Actress Lindsay Lohan taken to jail in handcuffs

BEVERLY HILLS, Calif. - Actress Lindsay Lohan returned to jail in handcuffs Friday after a judge refused to set bail and ordered her to remain in custody for failing a drug test until another hearing nearly a month away.

Bailiffs handcuffed Lohan immediately after the hearing that lasted less than 10 minutes at the Beverly Hills courthouse.

Lohan's father, Michael Lohan, said "Oh God" as his daughter rose, looked at her attorney and was handcuffed.

Los Angeles Superior Court Judge Elden S. Fox would not listen to arguments for bail from Lohan's attorney, Shawn Chapman Holley.

It will be Lohan's third jail stint for a three-year-old drug and drunken driving case filed after a pair of high-profile arrests in 2007.

Lohan has twice been released early because of overcrowding, with her longest jail stay a 14-day stint on a 90-day sentence earlier this summer.

But this time, the judge's order diminishes the likelihood that Lohan will be released before an Oct. 22 hearing, when her positive drug test will be discussed.

"When you put the judge in a tight spot, he has no alternative," said Barry Gerald Sands, a defense attorney who has represented celebrity clients in drug cases. "She will not get out now."

The previous judge handling Lohan's case had said she had to set bail for Lohan because she was facing misdemeanors, and a bondsman was sitting in the courtroom ready to post bail.

"This judge feels he didn't have to set bail," Sands said, adding that Fox's orders are rarely overturned.

The judge said probation officials are also reviewing Lohan's compliance with other aspects of her probation, which included frequent meetings with counselors.

Holley was not immediately available for comment. Court spokesman Allan Parachini said she remained in the courtroom to confer with Lohan.

Lohan acknowledged failing a court-ordered drug screening last week in a series of Twitter postings.

She arrived at the courthouse Friday about 10 minutes before the hearing was set to start, wearing sunglasses and accompanied by her mother, Dina. Her father arrived earlier.

Lohan has sparred publicly in recent months with Michael Lohan, who she sometimes calls her "ex-father."

It was the "Mean Girls" star's first appearance before Fox, who had said at a previous hearing he would sentence her to a month in jail for each drug test she skipped or failed.

The actress wasn't present for that hearing, which was held hours after her release from rehab.

Lohan seemed to acknowledge an addiction problem after news of her positive drug test broke last week.

"Substance abuse is a disease, which unfortunately doesn't go away over night," Lohan posted on her Twitter feed last Friday. "I am working hard to overcome it and am taking positive steps.

"This is certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences," her posts said.

The actress remains on probation for a reckless driving and two driving under the influence charges, all misdemeanors. Fox dropped two drug cases at a hearing in August during which he announced Lohan's release from rehab and set out a strict outpatient treatment schedule that included random drug screenings.

Fox has sealed Lohan's court file, but a source familiar with the case has told The Associated Press that the actress' failed test came roughly two weeks after her release from rehab.

Hopefully it's for a significant amount of time followed by a forced 90-day+ rehab stay.

I wonder a few things,because everyone was taken aback by the judges' real harsh decision.Lindsay,her lawyer,the lawyer for the OTHER side,her mother,her father,the legal analysts for the TV news shows,the baliff,everyone involved with the case.And I'll bet the person who was REALLY surprised was the original judge.Maybe NOW Lindsay will learn.

I don't think any amount of 'punishment' is likely to help unless she reaches deep within herself and finds a reason to change (and probably save) her life. Addicts don't think logically so I don't think it's reasonable to expect she'll think "Oh I keep getting punished for this so I better quit". My guess is that all she's thinking about is getting out and getting high again.

There is hope for her, of course, but it'll have to be her choice, for her reasons. The jail time is a good thing to keep her off the streets and away from potentially harming others but some kind of rehab/halfway house is probably the best solution.

It must be a strange life. Doing drugs, knowing the penalty and really not caring. Then when you do go to jail, the jails are over crowded, so you are released early. All I can say bad behavior will eventually do you in. I wonder if she will be alive by age 30.

So do I. It doesn't help that her mom is a card-carrying member of the Mama Rose school of stage mothers, and her father isn't much better. Lindsay needs a sponsor, and people who will give her the tough love approach and not coddle her. Obviously, the kid-glove treatment hasn't worked.

She's a idiot and she should be put in general population with the rest of the crazy female inmates and i bet then she'll change her life hahahahahahahaha. I bet she was crying when she got handcuffed hahahahahahahahahahaha.

I hope you never have to experience the sorrow and pain of a loved one who is an addict. If so, you might have to lose the vindictiveness and drop the totally inappropriate mocking tone.

Exactly. My uncle, who died in July, was an alcoholic. He was sober for many years at the time of his death, but he never forgot - and worked with AA for over 20 years. We heard from many people he helped at the time of his passing.

As long as there's life, there's hope. Let's hope Lindsay gets the proper health/treatment before it's too late. Not that she shouldn't be punished for her misdeeds, but at least she'd be alive.

Lindsay makes for a great punchline for late night hosts, but she's a human being in distress. I hope she gets the help she desperately needs.

I absolutely agree! I don't know what makes Isiahthomas the way he is but I am about tired of it.

I am so impressed by the level of sympathy and compassion you have for
someone like Lindsay Lohan. Sadly, that seems to be lacking with the general
public who seem to take great delight in her self destruction, just like with
Britney Spears.

Lindsay was one of the few younger stars who actually had acting talent and future potential. But now, instead of trying to make a comeback, she really needs to try to overcome her addictions. It's sad that her family seems to be doing very little to help her get on track.

Not only is her family not helping her they're her biggest enablers! She needs to separate herself from them to have any hope of recovery. I just hope she figures that out before it's too late.

I think the whole serving 14 days out of a 90 day sentence is ridiculous. By all rights, she should just be getting out of jail right about now instead of going back in. I don't think that anybody is doing her any favors by giving her special treatment. I hope and pray that she can fight her demons and beat her addiction once and for all, but i think the only way that can happen is if she leaves her parasite family and leaves Hollywood, and gets into some kind of program where people aren't going to be so awe struck by her fame. In other words, she needs a little tough love.

Exactly. She needs to get out of LA fast. Lindsay, go to Ohio, Kansas, Tennessee, someplace in the suburbs of the heart of America. A change of pace and scenery will do you good!!! Plus the rehab centers are a lot tougher here!!
