Alec Baldwin on Friday expressed his “shock and sadness” over an incident on the set of his film, Rust, where a gun he was handling misfired, killing the cinematographer and wounding the director.
Director of photography Halyna Hutchins, 42, died after being injured Thursday when the prop gun was “discharged” by Baldwin, the Western’s producer and star. Hutchins had been transported by helicopter to the University of New Mexico Hospital, where she was pronounced dead, according to the Santa Fe County Sheriff’s Department.
“There are no words to convey my shock and sadness regarding the tragic accident that took the life of Halyna Hutchins, a wife, mother and deeply admired colleague of ours. I’m fully cooperating with the police investigation to address how this tragedy occurred,” Baldwin said via Twitter. “I am in touch with her husband, offering my support to him and his family. My heart is broken for her husband, their son, and all who knew and loved Halyna.”
The second victim was the film’s director, Joel Souza, 48, who was taken by ambulance to Christus St. Vincent Regional Medical Center. His condition was not released.
An update on the investigation will likely not occur until next week, Juan Ríos, a spokesman for the sheriff’s office, told The Hollywood Reporter on Friday, as interviews are ongoing and evidence is being collected. Baldwin was interviewed Thursday by investigators at the sheriff’s department, Ríos said.
A spokesperson from Rust said in a statement:
“The entire cast and crew has been absolutely devastated by today’s tragedy, and we send our deepest condolences to Halyna’s family and loved ones. We have halted production on the film for an undetermined period of time and are fully cooperating with the Santa Fe Police Department’s investigation. We will be providing counseling services to everyone connected to the film as we work to process this awful event.”

And that brings us to how a gun loaded with blanks can kill someone. The term 'blank’ is a shorthand version of the full term, blank cartridge. Notice I said cartridge and not bullet. A cartridge is a unit of ammunition fed into the barrel of a gun comprised of several parts: The casing (sometimes called a shell); propellant material (gunpowder) inside the shell; a primer on the bottom of the cartridge; and at the tip of the cartridge, the actual projectile (bullet) itself."

Attorney Brian Panish held a press conference in Los Angeles after officially filing the lawsuit on behalf of the Hutchins family. He called out Baldwin and other producers "for numerous violations" of industry safety standards on set. A 3D video was played for the media that Panish claimed was a reenactment of the shooting. He said they undertook their own investigation and spoke to a number of witnesses who revealed what happened on Oct. 21, when Hutchins was killed after a gun Baldwin was holding discharged.
Panish said they are seeking "substantial" and "fair" compensation as Matthew "lost his long-term wife who was the love of his life, and his son has lost a mother."
"It is a young boy who will never have a mother," Panish said during a Q&A. "We need to hold the people responsible that engaged in this cost-cutting and reckless behavior causing this senseless death... it never should have happened."
Panish noted they "have found no evidence" of sabotage, as attorneys for armorer Hannah Gutierrez-Reed initially suggested. He added it's still being looked at how a live round ended up on set.
"Alec had the gun in his hand, he shot it, Halyna was killed," Panish said. "The gun cannot fire unless the trigger is engaged and the hammer is back."
During an interview with ABC News, Baldwin said he does not feel like he's responsible for Hutchins's death and claimed he didn't pull the trigger.
"We don't think the weapon is what caused this," Panish added. "The weapon was made to fire — it fired."
When asked if Baldwin is the person "most culpable," Panish said there are "many people culpable" before singling out the actor and Rust producer.
"Mr. Baldwin was the person holding the weapon that, but for him shooting it, she would not have died. So clearly, he has significant portion of liability but there are others and that's what this case is gonna be about," Panish continued.
The complaint alleges that at least 15 industry standards were disregarded on set, like how Baldwin did not accept the revolver from the armorer and that industry standards require him to use a replica gun or rubber prop gun whenever possible. Other defendants in the complaint include Gutierrez-Reed; props master Sarah Zachry; armorer assistant Seth Kenney; first assistant director David Halls and other producers.
Baldwin previously said he expected a wrongful death lawsuit to be filed by Hutchins's widow. Baldwin's attorney Aaron Dyer, Pillsbury Winthrop Shaw Pittman, said on Tuesday afternoon "any claim that Alec was reckless is entirely false."
"Everyone's hearts and thoughts remain with Halyna's family as they continue to process this unspeakable tragedy," Dyer, who represents Baldwin and other Rust producers, tells Yahoo Entertainment. "We continue to cooperate with the authorities to determine how live ammunition arrived on the Rust set in the first place."
No criminal charges have been filed against Baldwin or anyone involved in the case.
"[Baldwin], Halyna and the rest of the crew relied on the statement by the two professionals responsible for checking the gun that it was a 'cold gun' – meaning there is no possibility of a discharge, blank or otherwise," the statement continued. "This protocol has worked on thousands of films, with millions of discharges, as there has never before been an incident on a set where an actual bullet harmed anyone. Actors should be able to rely on armorers and prop department professionals, as well as assistant directors, rather than deciding on their own when a gun is safe to use."

“The death of Halyna Hutchins is a tragedy, and all the more so because of its preventable nature,” says the statement, which was released on Thursday. “It is not a failure of duty or a criminal act on the part of any performer.”
In October 2021, Baldwin fired the shot that killed Hutchins while the “Rust” crew was inside a church building on the Bonanza Creek Ranch near Santa Fe, N.M. Both the actor and the film’s armorer, Hannah Gutierrez Reed, who loaded the weapon, have been charged with involuntary manslaughter by Mary Carmack-Altwies, the First Judicial District Attorney in Santa Fe. The film’s first assistant director, David Halls — who handed the firearm to Baldwin on the set — agreed to plead guilty to a charge of negligent use of a deadly weapon.
“If any one of these three people — Alec Baldwin, Hannah Gutierrez Reed or David Halls — had done their job, Halyna Hutchins would be alive today,” said Andrea Reeb, the special prosecutor appointed by Carmack-Altwies to oversee the case, in a statement. “It’s that simple. The evidence clearly shows a pattern of criminal disregard for safety on the ‘Rust’ film set. In New Mexico, there is no room for film sets that don’t take our state’s commitment to gun safety and public safety seriously.”
In its statement, SAG-AFTRA takes issue with the prosecutor’s line of reasoning.
“The prosecutor’s contention that an actor has a duty to ensure the functional and mechanical operation of a firearm on a production set is wrong and uninformed,” says the statement. “An actor’s job is not to be a firearms or weapons expert. Firearms are provided for their use under the guidance of multiple expert professionals directly responsible for the safe and accurate operation of that firearm. In addition, the employer is always responsible for providing a safe work environment at all times, including hiring and supervising the work of professionals trained in weapons.”
The union points to codified industry standards from the Labor Management Safety Commission that require “an experienced, qualified armorer to be put in charge of all handling, use, and safekeeping of firearms on set.”
“The guidelines do not make it the performer’s responsibility to check any firearm,” the statement continues. “Performers train to perform, and they are not required or expected to be experts on guns or experienced in their use. The industry assigns that responsibility to qualified professionals who oversee their use and handling in every aspect. Anyone issued a firearm on set must be given training and guidance in its safe handling and use, but all activity with firearms on a set must be under the careful supervision and control of the professional armorer and the employer.”
Baldwin has said that when Halls handed him the gun that killed Hutchins it was “cold” — in other words, containing dummy rounds. The gun was found to contain one live bullet, and other live rounds were found throughout the set.
Industry experts have noted that it is common practice for actors handling firearms to follow general safety practices that Baldwin allegedly did not on the “Rust” set, according to on-set video, including keeping one’s finger off the trigger during rehearsals and never pointing a firearm directly at other individuals. Baldwin has repeatedly said he is not at fault for Hutchins’ death, and his lawyers have pointed to a series of alleged errors by Halls, Gutierrez Reed and others for the shooting.

Alec Baldwin is not a firearms expert. That's why he hired an armorer. It is not his responsibility to micromanage his employees 24/7. Should he start following around the plumber who installed the toilets too? Should Baldwin also be knowledgeable about plumbing, etc.? Where does it end?
The fault lies with the armorer, Hannah Gutierrez. I don't know how she lives with herself. I don't even care for Alec Baldwin but in this case, I side with him.

Alec Baldwin and his legal team didn’t have anything to say Monday when the Santa Fa D.A. dropped a disputed charge in the fatal Rust shooting criminal case that could have seen the actor behind bars for up to five years for the death of cinematographer Haylna Hutchins.
Taking a victory lap of sorts today, Baldwin and his “big-city attorneys,” as a D.A. spokesperson termed them, now had a lot to say – with more than a few knocks on District Attorney Mary Carmack-Altwies and special prosecutor Andrea Reeb.
“In light of the government’s concession that its decision to charge the enhancement was legally erroneous, the Motion is now moot,” said perhaps the most deferential lines in the February 20 filed notice of withdrawal from Baldwin’s NYC-based Quinn Emanuel Urquhart & Sullivan.
“As set forth in the Motion, the inclusion of the enhancement thus violated the Ex Post Facto Clauses of both the United States and New Mexico Constitutions,” the motion adds.
The five year sentence is now off the table with a maximum of 18 months now as the primary prison time.
The D.A.’s office did not respond to request for comment Tuesday on the withdrawal motion from the defendant.

Widely expected for several months, a New Mexico Grand Jury issued the indictment early Friday, according to Special Prosecutors in the case. Baldwin, who had always insisted he did not pull the trigger on the 1880s prop gun that killed Hutchins, could face up to 18 months behind bars if found guilty.
“We look forward to our day in court,” Baldwin’s lawyers Luke Nikas and Alex Spiro from Quinn Emanuel told Deadline today after the indictment was made public. The union argued that Baldwin was not responsible for firearms safety, and that if the prosecution rests on such a responsibility, “that is an incorrect assessment of the actual duties of an actor on set.”
“An actor’s job is not to be a firearms or weapons expert,” the union said. “Performers train to perform, and they are not required or expected to be experts on guns or experienced in their use. The industry assigns that responsibility to qualified professionals who oversee their use and handling in every aspect.”
Baldwin was holding a gun during preparation for a scene when it fired, killing Hutchins and wounding director Joel Souza. Baldwin has said that he did not pull the trigger, though the prosecution’s forensic experts concluded that the gun could only have been fired if the trigger was pulled.
Hannah Gutierrez Reed, the film’s armorer, is set to go on trial next month on separate charges of involuntary manslaughter and evidence tampering. She mistakenly loaded a live round into Baldwin’s gun, which should have contained only dummy rounds.
To prove involuntary manslaughter in either case, the prosecution will have to show “criminal negligence,” a higher standard than the ordinary negligence that would apply in a civil case. To rise to the level of criminal conduct, the behavior must be “reckless, wanton or willful” — not just careless.
In an interview with ABC News in December 2021, Baldwin said he had been trained not to point a gun at anyone and fire.
“I would never point a gun at anyone and pull a trigger,” he said. “That was the training that I had.”
Baldwin was initially charged in January 2023, but those charges were dropped three months later. SAG-AFTRA also came to the actor’s defense at the time of the original charges, saying the prosecution’s theory was “wrong and uninformed.”
California passed a law last year that set training requirements for film armorers and codified set safety standards for firearm use. Prior to the legislation, the industry’s safety rules had been voluntary, and there was no requirement that armorers get training.
The bill was the result of a compromise between the industry and the entertainment unions.
Gutierrez Reed did not receive any formal training as an armorer before taking the “Rust” job, though her father, Thell Reed, is a veteran armorer. In her police interview, she also said she never saw the industry-wide safety bulletins that are supposed to be attached to call sheets.
The prosecutors on the original case also sought to hold Baldwin accountable as a producer for management lapses on set, in addition to alleged mishandling of the gun. The case has since been reassigned to two special prosecutors, Kari Morrissey and Jason Lewis, who have not yet spelled out their theory of the case.

To the extent that the charges filed on January 19 are based on an accusation of negligent use of a firearm predicated on this or any actor having a duty to inspect a firearm as part of its use, that is an incorrect assessment of the actual duties of an actor on set.
An actor’s job is not to be a firearms or weapons expert. Firearms are provided for use on set under the guidance of multiple expert professionals directly responsible for the safe and accurate operation of that firearm.
The Industry Standards for safety with firearms and use of blank ammunition are clearly laid out in Safety Bulletin 1, provided by the Joint Industry-Wide Labor Management Safety Commission. The guidelines require an experienced, qualified armorer to be put in charge of all handling, use, and safekeeping of firearms on set. These duties include “inspecting the firearm and barrel before and after every firing sequence,” and “checking all firearms before each use.”
The guidelines do not make it the performer’s responsibility to check any firearm. Performers train to perform, and they are not required or expected to be experts on guns or experienced in their use. The industry assigns that responsibility to qualified professionals who oversee their use and handling in every aspect. Anyone issued a firearm on set must be given training and guidance in its safe handling and use, but all activity with firearms on a set must be under the careful supervision and control of the professional armorer and the employer.

A day before Alec Baldwin was scheduled to be arraigned on new charges in the fatal 2021 shooting of Rust cinematographer Halyna Hutchins, the actor has entered a not guilty plea.
Facing a prison sentence of 18 months to three years if found guilty, Baldwin was re-charged by a New Mexico grand jury January 19, a year to the day he was originally charged over Hutchins’ death. Due in no small part to incompetence by the initial investigators, those charges were dropped in April 2023 but never entirely disregarded by prosecutors.
Now Baldwin is charged with involuntary manslaughter (negligent use of a firearm), a lesser charge, and involuntary manslaughter (without due caution or circumspection).
“The above-named defendant did cause the death of Halyna Hutchins by an act committed with the total disregard or indifference to the safety of others, and the act was such that an ordinary person would anticipate that death might occur under the circumstances,” the grand jury indictment reads of the latter charge, a felony.
Thursday’s planned hearing is now canceled due to Baldwin’s plea and waiver of arraignment. However, while Baldwin is free without bail, there are conditions the Rust actor-producer must adhere to, according to New Mexico judge T. Glenn Ellington.
Baldwin is also not allowed to leave the U.S. without permission of the court, drink, or possess a firearm. Besides the renewed criminal case, Baldwin is up against a number of civil cases in California and New Mexico.

Saying that, this sounds like a tragic accident. But it’s again telling that no one to my knowledge has defended Baldwin, which means the man is probably not well liked among his peers.
My questions concerns the gun, prop guns have been used in movies for over a hundred years. Aren’t they just toy guns that shoot blanks? Why was there a gun that obviously shot projectiles that killed someone? That makes no sense. Anyone know?
I also think it’s interesting (to my knowledge) that no one has sued Baldwin, or the movie company or the director for the death. Was this woman married? Have children? I am sure she probably had insurance, but still. If something liked that happened to my wife, I would be out of my mind in grief and no amount of money would change that, but I would demand millions as punishment.

Santa Fe judge Mary Marlowe Sommer ruled Monday that the movie armorer will receive a maximum sentence of 18 months of incarceration at a New Mexico women's correctional facility.
Prior to sentencing, Gutierrez-Reed, 24, prepared a statement that she read aloud in court:
"First and foremost, my heart aches for the Hutchins family and friends and colleagues as well, and it has since the day this tragedy occurred. Halyna has been and always will be an inspiration to me. I understand that she was taken too soon, and I pray that you all find peace."

“The state has repeatedly made representations to defense and to the court that they were compliant with all their discovery obligations,” New Mexico Judge Mary Marlowe Sommer said in her ruling from the bench just now. “Despite their repeated representations, they have continued to fail to disclose critical evidence to the defendant.”
“The state is highly culpable for its failure to provide discovery to the defendant,” Sommer added in a measured tone. “Dismissal with prejudice is warranted,” she concluded.

Alec Baldwin‘s lawyers argued Friday that there is no reason to reopen his manslaughter case, and that New Mexico should be forced to pay his attorneys’ fees for having to respond to “continued abuse.”
Baldwin’s lawyers also submitted an affidavit from one of the two prosecutors in the Rust case, who stated that the other, Kari Morrissey, had told her to ignore a defense request to turn over evidence before the trial.
The trial came to an abrupt halt on July 12, when Judge Mary Marlowe Sommer threw out the charge, after it was revealed that the prosecution had failed to turn over a cache of bullets to the defense.
Morrissey, the lead prosecutor, argued in a motion on Aug. 30 that Marlowe Sommer should reconsider her decision and reinstate the charge. She argued that the defense had successfully confused the judge about the bullets, which she said had no significance to the case and did not undermine Baldwin’s guilt.
After the judge initially rejected the motion due to its length — 52 pages — Morrissey refiled a 10-page version.
Baldwin’s lawyers filed their opposition on Friday, in which they argued that Morrissey had “buried” evidence and lied about it before, during and after the trial.
“The intentional misconduct and fabrications that emerged at trial are consistent with Morrissey’s pattern of withholding evidence and lying about it from virtually the moment she took over this case,” they argued.
They also submitted an affidavit from Erlinda Johnson, Morrissey’s co-counsel, who resigned from the case shortly before it was dismissed. At the time, Morrissey stated that Johnson had stepped aside because she did not want to have a public hearing about the bullet evidence.
In the affidavit, however, Johnson said that was not true. She said that after she learned about the withheld bullets, she urged Morrissey that the “right thing for the state to do” would be to dismiss the case voluntarily, “but Kari Morrissey disagreed.”
Johnson said she resigned because she “felt my ethical obligations were for me to withdraw.”
“I did NOT resign from the case because I did not want a public hearing on the discovery issues,” she wrote.
Baldwin’s lawyers argued there is no basis to reopen the case, and that Morrissey’s motion should be dismissed for procedural violations or on the merits.
“Finally, the Court should award Baldwin’s attorneys’ fees for having to respond to the State’s defective motion and as a sanction against Morrissey for her continued abuse of the judicial process,” they wrote.
Morrissey has already indicated that the state may appeal the judge’s dismissal to a higher court, assuming the motion to reconsider is denied.
Hannah Gutierrez Reed, the Rust armorer, is serving an 18-month sentence after being convicted at trial in March for loading a live bullet into Baldwin’s gun. She has argued that her case should also be thrown out for similar discovery violations.
A hearing on that motion is set for next Thursday.

Although the involuntary manslaughter case against him was dismissed in July, Alec Baldwin still wants to tell his side of the 2021 Rust on-set shooting that killed cinematographer Halyna Hutchins.
The Oscar nominee said there’s “another phase” to come in the next couple months as he seeks to “expose what really happened” on the New Mexico set, where Hutchins and writer/director Joel Souza were shot when Baldwin’s prop revolver discharged live rounds.
“I think there’s more to come,” he explained on David Duchovny’s Fail Better podcast.
“There’s more to come, but the ‘more to come’ is now my effort, and it’s going to be undeniably a successful effort, to raise and to expose what really happened. I was counterpunching. I was on the defensive. I was being accused. I was being indicted.”
Baldwin said the press “suppressed every story that could benefit me and amplified every story that could hurt me. This has been for three years. And the truth of what happened has never been told, never.”
“We have more s— that’s going to come out in ensuing legal filings and so forth,” Baldwin told Duchovny. “These last three years, people have just dined out. Because in this country, when people hate you on that level, they want three things: They want you to die. The second thing is, they want you to go to prison.
These political crowds, both sides, they love to see their enemies put in prisons for years because prison is like a living hell. And the third thing is, they want you canceled, which is like being in prison or being dead, because you roam the earth and you’re just invisible.”
Noting that “things are coming back my way” professionally, Baldwin added, “There’s so much of this case that is not known because we didn’t have a full trial.”
Although he’s “grateful” the judge dismissed the case with prejudice, Baldwin thinks getting a solid verdict would have been “a little bit better,” as his legal team had “troves of things to present.”
Baldwin said he’s pursuing “another phase” in bringing the truth to light in the next “couple months” after the holidays, adding: “I’m going to take a break. I don’t want to talk about this for a while. I want to kind of take a nap.”

“Although no verdict in this civil case can undo the trauma the State’s threat of conviction and incarceration has inflicted, Alec Baldwin has filed this action to hold Defendants responsible for their appalling violations of the laws that governed their work.”
“Because Defendants’ actions were motivated by evil motive or intent and involved a reckless or callous indifference to Baldwin’s federally protected rights, an award of punitive damages is appropriate to the fullest extent permitted by law.”

"And I can tell you, it broke every nerve in my body, spiritually, financially, work-wise, my career, my wife, my kids, my friends, my health."
"I mean," he continued, "what it’s done to my health. I mean, if I told you what my health conditions have been since October 21st of 2021 — it’s taken 10 years off my life. It’s taken at least 10 years off my life."
The 2024 involuntary manslaughter charges against Baldwin were dismissed with prejudice during his July 2024 trial after a judge ruled that prosecutors sat on evidence that would have helped shed light onto how live ammunition was brought onto the set.
On the Dopey podcast, Baldwin also admitted that he had suicidal thoughts in the months after charges were re-filed against him. Baldwin was at first charged with involuntary manslaughter in January 2023, but those charges were dropped three months later.
"It’s really kind of unappealing to me because to talk about killing yourself and to actually kill yourself are two so profoundly distinctive things. I think a lot of people — I think countless people think about killing themselves and ending their life, and then very few do," he said.
"And for me, I remember, I used to lay there in bed and go, ‘Oh God, I can’t wake up another day and have it be the same. It’s the same every day. And I can’t do it.’ But somehow I found the faith in God to, you know, not kill myself tomorrow. Let’s wait one more day," he said.

Baldwin, 68, appeared on The Hollywood Reporter (https://www.hollywoodreporter.com/movies/movie-news/alec-baldwin-rust-health-retire-podcast-awards-chatter-1236561876/)'s Awards Chatter podcast on Monday, April 13, where he said the time he spent at home with wife Hilaria Baldwin and their seven children under 13 after Hutchins' death has changed his perspective on working. "For me, because of the situation in New Mexico, that was very painful," he told Scott Feinberg, after the host quipped that Baldwin "never stop working or surprising us" at the end of the interview.
"I wound up staying home a lot. I was home with my kids for three and a half years," the 30 Rock star said. "I hardly worked at all. And that's just changing now, I'm going to go off and do a bunch of things, but I was home and I got used to it, and I don't want to leave my house anymore. I don't. I don't want to work anymore. I don't. I really don't. I want to retire and stay home with my kids."
Baldwin shares his oldest daughter, Ireland, 30, with ex-wife Kim Basinger. He married wife Hilaria, 42, in 2012: the couple's seven children include daughters Carmen Gabriela, María Lucía Victoria, and Ilaria Catalina Irena, as well as sons Rafael Thomas, Leonardo Ángel Charles, Romeo Alejandro David and Eduardo "Edu" Pao Lucas.
Baldwin was the subject of a criminal investigation into the circumstances surrounding Hutchins' death on the Rust film set in 2021. The actor was at first charged with involuntary manslaughter in January 2023, but those charges were dropped three months later. He was then charged with involuntary manslaughter again in 2024, but those charges were dismissed with prejudice during his July 2024 trial after a judge ruled that prosecutors sat on evidence that would have helped shed light on how live ammunition was brought onto the set.
Baldwin offered a glimpse of his experience coping with the aftermath of the Rust shooting in his TLC series, which debuted in February 2025.
“I don't know where I would be if I didn't have her,” Alec told PEOPLE of Hilaria prior to the series' debut. “I don't know what would've happened to me.”
Baldwin's time spent at home with his family as the investigation played out was also covered in a yet-to-be-released documentary titled The Trial of Alec Baldwin, which premiered at DOC NYC in November 2025.
Baldwin shared a peek inside his life with his large family during the podcast. "My kids are all born in Manhattan, same hospital, same doctor," Baldwin said on Awards Chatter. "And my son Romeo was there and we're picking clothes, they're picking out ski jackets back in November. And I go, 'Get that one, get that color. I like that one. Don't just get the black, get that one.' And he looks at me and goes, 'What do you know? You're from Long Island.' "
"And that's my life now, day after day after day after day," he added.
Baldwin most recently appeared on the big screen in a Spanish comedy titled Torrente Presidente, in which he portrayed Donald Trump. He has a number of projects in the works, including a movie titled The Cutting Room Floor, which Deadline first reported in April 2025. Baldwin will also play a fictionalized version of himself in the comedy National Lampoon's Hollywood Hustle, which The Hollywood Reporter reported in January.

Alec Baldwin's days in court aren't yet over.
The Oscar-nominated actor previously faced involuntary manslaughter charges stemming from the 2021 on-set shooting of Rust cinematographer Halyna Hutchins. And while that case was officially dismissed, Baldwin is now dealing with a civil trial over alleged negligence.
Rust gaffer Serge Svetnoy is arguing that he suffered emotional distress after Baldwin fired a gun that turned out to contain a live round, which resulted in the death of Hutchins.
On Friday, Los Angeles Superior Court Judge Maurice Leiter allowed Svetnoy's case to move forward, while also throwing out the allegations of assault, believing that there was no intention of harm from Baldwin.
"As to intent, the analysis is different on this claim than on the assault claim… A reasonable jury could find that Mr. Baldwin recklessly disregarded the probability that pointing a gun in the direction of someone, with the finger on the trigger, would cause emotional distress," the judge wrote in his summary.
An attorney for Sventoy, John Upton, said in a statement to Entertainment Weekly, "We are pleased with the Court's decision to deny the motions for summary judgment brought by Rust Movie Productions and Alex Baldwin. These rulings enable our client to present his case at a jury trial, now scheduled for October of this year. He looks forward to finally having his day in court on this long-pending matter."
A trial date for the latest civil case is currently set for Oct. 12, with the judge reportedly noting, "I'm a little concerned about this case going on and on and on when it should be coming to a resolution."
