A hypothetical situation;
While waiting at a traffic light I notice a bald guy in a Ford truck in the next lane. Just for the fun of it I hit him in the side of the head with a half-eaten jelly doughnut. He calls the cops and when they show up they ask me if I threw the doughnut, I am in no position to deny it since I have jelly on my mouth and fingers and he has jelly on the side of his head. I told them that he asked for a bite of my doughnut and that I shouldn't be blamed for his lousy catching ability. They didn't buy my story and figured since we were in vehicles I should be charged with road rage. But wait......after further investigation they discover that I picked on him because who he is. It seems that when I was a child a bald guy driving a Ford truck ran over my dog and I had extreme hatred for bald guy's driving Ford trucks ever since. Could I now be charged with a hate crime? Can I be charged with both or does one cancel out the other ? Is it like in football,can the bald guy decline the lesser penalty? Which one is more severe ? Crimes are getting complicated these days.
