Report: Brooke Mueller Refuses Court-Ordered Drug Test

Brooke Mueller has a refused to take a court-ordered drug test, TMZ reports. The procedure is a mandate set by her child-custody agreement with ex-husband Charlie Sheen.

When authorities arrived at Mueller's home for the scheduled test on Friday, Mueller's lawyer informed them that she would not be taking it. Refusal constitutes as a failed test.



It is unclear how Sheen and his lawyers will respond.

Sheen and Mueller's divorce was finalized in February and becomes official May 2. They have 2-year-old twin boys, Max and Bob.

It depends on the state but usually there are waiting periods in-between when the judge finalizes the divorce and when it becomes official.

After the judge finalizes it there usually is a waiting period for both parties to look everything over and make sure they are ok with the situation.

Also it's a waiting period to see if both parties are keeping up to date with things that the court mandates ex. drug testing.

Brooke Mueller is back in rehab, TMZ reports.

According to the site, Mueller spent the week binging before checking in to an unspecified facility.



The news comes days after Mueller refused to take a court-ordered drug test that is part of her child-custody agreement with Charlie Sheen. Refusal constitutes as a failed test.

Mueller has been in rehab twice in the past year.

Neither Charlie nor Brooke are fit to raise these children. The best thing that could happen to them is for them to be put in foster care.

I just read on TMZ that Charlie wants Full custody of the kids on the count that Brooke relapsed and, he wants to stop paying $55,000 a month for child support.... Both these idiots shouldn't have the kids!!! Sheen can get full custody of the kids when he can get his job on two and a half men back...

Despite refusing a court-ordered drug test, Brooke Mueller will maintain custody of the twin boys she shares with ex Charlie Sheen, the New York Daily News reports.

Sheen wanted to remove Mueller's legal and physical custody of their 2-year-old sons, Bob and Max. But in a hearing Tuesday, judge Hank Goldbert decided to keep the couple's private custody agreement the same.




Mueller reportedly checked herself into rehab after refusing a court-ordered drug test. The tests are part of her child-custody agreement with Sheen and refusal constitutes as a failed test.

She's been in rehab twice in the past year.






Sheen took a detour from his "Violent Torpedo of Truth" tour to visit California for the custody hearing. After losing his bid to get the twins back, Sheen hopped on a plane again to make his Washington, D.C. concert, scheduled for 8 p.m. Tuesday.
