(LOS ANGELES) This just in from the Department of Duh: Cap'N Crunch Crunch Berries are not a fruit.

Last month, a judge in California dismissed a claim brought by a woman who believed PepsiCo, the parent company of Cap'N Crunch manufacturer Quaker Oaks, had misled "reasonable consumers" with its colorful Crunch Berries.

"Plaintiff contends that the colorful Crunchberries, combined with use of the word 'berry' in the Product name, convey the message that Cap'n Crunch is not all sugar and starch, but contains redeeming fruit," the opinion says.

"This Court is not aware of, nor has Plaintiff alleged the existence of, any actual fruit referred to as a 'crunchberry,'" Judge Morrison C. England, Jr. writes in the May 21 opinion brought to our attention by the blog Lowering the Bar. "Furthermore, the 'Crunchberries' depicted on the PDP [principal display panel] are round, crunchy, brightly-colored cereal balls, and the PDP clearly states both that the Product contains 'sweetened corn & oat cereal' and that the cereal is 'enlarged to show texture.'

"Thus, a reasonable consumer would not be deceived into believing that the Product in the instant case contained a fruit that does not exist," he said.

The ingredients from our bottle of Heinz ketchup:

Tomato concentrate made from red ripe tomatoes
(What else would you make it from?) :confused:

Distilled vinegar

High fructose corn syrup
(Luckily I don't eat this mess.)

Salt, spice, onion powder and natural flavoring

Tomatoes are classified as a fruit so the onion powder must be the ingredient that qualifies ketchup as a vegetable. :rolleyes:

Thanks, I had my mind on the onion powder and forgot about the corn syrup. I'm also well aware that corn is vegetable. I may not be brightest light in the chandelier but I'm certainly not the dimmest. :)

I don't even get started on the rejected titles board cuz I love stuff like that, but mine would be so censored most of the time. I think Janice is about the only one who I send stuff like that too ~ she "got" me at hello :lol: ;)

OMG....you are NOT going to believe this, people!

I watched a clip of a TV news program in Sacramento, CA. It said that the woman plaintiff is appealing the judge's decision. Her lawyer told the newscaster that the "case has merit" - "people need to know what's actually in the product". :crazy:
