LOS ANGELES, California (CNN) -- The jury in the murder trial of legendary music producer Phil Spector has "reached an impasse" after more than a week of deliberations, the trial judge said Tuesday.


Phil Spector, 67, is charged with second-degree murder in the 2003 killing of an actress.

The nine-man, three-woman jury delivered a note to court officials early Tuesday afternoon, warning they were unable to reach a unanimous verdict in Spector's case.

The panel's foreman later told Superior Court Judge Larry Paul Fidler that jurors were split 7-5 after four ballots, but did not indicate which way they were leaning.

Fidler quizzed jurors as to what might break the deadlock and denied a defense request for an immediate mistrial in the case.

But he said he would consider whether to repeat jury instructions, allow jurors to hear a read-back of testimony or let them consider a lesser charge of involuntary manslaughter.

"At this time, I don't believe that anything else will change the positions of the jurors based on the facts that are in evidence," the foreman told the judge.

The jury began deliberating September 10 after hearing testimony and arguments since April.

Spector, 67, is charged with second-degree murder in the 2003 killing of B-movie actress Lana Clarkson.

The onetime star of "Barbarian Queen" and the spoof "Amazon Women on the Moon" was found dead in Spector's Alhambra home -- dubbed "the castle" -- from a single gunshot wound through the roof of the mouth.

Spector's lawyers argue that Clarkson, then working as a VIP hostess at Hollywood's House of Blues, was depressed over a recent breakup, grabbed the .38-caliber pistol and took her own life.

A small amount of blood spattered on Spector's white jacket proves his innocence, they said.

But prosecution witnesses painted Spector as a gun-toting menace, with five women telling harrowing tales on the witness stand of the music producer threatening them with firearms.

Spector's driver testified he heard a loud noise and saw the producer leave the castle holding a revolver, saying, "I think I killed somebody."

The defense attacked the driver's command of the English language, asserting the Brazilian constantly mixes up pronouns and meant to say something else.

But under intense cross-examination, he never strayed from the gist of his original call to a 911 emergency operator.

Spector has won two Grammy Awards and was inducted into the Rock and Roll Hall of Fame in 1989, but he stayed out of the public eye for two decades before his 2003 arrest.

In the 1960s, he became famous as the man behind the "Wall of Sound" -- the instrumentally dense swirl of melody and percussion underlying tunes like The Ronettes' "Be My Baby," the Righteous Brothers' "You've Lost That Lovin' Feeling" and Ike and Tina Turner's "River Deep, Mountain High."

He later produced the Beatles' "Let it Be" album, John Lennon's "Imagine" and the Ramones' "End of the Century."

They are probably the same jury that found O.J and Robert Blake 'not guilty':rolleyes: .

I wondered why she was not brought in as a witness. My only conclusion is that her abuse occurred so long ago (1960's) the prosecution probably felt it would not be in their best interest. Also, before anyone testifies, the prosecution must provide a list of potential witnesses to the defense and vice-versa. The defense has a right to ask the judge to ban certain witnesses for certain reasons. This is done pre-trial.

Also, I don't know if this is true or not, I haven't bothered to research this, but is it true that singer/actress Michelle Phillips of the Mamas and Papas was supposedly hit by Spector or had a gun pulled on her by him? :eek:

The judge can either decide to call this a mistrial and order a new trial.

The judge can call it a mistrial and there won't be another trial. Meaning he walks away scot free and can't be charged for second degree murder. However, the state of California can charge him with a lesser offense of involuntary manslaughter, but so far the judge on this trial doesn't want that because he feels this crime is murder, not manslaughter.

Irene, I think you're probably right re: Ronnie. She'd be an OUTSTANDING character witness (for the prosecution), but the statute of limitations has probably expired by now. Thank God, she was able to get away from Phil. Today, she is the mother of two boys, plus she has been married to a wonderful man for over 25 years. Any music lover needs to read her autobiography Be My Baby - I couldn't put it down!!

HOLLYWOOD, CA (Hollywood Today) 7/9/07 — Michelle Phillips of the famed 60s group Mamas and the Papas is the latest in a growing list of stars that say were held against their will at gunpoint by Phil Spector. Phillips sent a letter to Pat Dixon of the Los Angeles District Attorney’s office offering testimony, but it arrived after the judge had already ruled on how many and who could testify at the trial.

Phillips joins a list of stars that have said Spector pulled a gun on them including Deborah Harry, Dee Dee Ramone, Leonard Cohen and the late John Lennon.

“We did consider it, but the letter came in very late and the judge had already ruled,” said DA spokesperson Sandy Gibbons about the letter describing how Spector kept Phillips and two other women from leaving his home, this time with a rifle. “If we feel it’s necessary in counter, we will consider calling her in.” The Mamas and Papas did such hits as “California Dreamin’ and “Monday Monday.”

The letter describes how Spector held the women in a room after a night of drinking when he lived in the ritzy Trrousdale area of Los Angeles.


The Bel-Air Patrol reportedly came in because another woman was wandering around outside the house, which gave Phillips the chance to leave. According to Phillips’ letter, the Bel-Air Patrol, a private security firm that handles many Beverly Hills and Bel Air homes, was familiar with Spector holding people hostage.

“The Bel Air patrolman came in and asked if anyone there was being held against their will. I raised my hand and was allowed to leave. The patrolman said to him ‘How many times do I have to say this? You can’t hold people against their will.’”



Phillips, reached at her home today, declined to say anything about the letter to the DA or on the possibility of being called to the stand. “I have no comment. I think you understand,” she said.

Deborah Harry of Blondie was not so shy about speaking of her encounter with Spector. “He did it - he pulled a gun, that notorious thing he does. He stuck it in my boot and went ‘bang’. I thought, ‘Get me outta here. I just wanna go home. Why would anyone be carrying a .45 automatic in their home? And now he’s finally gone and done it.”


Even a star as big as John Lennon was chased by a gun-toting Spector through the fabled Record Plant recording studio. Bill Hudson of the Hudson Brothers described the scene. “I was at the A&M studios with my brothers and everyone knew that Lennon was in the big studio with Phil Spector, and through the walls you could hear Spector just going off on John. One time, Spector pulled out a large gun and started chasing John through the hallways. John was trying to laugh it off, but it was horrible. I mean Spector’s reputation had preceded him. I was scared to death.”

Phillips encounter was about 1971, but a decade later, Spector was up to his old tricks. Spector’s last major album was a collaboration with the Ramones, 1980’s “End of the Century.” During the session, the late bassist Dee Dee Ramone said “Spector pulled a gun on the band.”


Gibson at the DAs office was careful to point out that they were not ignoring any potential testimony and that if needed they could appeal for more witnesses. “The judge allowed us to enter certain testimony of women and guns. Whether we need to re-visit that we will see after the defense case.”

However, its easy for an observer to see Phillips testimony isn’t as useful as the four female witnesses with far more recent encounters, in the same house as the death of Lana Clarkson, and in eerily similar circumstances.

Though trial-watchers should note, the judge allowed five female witnesses and only four have testified. So the prosecution has one slot it is allowed to fill if defense arguments warrant it.
