LAKE PIRU (CBSLA) — Authorities were searching for actress Naya Rivera (https://twitter.com/search?q=%22Naya%20Rivera%22&src=trend_click) Wednesday night after her 4-year-old son (https://losangeles.cbslocal.com/2020/07/08/naya-rivera-missing-lake-piru-4-year-old-son-safe/) was found floating alone on a rented boat in Lake Piru (https://www.dailymail.co.uk/news/article-8505089/Naya-Rivera-missing-presumed-dead-four-year-old-son-boat.html).

According to the Ventura County Sheriff’s Department, Rivera rented the boat at about 1 p.m. About three hours later, another boater found the child in the boat by herself.

The boaters notified officials who immediately began a search for Rivera (https://www.lipstickalley.com/threads/naya-rivera-is-presumed-dead.3692899/) with the use of helicopters, drones and dive teams.

The child was said to be unharmed and told investigators that she and her mother were swimming, but his mother never got back into the boat.

Authorities were working to reunite the child with family members.

Wrongful Death Lawsuit Filed in Naya Rivera Drowning

A wrongful death lawsuit was filed today in Ventura County Court on behalf of the four-year-old son of drowning victim Naya Rivera, claiming the county failed to adequately warn swimmers of the dangers at Lake Piru.

The suit comes four months after the July 8 death of the Glee actress, who was swimming in Ventura County’s Lake Piru with her son, Josey, when the incident occurred. The boy was able to climb back onto the rented boat.

The suit, which also names as defendants United Water Conservation District as well as Parks and Recreation Management (PMC), was filed by Josey’s father Ryan Dorsey, along with Naya Rivera’s estate and business manager.




“At the Lake Piru Recreation Area boating dock, Naya rented a pontoon boat from PMC – a boat that, it turned out, was not equipped with a safely accessible ladder, adequate rope, an anchor, a radio, or any security mechanisms to prevent swimmers from being separated from their boats,” the suit alleges.

“Disturbingly, later inspection revealed that the boat was not even equipped with any flotation or lifesaving devices, in direct violation of California law…”




According to the suit, no signs were posted anywhere near the popular Diablo Cove swimming area “warning of the lake’s strong currents, low visibility, high winds, changing water depths, underwater caves, ledges, and drop offs, or the trees, brush, and other debris that congest its waters due to vastly changing water levels and winds.”

The suit says that at least 26 other people, “from children to fit adults to elders,” have drowned in Lake Piru since its recreational facilities opened.




The suit also provides a horrific account of the actress’ final moments.

“While Naya and Josey were swimming, the boat started to be carried away – likely by the current and wind, which gusted up to 21 miles per hour that afternoon. Josey, who was closer, managed to get back on the boat on his own volition and braced himself on the boat, which was rocking back and forth forcefully in the current and wind. Josey knew Naya was still in the water, and heard her cry, ‘Help! Help!’ in her struggle to get back to the boat and avoid drowning.

Josey searched in vain for rope to help his mother get back on the boat. Josey then looked back at the water for his mother, and saw that Naya had disappeared. Josey yelled for help and cried alone in the boat until he was found more than an hour later by a PMC boat leasing agent.”

Ryan Dorsey is ready to speak about the sudden death of his ex-wife, Naya Rivera.

For the first time since the "Glee" star and mother of his child died in a tragic boating incident nearly five years ago, Dorsey has opened up about the devastating call that started it all. Dorsey revealed that he was in a supermarket when he learned from Rivera's stepfather that she had gone missing while swimming with their then 4-year-old son, Josey.

"I instantly said, 'What do you mean? She knows how to swim,'" Dorsey recalled in a candid new interview with PEOPLE. "He said, 'They jumped in, and Josey got back on, and they're trying to find Naya.' I collapsed into a pallet of drinks. I didn't know what to think, but I feared the worst."




Dorsey, who was in Big Bear Lake, Calif., for a friend's birthday party at the time, immediately jumped into his car and sped 145 miles to Lake Piru so that he could reunite with his son.

"I drove 100-and-*something the whole way with my four-way hazards on, chain-smoking cigarettes — and I don't even smoke, really — and just crying," he said. "I just wanted to get to Josey."




Rivera's death would not be confirmed until several days later on July 13, 2020, when her body was recovered after a weeklong search. She went missing after embarking on a boating trip with Josey, who was found safe, asleep in a lifejacket, on the drifting boat.

According to investigators, Rivera was able to help her son get back into the boat but could not do so herself.




"It was the worst five days of my life," Dorsey said of the waiting for news while officials searched for Rivera. "There was a fear: 'What if we don’t find her?' It was just awful."

He added, "If we'd have lost both Naya and Josey, I don't know how I would continue on with my life. I don't know what I would've done, but I'm sure it wouldn't have been good."




As for what his son recalls of the traumatic day, Dorsey became emotional while reflecting on the details Josey has shared with him.

"He said that the last thing she said was his name, and then she went under, and he didn't see her anymore," Dorsey said, with tears in his eyes. "It just rocks my world that he had to witness her last moments."




He also spoke to Josey's resilience in the wake of the tragedy, adding that though he is "such a happy kid," the loss has also taken a toll on him.

"I treat him differently than I would a normal kid because of what he's been through,” Dorsey said, noting that his 9-year-old son still feels guilt over his mother's death. "Something he's said over and over is that he was trying to find a life raft, and there was a rope, but there was a big spider on the rope, and he was too scared to throw it. I keep reassuring him, 'Buddy, that rope wasn't going to be long enough.'"

He does see pieces of Rivera in Josey. "He's definitely his mama's son, because when he doesn't get the answer he wants, he keeps talking," Dorsey said. "He likes to talk, and that's mama for sure."




Still, Dorsey said his son can't forget the detail "because he feels like he could have saved her."

While he described the incident as a "freak occurrence," Dorsey admitted that he, too, ponders how things would have gone if he had been present. "I probably would have jumped in, and I like to think I would've saved the day," he said. "But on the other hand, I think maybe something bad could have happened to both of us. I don't know."
