Pennsylvania’s highest court overturned Bill Cosby’s sex assault conviction Wednesday after finding an agreement with a previous prosecutor prevented him from being charged in the case.

Cosby has served more than two years of a three- to 10-year sentence at a state prison near Philadelphia. He had vowed to serve all 10 years rather than acknowledge any remorse over the 2004 encounter with accuser Andrea Constand.

The 83-year-old Cosby, who was once beloved as “America’s Dad,” was convicted of drugging and molesting the Temple University employee at his suburban estate.

He was charged in late 2015, when a prosecutor armed with newly unsealed evidence — Cosby’s damaging deposition from her lawsuit — arrested him days before the 12-year statute of limitations expired.

Bill Cosby always maintained his innocence going as far as to not take part in a sexual assault rehabilitation program while in prison which affected his recent parole hearing in which he was denied parole. Now, will people start watching the Cosby Show again? Will classic tv stations that shied away from scheduling The Cosby Show schedule it in the future?

Bill Cosby was released from prison Wednesday after his conviction on sexual assault charges was overturned by Pennsylvania's highest court.

The 83-year-old Cosby walked out of the State Correctional Institution Phoenix in Montgomery County, Pennsylvania, Wednesday afternoon, officials told ABC News.

Cosby's publicist, Andrew Wyatt, told ABC News earlier Wednesday that he was going to pick Cosby up at the prison.

Cosby was sentenced in September 2018 to three to 10 years in state prison for allegedly drugging and sexually assaulting former Temple University employee Andrea Constand in 2004. Cosby has served a little less than two years of his sentence.

Last year, the Pennsylvania Supreme Court agreed to hear two points in Cosby's appeal to overturn his 2018 sexual assault conviction.

In a ruling released Wednesday, the state Supreme Court concluded that Cosby's prosecution should never have occurred due to a deal the comedian cut with former Montgomery County prosecutor Bruce Castor, who agreed not to criminally prosecute Cosby if he agreed to give a deposition in a civil case brought against him by Constand.

"The discretion vested in our Commonwealth's prosecutors, however vast, does not mean that its exercise is free of the constraints of due process," the Pennsylvania Supreme Court justices wrote in their 79-page decision.

"When an unconditional charging decision is made publicly and with the intent to induce action and reliance by the defendant, and when the defendant does so to his detriment (and in some instances upon the advice of counsel), denying the defendant the benefit of that decision is an affront to fundamental fairness, particularly when it results in a criminal prosecution that was foregone for more than a decade," the justices wrote.

The decision went on to say Cosby was the victim of an unconstitutional "coercive bait-and-switch."

Believing he had immunity from criminal prosecution, Cosby testified during four days of depositions by Constand's attorneys, and the civil lawsuit was settled for more than $3 million in 2006.

Cosby cannot be retried on the criminal charges.

No where in the article does it say that Bill raped anyone. The woman in question willingly took a Quaalude pill which was a big thing in the 1970s and then had sex with Bill. Hugh Hefner used to pass out Quaaludes to females like it was nothing at the Playboy Mansion.

To be honest, I don’t know where I stand with this. Obviously, Cosby had to be involved somehow, he’s definitely NOT innocent, that’s for sure, and no woman deserves this harsh and insulting and vile treatment. But there had to have been something going on behind the scenes. The thing that got me was that after ALL these years, they wait until he’s elderly and not in the healthiest condition to build this up and lock him up. They said that there wasn’t enough evidence to back it up and that they wouldn’t use it against him, however he STILL got convicted, and yet, now he’s out of jail. What was the point of convicting him if you’re just gonna let him walk right back out? This is so inconsistent.

Bill Cosby is a rapist. There are just way too many victims out there to refute this.

Hollywood has known for decades what Cosby was up to, and it isn’t that much different than other perverted people in similar positions. Bill Cosby was in the good graces of Hollywood for decades and made Hollywood a lot of money, millions.

Around 2004-2005, Cosby went out and started talking and complaining about the plight of black people, basically blaming them for their overall station in life. Cosby was right and his position was a conservative one. Hollywood got angry at this and decided that they were going to get Cosby and ruin him, and this is the beginning of this scandal.

The way they locked him up was just wrong. The man is in his 80s, has trouble seeing, and has to get escorted on top of that. He can’t do much harm now. Definitely don’t think raping is excusable, but come on, you should’ve got that sh*t over with YEARS ago. Such a messed up system. Also, I find it strange how he was actually denied parole like a month ago, but look at him now.

That's AWFUL! Yes, I liked the show a great deal and had been a fan of his from 'The Electric Company' but the evidence (including what HE said for court record) was simply too strong to pretend that he was innocent (and it was so gut wrenching for me to have to reach that conclusion) . I hate that this charming, grandfatherly persona was actually a disguise concealing a serial criminal one. Regardless, he's an admitted rapist who DID serve two years in prison and this reversal of justice can't change that but I sure feel sorry for all those victims and their loved ones!

BTW, I hope EVERY tuition-paying student and their parent at Howard University considers how Ms. Rashad has refused to believe the accusers of Mr. Cosby (for YEARS) and questions whether there's any possibility she'll actually deign to listen to any of THEM if they get sexually assaulted- especially if they claim it been her fave faculty members or board members who did the deed (yes, I read the latter tweet of hers but the previous actions and words sure speak FAR louder than her hollow-sounding platitudes).

She should have never went after the money in a Civil trial and pursued a Criminal trial instead but she clearly wanted the money...she can't be upset that Bill Cosby has been released when she could have made a different choice that didn't leave the DA promising Bill Cosby immunity from prosecution for his Civil testimony.

The former Cosby Show star sent a letter of apology to the Howard University student body on Friday, one day after she assumed her new job as dean of the Chadwick A. Boseman College of Fine Arts and two days after her celebratory tweet over the overturning of Cosby's sexual assault conviction that she had to walk back.
