Did you know that some states have laws regarding calling something rape?  :( For example, a state might say that if the woman did not say NO, she silently consented forced sex... Am I the only one who sees something extremely wrong with that? What if the woman is a mute? She can't say NO if she can't speak at all. What if she was was drugged on Roofies and didn't even know what was going on? She MUST have consented to sex she didn't even know was happening!

If the woman invited a man to her place, the state might say the rape was her own fault for being alone with him in the first place.... What if all she wanted to do was kiss and he forced himself on her? That's her fualt too.

If the woman was drunk, the law might say if she was sober, she would never have gotten raped and would have had enough sense to see he was a dangerous man............

All of these "faults" of the woman might let her attacker go free! And rape other women, while she herself is called a slut and loses her self-esteem. gray rape, please go to hell!  :(

I think what Janice is saying that these laws suck! (the ones that create "grey areas" that may let a rapist off the hook) And I agree with her.

These are the most idiotic laws I have ever heard of. What is happening to this country??? If a man forces his way on a woman and she dosent want it, its rape pure and simple. The way things are going now the only way to get any rights is to become a criminal, the victims dont seem to have any rights anymore.

I agree with you guys. Gray rape laws just punish the victim.

how do they know that the criminal just won't change the story around to fit those laws? Like if the woman says that she yelled for him to stop and the rapeist says that she encouraged him?

Please congress, there is no more room for stupid laws.

the defendant isn't always the one who lies. something that happens sometimes, is that a girl has consensual sex with her boyfriend, but then they break up or she gets mad at him or whatever, so she goes to the police and tells them that the sex they had was rape. sometimes a girl will say a guy raped her when they'd never been sexually involved at all. i'm no legal expert, but i know that rape can be a very tricky case to resolve in court due to this hearsay aspect. it's natural for people to lean towards the first side of a story they hear, but defendants in court are considered innocent until proven guilty for a reason.

gray rape isn't some legal form of rape, it's just a term applied to cases where it's UNCLEAR whether what someone did was rape until the case is thoroughly looked over. that's why court exists and the police don't just automatically sentence everyone who gets accused of committing a crime. nothing in life is black and white.

The rapist could easily say that SHE raped him and forced HIM to have sex with her.... Even though he's completely lying and people would say that HE is the victim, anmd she is a slut............

I think there is another example of "Gray rape." If she was wearing revealing clothes, the court could say that it's her fault for getting him aroused and horny............
