View Full Version : Child Support Court
Nanny Fine 02-19-2004, 09:31 PM This is for all you adults and single parents out there.
I get child support sporadically. Never any sort of schedule to rely on even though we need it to live. So in December I get a $100 payment with a letter from the state saying the "payer" now has his wages garnished and I thought GREAT he has a job! (We dont' speak, have not had anything to do with each other in 10 years - he has never made any contact with my daughter).
Then I get a letter in mid December telling me he's filing a petition to modify his child support because he's "sick" and can't work! I get a letter after that telling me I have a court hearing date February 19th and I need to show up with all this new information requested, they wanted my earnings, my expenses, etc for the month/year. In the meantime the amount of money he owes me is just wracking up and he's not paying it because he thinks since he has this petition on file he doesn't have to pay.
I had to take off work today, hire a lawyer and drive an hour to court...and guess what?
HE DID NOT SHOW UP!!!!!!!!!!!!!!!
So they tell me he claims he has severe anxiety and depression and all I can think is LIVE MY LIFE! Then they proceed to dismiss, yes dismiss his petition, the entire thing went in my favor! THe judge said he'd not ever had someone FILE a petition to modify an order and then not show up. HOw stupid is he? Well I know how stupid but geez. So they were sending him a letter, certified, today stating he has 14 days to pay the money he owes me from December through now or they will put him in jail. HA.
I live up to my obligations and responsilbities to my daughter. Why shouldn't he?
Justice will be served, as Toby says :)
That is my news of the day. The rest of my day was just normal :)

dawsongirl 02-19-2004, 11:33 PM <harshness alert>Perhaps it would be better for all if he just died.
And I'm not saying that just because he sounds like a lowlife. But I have a cousin that gets (or got...she's 18 now) money because her dad (who was a lowlife alcoholic) died. It might not apply here...but...
And no one yell at me like I think all alcoholics are lowlifes. I don't.

Yeah right.
Brian 02-19-2004, 11:42 PM I think it is selfish of him to do that. I say if you don't show, it's a no-go.
About the severe anxiety and depression, that kind of excuse would not wash with me and I'll tell you why. I have stated several times over the years that I am a high-functioning Autistic. If you don't understand what high-fuctioning means, think about a scale from 1-10, 1 being very Autistic to the point where you are withdrawn and very quiet and 10 where you are the opposite. I am at an 8. Even with my learning difference (I don't like to call it a disability) I will have obligations in life. In fact I have succeeded in many things despite my mental disorder so saying that I can't do something because I am Autistic would be no excuse.
I am Him 02-19-2004, 11:47 PM I believe the custodial parent should assume all financial responsibility to raise a child.
Of course the non custodial parent should contribute, but he/she should not be forced to by the government.

Why should the government have the right to tell a parent how much to spend on their kids?

Because if they refuse to pay their children anything, and it's proven that the child could really use the money just to live, someone's got to force them to pay. I consider it child abuse if they care so little that they'd rather have their children live in a box than pay child support. Child abuse is illegal. Government again.

:clap Hear, hear!
Jenya 02-20-2004, 12:11 AM I like what they do to deadbeat parents in Manitoba. If you continually don't pay child support, the courts can arrange to have your car and other property stripped away from you, and auctioned off. The money from the auction would go towards the other parent and child(ren).

The parent that has full custody should assume the financial responsibility. If that parent is unable to provide then the child should be placed with someone that can.

I consider it child abuse to take a child away from one parent to live exclusively with the other.

The courts are part of the government. Furthurmore, the government makes the laws. The courts make decisions based on the laws the legislature creates.

the laws should be changed to protect peoples rights.
If a child is suffering under the care of his/her parent, that child should be removed from that household.

Nanny Fine's daughter is just fine. She doesn't beat her daughter or anything like that. She REALLY tries to provide as much to her daughter - she gave her daughter a BIKE for Christmas. Now, tell me, how is THAT suffering?
Besides, the point is that Nanny WANTED her daughter. Her daughter's did didn't. He doesn't want to have anything to do with Nanny's daughter - I shudder to think what would happen if her daughter were to live with her dad.

kids arent goldfish - you can't just flush them when you get tired of feeding them

Even if the other one is a bad parent? I think a child would much rather live with the parent that loves and takes care of them. If the non-custodial parent doesn't even care enough to give the child support money, chances are they wouldn't be much better off actually living with them.
In Nanny Fine's case, it sounds like her daughter is much better off with her and not associating with her father.

Correct, my dear.
My parents are divorced, and all together, my parents had 3 kids. My brother, my sis and I. My mom got custody of me and my sister, and my dad got custody of my brother. We still saw each other often.
Nanny Fine 02-20-2004, 08:04 AM
I go to bed and there were no responses and I get up and this!
My daughters father said when I refused to have the abortion he demanded that if I made him pay child support he would make sure there was no child to support. I did not file for FIVE years. He made comments like "I wonder what sex with a child feels like" and "if I were to get her you might not get her back".
There is no way on God's green earth that I would let him anywhere near my child so it's a blessing that he does not want to be, that he's never made an effort.
He said he was not ready to be a father. Uh, too late for that pal.
My daughter considers herself lucky because she has a mom who is both a mom and a dad. She says she doesn't have to share me and I dont have to share her.
We dont have much but everything I have is for her. I didn't create her on my own and I shouldn't have to pay for her care on my own. He's in all rights abandoned her and that's not my problem. She should not suffer because he's a jackass. Right?

I don't regret for one single solitary second having my daughter. She changed my life and is the single most important and best thing that has ever happened to me.

JoJoJoJoJoJoJoJoJo 02-20-2004, 01:45 PM All actions come with consequences. If the man didn't wanna take care of his daughter, he shouldn't of whipped it out in the first place. It takes two to make a baby, and two to take care of it. It's obvious that this child is better off with her mother, Nanny Fine. I would hate to see what would happen to this child if she came up sick, but poor ol "i'm so depressed dad" didn't wanna take her to the doctors because he's "not forced" too. You make a child take a bath when he's dirty, but no one cries that his rights are being taken away. This father has not taken responsiblity for the kid he help create, therefore someone has to make him.
Duh.
Bang A Gong 02-20-2004, 04:52 PM I'm really sorry about your situation Nanny Fine. That guy is such a loser. He needs to realize that he played a major part in making that child and that, even if he doesn't want anything to do with her, he still needs to pay.

If women would get with a decent man, they would have an ex that would voluntarily give money and time.
If women find deadbeats more exciting and sexy, then why should the law enforcement and courts be burdened with forcing the deadbeats to pay child support?
Law enforcement already has a lot on their hands dealing with murderers, carjackers, snipers and terrorist.

When you gamble and loose, you don't get your money back.
Good f*cking God. Which hole are you talking out of? No, I'll answer that for you. You're talking out of your ass hole. :)
There are MANY reasons parents choose to be single and divorced. Not just because of one parent being a deadbeat. :D

So if you were to look at this innocent gentleman, it would be a proven fact that he is not a deadbeat?

Sexist- prejudice or discrimination based on sex; especially : discrimination against women
Pig- Any of several mammals of the family Suidae, having short legs, cloven hooves, bristly hair, and a cartilaginous snout used for digging, especially the domesticated hog, Sus scrofa domesticus, when young or of comparatively small size.

It's painfully obvious what it is.
And ANYBODY can be a deadbeat. It can be a male, a female, obese people, thin people, any skin color...You could be talking to a deadbeat and not know it. They don't wear a sign around their neck. You're stereotyping, big time.

I worked with an assistant manager who treated his female employees-me also-like whores and worked all the females much, much, more harder than the male employees and he was the reason that I quit at the grocery store!!

If a guy is pre-occupied with drinking and partying, chances are he's a deadbeat.
If a guy has tatoos up and down his arms and legs, chances are he's a deadbeat.
If a guy has more piercings than you have, chances are he's a deadbeat.
Its not hard to tell.
STEREOTYPING.

I think he meant that Nanny Fine's bf suddenly turned into a deadbeat when a full moon came out...like he was a freakin werewolf.
Lame comparison.

There's no full moon out tonight, so I'd go with the latter. ;)
