The report has said there was no physical evidence of violence yet, and it was a citizen's arrests, plus there has been no declaration of being guilty already.

What is with these players who think they can get away with everything? Not saying he did it ,but this reminds me of the incident with the Oregon Ducks player who punched that Idaho player on Thursday. What a jackass! I don't know what the other player said to him, but he was a moron to haul off and punch the guy and then go after the fans! Now he still has to practice with the team but he can't play in any games for the rest of the year! Even in bowl games! What a waste!!!

I know! Why do athletes always get free passes for crimes like this while regular people have to pay their dues? Totally unfair. ohno: :mad:

The lawyer representing the woman accusing Chargers linebacker Shawne Merriman of battery and false imprisonment indicated Sunday that Tila Tequila Nguyen would not be commenting on the incident that resulted in the pursuit of charges against him.

"Due to the serious nature of this matter, and out of respect for all domestic violence victims and defendants, Ms. Nguyen and her representatives will not be publicly addressing the facts and circumstances of the incident," New York-based attorney Scott E. Leemon told Kevin Acee of the San Diego Union-Tribune.

Apparently, there's been a change of plans.

On her Twitter page, which as of Sunday night was blocked from public viewing, Nguyen promises that she will address the situation on Tuesday.

In a tweet posted not long ago, she describes Tuesday as "judgment day."

"I haven't release an official statement on what happened yet because I didn't lie, so no need to release 3 statements to 'cover' myself," she said in a backhanded slap at Merriman's contention that he prevented her from leaving his house because she was intoxicated.

"Just wait til the whole story comes out," she said. "I am letting them talk and bash me all they want. I dont care. I know the truth. [A]nd it will come."

Nguyen also hints that she was restrained because of something she had seen: "There is only one reason why I was running for my life.....why was I stopped? Hmmm....maybe the truth didnt want to leave the house."

So what's the truth that didn't want to leave the house? It's unknown at this point.

That said, she devotes several of her Monday night tweets to the issue of steroids, a substance for which Merriman tested positive in 2006. So it doesn't take a rocket surgeon to put two and two together on this one, and to at least wonder whether she's going to claim that she came across a stash of nandrolene.

But that's all speculation. Nguyen says that she'll comment on Tuesday. Regardless of whether what she says is legit, she's done a good job of building suspense.'

The owner of the nightclub where Shawne Merriman spent time with TV personality Tila Tequila on Saturday has refuted her claim that she was not drinking prior to the arrest of the Chargers lineback Sunday morning.

Tequila said on Twitter that she was allergic to alcohol and is unable to drink.

James Brennan, the owner of the Stingaree nightclub, said several of his employees told him she drank several shots of tequila and sipped a bottle of vodka.

"She wasn't like falling down or anything of that nature, but she was visibly intoxicated," Brennan told the AP.

"It sounds like she's allergic to the truth."

Merriman has denied assaulting Tequila and said he was trying to help her get home safely before police arrested him on Sunday.

He practiced with the Chargers on Monday and reiterated his innocence afterward. -- Sean Leahy

SAN DIEGO -- The District Attorney's Office on Wednesday began reviewing accusations of domestic violence that reality TV star Tila Tequila brought against star linebacker Shawne Merriman of the San Diego Chargers.

The DA will review reports from the San Diego County Sheriff's Department and decide if the player known as "Lights Out" will be charged.

Merriman was arrested early Sunday after Tequila accused him of choking and throwing her to the ground while she was trying to leave his home in suburban Poway. Tequila signed a citizen's arrest warrant accusing Merriman of battery and false imprisonment. Both are felonies.

Spokesman Paul Levikow said the DA's office can charge Merriman, reject the accusations or refer them to the San Diego City Attorney's Office for consideration as misdemeanors.

Tequila, whose real name is Tila Nguyen, is best known for "A Shot at Love with Tila Tequila," which ran for two seasons on MTV. The bisexual dating show featured men and women vying for Tequila's affections. She has also modeled for Playboy and other men's magazines.

Merriman and his attorney, Todd Macaluso, have said they expect him to be vindicated. Merriman issued a statement Sunday denying wrongdoing and saying he was trying to keep Tequila from leaving his home because she appeared to be intoxicated.

"I in no way caused any harm to Ms. Nguyen, however, paramedics were called and she was examined but no injuries were reported," Merriman's statement read.

On Tuesday night, Tequila's attorney called Merriman's explanation "spin" and predicted it would be discredited.

"It is never justifiable to brutally assault, choke, strike and imprison a woman," attorney Alan S. Gutman wrote. "Once the truth is fully revealed, Mr. Merriman's fantastic story of how he was trying to keep Ms. Tequila safe will be completely discredited."

Gutman didn't return calls seeking comment Wednesday. Merriman and Macaluso said they had no further comment.

When Merriman bailed out of jail on Sunday, a court appearance was scheduled for next Tuesday. If no charges are filed, that appearance will be removed from the court calendar, Levikow said. If the DA's office hasn't decided by then, the appearance will be rescheduled.

Merriman is one of the NFL's hardest-hitting players, nicknamed "Lights Out" for his savage hits. There's a tattoo of a light switch on his right forearm that he pretends to flip while doing his spasmodic sack dance.

The three-time Pro Bowl selection has been getting back into shape after having season-ending knee surgery following the 2008 opener.

The Chargers open the 2009 season Monday night at Oakland.

'SAN DIEGO -- Multiple sources provided 10News' Juliette Vara with new details about what led to the incident last Sunday involving San Diego Chargers star Shawne Merriman and reality TV star Tila Tequila at the linebacker's Poway home.

Sources close to the story told Vara that Tequila -- also known as Tila Nguyen -- was unhappy that she was not the only woman getting attention from Merriman, and jealousy played a role in the early morning altercation.

The sources told Vara that witnesses at Merriman's home said the three-time Pro Bowl linebacker went to his bedroom with two women.

Sources said Tequila walked into the room and Merriman asked her to join them. However, the sources said Tequila reacted angrily and threatened to have sex with a member of Merriman's entourage.

According to sources, Tequila was intoxicated, and she got naked and attempted to leave the house.

Sources told Vara that Merriman, 25, tried to stop the 27-year-old Tequila, and that is when she called 911.

Tequila accused Merriman of choking and throwing her to the ground while she was trying to leave the house. Tequila signed a citizen's arrest warrant accusing Merriman of battery and false imprisonment. Both are felonies.

After practice on Wednesday, Vara talked to Merriman, but he did not discuss specifics about the case.

Vara asked Merriman to clarify his relationship with Tequila, and he immediately contacted his attorney.

"I don't know if … let me text my lawyer real quick," he said.

Merriman later acknowledged that he and the MTV star were friends and had only known each other for a short time.

"If anyone feels this is a distraction for me, I apologize," Merriman said. "I know my No. 1 priority is guys in the locker room."

Sources also told Vara that Tequila faked a neck injury, and when paramedics arrived they determined that she was OK. However, Tequila insisted on going to the hospital.

On Wednesday, the San Diego County Sheriff's Department handed over its findings in the case to the District Attorney's office.

The District Attorney's office will review the sheriff's department documents to decide if charges will be filed against Merriman.

The attorney representing Tequila disputed Merriman's claim that she was drunk when the linebacker allegedly choked her and held her against her will in his Poway home.

Attorney Alan S. Gutman issued a statement Tuesday, saying Merriam's comments since the incident early Sunday morning are nothing more than "calculated spin to cover up his illegal and indefensible actions."

Tequila Slams Authorities Over Choking Case Dismissal

Reality TV star Tila Tequila has lashed out at the San Diego District Attorney's decision to dismiss her allegation she was battered by her NFL player boyfriend - accusing authorities of "unconscionable negligence".

Last week (06Spe09), police were called to the home of San Diego Chargers footballer Shawne Merriman after Tequila dialled 911 and claimed she had been choked and prevented from leaving the property by the sports star.


The internet pin-up, real name Tila Nguyen, signed a complaint against her beau at the scene and was taken to a local hospital for treatment, while Merriman was taken into custody accused of battery and false imprisonment.

Merriman vehemently denied attacking his lover, insisting he prevented her returning home as she was "inebriated" and he didn't want her to travel alone.


District Attorney Bonnie Dumanis ruled on Friday there is insufficient evidence to prove beyond reasonable doubt that Merriman committed a crime.

But Tequila is fuming with the decision, and plans to launch a civil case against Merriman.


In a statement, her representative says, "Tila Tequila is the victim of a violent crime. The San Diego District attorney's decision not to press charges against Shawne Merriman for the battering of Tila Tequila demonstrates an unconscionable negligence in the discharging of their public duties. We strongly feel that justice has not been served in this matter.

"Obviously, The San Diego Charger's NFL franchise brings millions of dollars in revenue to the city of San Diego, and it seems clear that other interests are being served by the Da's office than the upholding of the law.


"A young woman was violently beaten and choked, and the physical evidence is both overwhelming and disturbing... Just because the Da has made this reckless decision doesn't mean that justice will not be served in this case. No one is above the law. Tila Tequila will immediately begin pursuing civil charges against Mr. Merriman and she will have her day in court."
