing up... and I turned out fine. Heh.
(additionally, I remember when B&B debuted, as well as South Park. I have a SP bumper sticker that I got in '98, stuck on a notebook somewhere, with the trademark "THEY KILLED KENNY! YOU BASTARDS!" saying on it)

There are loads of kids that were definitely thinking about that kind of thing at that age but it didn't really interest me at all then.
My parents never explained anything to me, either. I've never had "the talk". I just learned everything on my own and never really had any interest as a child in looking at porn.
Dean Winchester 12-29-2007, 08:52 PM If you and your buddies were filthy at 10, it doesn't mean everyone is now.
I just want to clarify something... I was NOT one of those kids I was speaking about in grade school. I certainly wasn't a little saint, but I hardly was a little Kenny-esque foul-mouthed, sex-obsessed 10 year old like some of the kids I knew. I admitted that I enjoyed watching a good horror movie at that age, but that was probably my worst vice at the time, I was listening to MC Hammer when all the other kids were listening to N.W.A., and Def Leppard when everyone else was into Megadeth in that grade. I just wanted to make sure to clarify things because I wasn't one of those kids, but I definately knew more than my share of classmates who would make Beavis and Butt-Head or the kids on South Park blush if they heard the things they would talk about
Janice 12-29-2007, 08:53 PM Unless this little girl was homeschooled, I am sure she was exposed to a lot of the filth that is called the fourth grade.
I completely disagree. I think it's completely reasonable that a 10-year old hasn't seen porn yet, regardless of where they attend school. My husband has 9 grandkids. In that group, there is a 9 1/2 year old, a 10-year old and a 12-year old, all girls, from two sets of parents. My husband's son, and his daughter. I would bet my home that they haven't seen porn, unless it was an unavoidable accident. Everything's on parental controls (tv, internet), only G movies, on and on. My stepdaughter goes to a website to get the full scoop on a movie before they see it. It's run by a parent's watchdog group. Nobody can swear around their kids. Who wants to swear around little kids anyway.
Every second of every day is monitored. Dropped off at school, then picked up, then off to after-school activities. Only family or best friends babysit, and even then, not everyone. Someone wants to call that sheltered, so be it. They're being sheltered from porn, perverts, and anything else that's not meant for a child's eyes or ears.

yeah, i didn't mind people making fun of the idea of 15-year-olds not being allowed to watch the simpsons and whatnot. it's just a few posts around the beginning of the thread that really irked me. "ten-year-olds can't be traumatized by porn, they aren't that innocent." "oh i watched porn when i was ten, therefore anyone who doesn't is sheltered." those statements are overgeneralizing beyond belief, not to mention false.
Thanks for backing me up here, Janice

Yeah, I know what you mean. 10 year olds looking at porn isn't good, especially if it's on purpose.
Dean Winchester 12-29-2007, 10:33 PM I completely disagree. I think it's completely reasonable that a 10-year old hasn't seen porn yet, regardless of where they attend school.
well, there's a difference with not seeing it, and not knowing it exists. I never saw porn until I was of legal age (and I still stand by my belief that porn is garbage and a dangerous field) but I knew all about Penthouse and the sort because of my classmates talking about it all the time when they were 10-11 years old. The girl surely has been forced to hear about a lot of that garbage from classmates unless she has been homeschooled her whole life. There's always one or two bad influences that can sour the entire class.
Ireneparalegal 12-29-2007, 10:39 PM I can attest that a child of ten who hasn't seen porn is not sheltered. I grew up in a middle class family. No porn around for me to find, no cable, no video tapes, etc. this was the 70's folks. So, the only thing available really would have been dirty magazines which I never saw until I was abt 11 and only because I was at my best friend's house and she found her father's dirty magazines. I was shocked. I laughed hysterically but only out of embarrassment. I didn't like what I saw. I knew in my mind what married couples did in the bedroom but I didn't have a clear picture in my head of the many things that I seen in that magazine. Five years later I remember me and my best friend laughing at what she discovered and I told her how it kind of bothered me that she showed me. Which is why I made the comment on the first page abt how that girl would do the same. It was a simple comment but I should have elaborated on my reason behind it. Just stating simply that hopefully she will one day look back at that moment and be able to laugh abt it and not be scarred by that horrid find on her mp3 player.
I too went to catholic school, was raised by a beautiful family and not being exposed to sexual materials doesn't make me sheltered. It simply means there was not that kind of material in my home. It took a friend to expose me to that sort of thing. Porn wasn't readily available like it is nowadays with cable and the internet.
As for my  to Lee on page one, I am sorry for making you feel as if your opinion didn't matter. It certainly does. I can only say I felt your seriousness comment in regards to John's funny remark was not necessary since John was only being funny abt something that DID NOT occur (the father keeping the mp3 for himself to view privately later).
Dean Winchester 12-29-2007, 10:50 PM I can attest that a child of ten who hasn't seen porn is not sheltered.
just to clarify my comment earlier. I DON'T believe kids should be watching porn, but I meant that if the little girl was so unaware that such garbage exists that at ten, she would be having mental scarring from it, she must've been. Knowing what exists out there and watching it are two totally different things. My parents sheltered me and wouldn't allow me to watch anything in that vein, but I did know what porn was thanks to other kids. The way the father acted like his daughter just saw the most undescribable thing imaginable made me wonder if she just saw "standard" porn, the stuff that mischevious underage boys want to sneak a peek at, or if she just watched something like "2 Girls, 1 Cup"
Ireneparalegal 12-29-2007, 10:56 PM Well John, standard porn, hardcore porn, whatever it was, it was not material befitting to be seen by a child. I wouldn't want my 10 year old child or whatever age they are, to be seeing that stuff. When they hit adulthood, they are on their own. I hope she isn't scarred by this. I hope she can laugh it off one day like I did. We don't know the family circumstances. We can only surmise. What one kid can shrug off, some others can't. Like the kid on the other thread who may not see Hannah Montana. Big deal, she won't see her idol. But, a young girl who sees porn for the first time may have that image in her head for a long time and might let it affect her. Also she may be made fun of at school or by friends.

Well I do know that I didn't know about porn when I was in elementary school. The group of kids I hung around with didn't talk about it. We were mostly into football and comics. Now when I hit junior high it was a different world. But then again it was the 70's.
Ireneparalegal 12-29-2007, 11:04 PM Bottom line, no porn of any kind should have been on any device that was returned to the store. And this is simply one of the reasons why. It can fall into the hands of someone like a child. I am surprised a store that accepted that item as a return didn't inspect it thoroughly. Sure items are returned and people will buy them "as is" or as open merchandise, but that doesn't mean it should have anything left on the device.
Dean Winchester 12-29-2007, 11:05 PM true, it was age-inappropriate in any form, it's just that the way they described this girl as having nightmares from what she saw makes you wonder precisely what she was watching. Considering the way young boys are infatuated with "boobs", I doubt girls are that innocent and pure to not know what their male classmates are talking about. A kid shouldn't see a standard sex video, but the way the dad was describing her "trauma" made you think she just witnessed people fisting each other after eating poop (the infamous "2 Girls 1 Cup" video is about two girls eating poop)
I do think the father is going too far about refusing to exchange it with Wal-Mart and get a new iPod because Wal-Mart "broke their policy". I mean, if the iPod was loaded with Hannah Montana and Zac Efron songs and videos, would the guy want to consort with a lawyer to sue Wal-Mart for selling used merchandise?
By the by, anyone who owns an ipod knows that all you need to do is install iTunes on your computer and you can clean out an existing iPod hard drive by accomidating it to your iTunes folder on your computer. That's what I did when I bought an open box iPod from Best Buy.
Ireneparalegal 12-29-2007, 11:09 PM The father is contesting that Wal-mart sold the item as NEW rather than state it was "used." I don't know abt that as I have never purchased an electronic item at Wal-mart. Being someone who's recently worked at Walmart, items that have been opened are supposed to be sent to home office, not put back out into the store. Someone at this Walmart probably lost their job over that one.

true, but I wonder if he'd be so outraged and refusing to take compensation from Wal-Mart if the ipod had been filled up with material that would be appropriate for a 10 year old. If instead of porn, it was Hannah Montana episodes or whatever, would the guy be so willing to take Wal-Mart to the cleaners over selling a "used" item.

From what Lauren above stated, the item should have been sent back to the warehouse, not put back on the floor. So, I can see having a complaint with Wal-mart for violating their policy. On top of that, for putting an item back filled with porn? Oy vey. If I bought that item and it was filled with Christmas songs, I would be pissed. Not because of the material, but because I was sold a "used" item.

Exactly, home office is supposed to deal with used items, not the individual store itself. Not to worry though, I'm sure they'll crack down on this now.

why put porn on an iPod anyways? I use my iPod for music and only music, I am not one of these hiDef obsessees, but I never understood the phenomena of putting episodes, movies or music videos on an ipod since the screen is way too small to enjoy it anyways, plus, it takes up so much room that you could be putting music on

yes, It was probably embarassment, a lot of people love porn but won't gloat about it because a lot of people pass judgment on those who enjoy it. I do swear that I have no porn on my hard drive or DVD collection (I do own a copy of Madonna's "Sex", but that was mainly for collector purposes as that book is very hard to find now and it fetches ungodly prices now) and the only nudity I have on DVD is in movies where it furthers the story, not being THE story
Corolla 12-30-2007, 05:27 PM Wow, this thread took a sharp turn in a direction I didn't expect when posting the news story.
Ireneparalegal 12-30-2007, 05:36 PM The parents appeared on the news last night and the father looked so devastated at what had happened. They never mentioned anything regarding the person who loaded up the porn ever contacting the family. Is that even true?

That's what they said on my local news - I'll see if I can confirm it on the web somewhere.
MsOrange 12-30-2007, 11:06 PM exactly. I would be mad too no matter what was on. The porn just made it worst.
I think he has a right to be upset either way; just if it had anything but porn, it obviously wouldn't have made the news. Sex sells.
