I feel for him. To me, Lori owes him and the rest of the cast a big apology for putting them in a situation to where they don't know what to say about all that she has done.

Well Lori and her hubby are taking a real crap shot. If they lose they lose big. Me personally would like to see the judge go heavier on fining them and community service than with jail time. 40 years seems way too harsh but 1-2 years with VERY HEAVY fines AND LOTS of community service would work (for me at least)
