She told his father Tim in Joey Goes To New Orleans
"I happen to work for the Chief of Police and Joey just happens to be our...our foster child."
Tim got upset and confused and thought Joey was staying with his uncle Jerry.
In Nell Goes back To New York, Tim let's Nell have full resonsibility of both Joey and Matthew and promises he would not interfere, as long as he could see them every once in a while which they agree to.
So I think Nell was just his Foster mother, until Tim took Joey for himself and then gave him back to Nell because he saw how good he turned out and wanted her to raise him and Matthew together so he could go back to sea.
