HOLLYWOOD - The photojournalist fighting Anna Nicole Smith over the paternity of her baby girl Dannielynn has sensationally revealed the actress/model miscarried their first child.

Larry Birkhead and his attorney Debra Opri appeared on CNN show Larry King Live on Friday night to update the ongoing paternity battle, which was delayed earlier in the week when Smith was granted the opportunity to fight demands for a DNA test on her baby.

Smith's partner Howard K. Stern also used the nightly news show to state he was the biological father last year. Birkhead refutes that claim and now reveals he and his ex-girlfriend had been planning to have a child for some time.

He told King, "It was a long-term plan that we have had together, you know, to have a child. And we tried once before... It was unsuccessful. It resulted in a miscarriage.

"So we talked again about having a child... and I had made plans and preparations for this child and went to the doctors appointments and...helped her through morning sickness and shopped for baby items.

"I felt like it was my responsibility after the first unsuccessful pregnancy to really monitor the situation and make sure that, you know, my child, at that point, was OK."

Birkhead went on to explain that Smith was so happy with her choice of father she constantly asked the photojournalist to marry her.

He added, "I think the first time was maybe one of the first nights that we spent at her home... It was just not right."

I feel very bad for Anna Nicole regarding the loss of her son. However, I think that Larry Birkhead has every right in the world to know if that baby is his daughter. I've felt from the beginning that he's the father, but who knows. She may not even know, but I think she does.

The fact that she's fighting the DNA test is very telling. If she's so positive that it's Howard's child, she'd do it just to make the story go away. I think she's turning it into a circus. Get the DNA test done and over with and end it.

People grant interviews all the time. Stern has appeared on shows himself talking about the baby, Anna and Danielle. The bottom line is this. Anna should not be fighting the DNA test. If Larry is the father, he has a right to know his daughter.

Stern granted interviews when Anna's son died. He had no idea that this loser was going to come along and start insinuating he is the father of her baby. It only makes sense for Stern to also respond to this matter since it began right after the death of Anna's son.

Anna has her rights to also deal with her son's grief and prolong a DNA test. Although it is an easy blood test, she still mourns for her son and I am sure the way this guy is going abt this doesn't make things easy for her, so why should she make it easy for him to get what he wants? Sure, in a less complicated matter, I can say "give in to the blood test", but she is someone who was dealt a blow right after giving birth. I hope and pray he isn't the baby's father.

Stern was on Larry King discussing the entire situation when Larry first came forward. Larry was trying to talk it out with Anna at first, but she ignored his calls. He did what anyone would do, he contacted a lawyer. Losing her son doesn't excuse her refusing to cooperate with the court order. It's a quick blood sample from her daughter. I don't see how that interferes with her grieving process.

If Larry is the father, he wants to have a relationship with his daughter, now. That's his legal right. Why should she make it hard for him? She's making it hard for herself and everyone by fighting the DNA test. Larry's not fighting anything. He's just wants his legal rights regarding the baby, if he has any.

He has every right to know if he is the father. Spilling details abt their relationship and a so-called miscarriage that may or may not have occurred is NO ONE'S BUSINESS. She lost a son and now we are being told she lost a baby? How much must she endure? He could have kept this under wraps and not talked to anyone. How does talking to the media get her to move any faster? The courts will move at the same pace whether he talks to the whoremedia or not.

Larry has just proven what a basket case he is. This sounds like a jilted lover who will say anything crazy just to make his case. He needs to mature and handle himself in a better manner. Me thinks he is just pissed because Anna dumped his sorry ass.

Larry went through the proper channels to get Anna to cooperate. She has ignored and fought him from the get go. Larry isn't the person who isn't cooperating.

Regarding Anna's intimate details, that's a joke. I've watched Anna on tv and read interviews for years where all she does is blab about her personal life, her sex life with the elderly husband, on and on. They couldn't shut her up about her lawsuit for that husband's estate.

I like Anna, always have, but we're talking about a woman who was always half stoned, totally nude and completely nuts. This isn't some sweet private person we're talking about. Nothing, and I mean nothing, has been off limits with her.

Anna's not blabbing now, I believe, because in her heart she knows that Larry's the father. That's what this story is about. Larry's legal right to have a relationship with that baby if he's the father. It's starts with a DNA test. Her son's death, interviews, etc....all of that has nothing to do with the core issue.

Anna Nicole Smith has launched a furious TV torrent of abuse on her estranged mother after learning she visited the grave of her late son in the Bahamas.

The actress/model flew into a rage when she saw photographs of Virgie Arthur kneeling at her son Daniel's grave and kissing the ground under which he's buried.

Smith refused to invite members of her estranged family to the funeral service last year and cannot believe her mother made the trip to see Daniel's final resting place.

In a taped TV interview, which will air on Monday, an angry Anna Nicole hisses, "I can't believe she had the nerve to come up here on my son's 21st birthday and lay her fat self on my son's grave."

Arthur enraged her daughter after Daniel's death last September by appearing on TV news shows insisting the 20-year-old was murdered and pouring scorn on Smith's plans to wed her attorney Howard K. Stern.

In one interview last November, Smith stated, "She (Arthur) hasn't seen my son since he was probably about five years old; she doesn't know him, she doesn't know me.

"For her to go out there and make these ridiculous statements about me killing my son or Howard killing my son--who does she think she is?

"When I saw her on CNN and I saw how evil she was and how evil she looked... bring it on, Mom, Mommie Dearest, bring it on."

Photographer Birkhead is fighting to prove he's the biological father of Smith's baby girl Dannielynn, but his public statements about his alleged romance and the ongoing war between the former friends has upset the actress/model--and she was perplexed when Birkhead recently sent her a box full of baby gifts.

She says, "He has sent me a box of baby clothes. Inside was a book that said 'My Family,' and in the back of it, it had a picture of me and him... It's kinda scary in a way."

Anna Nicole Smith and TrimSpa Inc. have been sued in a class-action lawsuit alleging their marketing of a weight-loss pill is false or misleading.

Janet Luna and three people identified as her guardians were named in a lawsuit filed Thursday in Los Angeles Superior Court. The lawsuit alleges deceptive business practices and a violation of California's unfair competition law.

They are asking for unspecified damages, restitution and an injunction preventing Smith and New Jersey-based TrimSpa, maker of TrimSpa X32, from making claims that users of the pills can lose substantial amounts of weight.

Smith, 39, has endorsed TrimSpa and is a spokeswoman.

Messages left after hours with Joseph Farzam, an attorney for the plaintiff, and Ron Rale, Smith's lawyer, weren't immediately returned.


Last month, the Federal Trade Commission announced TrimSpa would pay $1.5 million to settle allegations that the diet-products company's weight-loss claims were unsubstantiated.

TrimSpa released a statement following the announcement saying it supported actions to clean up the weight-loss industry, but disputed the federal agency's allegation that a handful of TrimSpa advertisements that ran in 2003 and 2004 had insufficient substantiation.

TrimSpa also disagreed with any inference that its X32 product has no scientific support.

This poor woman has more problems. I read somewhere that she's getting tossed from her home. Her son dying, the paternity suit, her ongoing legal battle for her late husband's estate. I wish she would allow the DNA test, and I honestly hope that it's not Larry's child. It would make it easier for everyone involved, including the baby.

Anna Nicole's New DNA Deadline

Anna Nicole Smith has been given a choice: She can either book a paternity test or a plane ticket.

Two weeks after hearing arguments as to why Smith shouldn't have to submit her daughter for a DNA test just yet, a Los Angeles judge ordered that the reality-TV star either have that test completed by Feb. 21 or else hightail it back to L.A. to explain the delay in person.

Larry Birkhead filed a paternity suit against Smith (who has denied having had a romantic relationship with the photograher, while he claims they had a two-and-a-half-year affair) in October, demanding that she have Dannielynn Hope, who was barely a month old at the time, tested to determine whether he or Smith's lawyer-turned-lover, Howard K. Stern, is the little girl's father.

According to Birkhead's attorney, Debra Opri, Los Angeles Superior Court Judge Ronald Schnider ruled Wednesday that Smith could have the test performed in the Bahamas or in Miami. If Smith fails to comply, Opri said, Schnider will want to see her in court.

There was no immediate comment from Smith's L.A.-based attorney, Ron Rale.

The judge stayed the previous Jan. 23 deadline after Smith's legal camp argued that, because the TrimSpa endorser had been living in the Bahamas since August, a Bahamian judge needed to sign off on Schnider's order.

Although, in light of this latest ruling, an end to this saga seems near, various twists and turns have been keeping both the L.A. and Bahaman legal systems busy.

A few weeks after suing Smith in Los Angeles, Birkhead transported some of his grievances to her new island residence, filing a civil action in the Bahamas charging Smith and Stern with fraud and conspiracy after Stern was listed as Dannielynn's father on the child's birth certificate.

Then, before Schnider was able to issue the test order, matters of jurisdiction had to be hammered out, with Smith's attorney insisting it was up to a Bahamian court. Meanwhile, Birkhead's side maintained that Dannielynn had been conceived in California, and that because the ex-Playmate had recently been living, working and engaging in a sexual relationship in the state, it was an L.A. affair.

Schnider agreed with Birkhead's team in November and settled in for what has turned out to be the long haul.

Then, last month, the Bahamian law firm that used to represent Smith—until she sold photos of her and Stern's commitment ceremony to People magazine before making funeral arrangements for her son Daniel, who died suddenly Sept. 10—filed suit against her, claiming she owes more than $113,000 in legal fees. A freeze was put on Smith's local bank accounts, preventing her total balances from falling below the amount of the unpaid tab.

And, as if Smith wasn't busy enough defending herself from attacks on her character, mothering skills and overall sense of morality, now her latest career move is under fire, as well.

Smith and TrimSpa Inc. were sued last week by three women claiming to be the victims of the diet-aid purveyor's dirty dealings. Per court documents, the plaintiffs charged that the makers of TrimSpa—and their spokesmodel—engaged in deceptive business practices by marketing the pills as a safe, effective and fast way to lose a substantial amount of weight. Which apparently didn't work out for them.

That was pretty inapproiate for someone's resent death. People come out and say things all the time. If anything, I'm more curious to why Howard K. Stern won't take a DNA test, where he was during Anna's death and why he hasn't been watching someone who was clearly unstable.

If you want to talk about no class during a very sad time for many people, then refer to your original post and think about what you said.

I lived it first hand, so I don't think anyone other than those of us who have been through that can say how hard it is to try and help someone who clearly doesn't want help or help someone who thinks they don't need help. Howard had been in Anna's life for over a decade. Larry was with her for what, a few weeks? I know if it weren't for Howard, Anna would probably have died sooner than this. Howard is not a fault here...he merely protected her. He has more class than any of those bastards who are now mocking her death, stating she slept around, saying totally inappropriate things AT ANY TIME. I will defend her because she is not alive to defend herself. LARRY BIRKHEAD IS A D*CKHEAD.

Larry Birkhead had a right to know if he is the father. HOWEVER, his methods for going on interview after interview after interview I don't agree with. Him spilling supposed facts that Anna had a miscarriage and other private matters are NOT PART OF THE COURT MATTER for which he is using to establish paternity. Of course he should know if he is the father, doesn't give him the right to splatter any info TRUE OR NOT abt a woman he supposedly loved and adored. Hell, if that is what men do to women they love, then don't bother loving them. Stay away from them. He should have respected her as the MOTHER OF HIS SUPPOSED CHILD. He will have had to deal with her for the next 18 years of the child's life, is that how he would have wanted to have things be? So be it that Anna did what she did to deny him a DNA test, let the courts handle it, not the media. Larry should have had MORE CLASS AND TELL THE MEDIA "NO COMMENT".

As for Howard K. Stern, if you have seen all the interviews (her last interviews) that Anna gave, you will clearly see/hear that she defended Howard. It's not for us to say whether he manipulated her or controlled her...only she and him know what happened behind closed doors. She defended Howard. She had him by her side continuously because she trusted "No one." Her words, not mine. One of her last interviews was shown last night and she expressed how she depended on Howard for EVERYTHING, as a man, as a friend, etc. If she had a female friend by her side rather than a man, this wouldn't be an issue.

As for him being there when two people died, that is so absurd. So every person who was around someone who died is a murder suspect? LMAO...

Two people, Anna and her son, had a history of taking medications and not properly...therefore, unfortunately they paid the price for it.

I still think Stern didn't help the situation, he added greatly to it. Larry Birkhead might not of handled everything with the best tact, but he certainly had every right to pursue this DNA test. Something that Anna and Howard mysteriously refused.

I would hate to think that Anna went through that drama and Larry is NOT the father. Anna and Howard were best friends. Best friends do things for each other that others wouldn't do. They may not be married "legally" but in their hearts they were. I just seen earlier another interview where Anna spoke with Greta Van Susteran and she went on abt how Howard is the only person she considered a friend and he became her best friend. Greta stated, "You hired him to be your lawyer and your best friend?" Anna stated, "No, I hired him as my lawyer and it turned into friendship. It then turned into BEST FRIENDS." She stated on another interview that Howard protects her because she ASKS HIM TO. I think it is beautiful that a relationship started out as friends and blossomed into something more, rather than a quickie romance.

She could've been easily trained to say that. I know plenty of people that are mentally controlled by people who proclaim LOVE and everything else and deep down feel trapped.

I am aware of that, but I think it is obvious that Anna felt insecure and lonely (something she did state in at least two interviews) and she had to be careful because people would "use her". She needed a friend she can trust. If she was being manipulated or controlled, I think this would have shown a lot sooner. I can't imagine what her life would be like without Howard. I am sure every vulture would have taken a piece of her mental being and she would have ended up dead sooner.

But think about it Irene, she did die early. She was only 39. Look at her life with Howard. She was a mess. She did drugs, she had affairs, she was in terrible shape. I don't want to rag on her, but my point is, just how good of a friend was Howard if she still did all these things?

A friend can only do so much. Imagine how really really bad it would have been for her. I mean, friends can beg, plead, yell, scream and talk til the cows come home but only the person who is taking drugs has to speak up and admit they have a problem. Once they can admit they have a problem, then they can seek help, then and only then can friends be there to assist. Mariah Carey is a good example of that. Her sister is a prostitute w/HIV and all of Mariah's money can't make her sister come off the streets and seek help. Her sister has to want to get better.

You know what rubs me the wrong way? Right now, Larry Birkhard's attorney is speaking for him on television, trying to get the case pushed and stuff for the baby..which all makes sense. Sure he tried to milk the case in the past...but he's for the most part keeping her affairs quiet at least now.

Well now, apparently on Entertainment Tonight, they're airing the "exclusive" interview with Stern and him being reunited with the baby. Anna's been dead for like 4 days and he already called up a tabloid for a story to be done on him for a whatever amount of money. Fine if he wants to do an interview done the road...but do we really need to see it at this particular time? I think he's trying to make himself look better - which theres nothing wrong with clearing your name - but do it in court and with respectibility.

Well, I can't blame Birkhead's attorney for looking for a DNA sample for the baby from Anna. Why not make sure that both DNA's match? I mean, a switch would be completely ludicrious but better safe than not doing it.

It's probably not as far-fetched as we think either. The stakes are very high. People do things like this for a lot less important matters. Drug testing, for example. I had to take one before I started a job years ago. I couldn't believe the procedure. I had to take my shoes off, and I was frisked.

The bathroom was locked and used only for drug testing. The nurse waited outside the bathroom while I "went". All this to make sure I didn't try to slip them someone else's clean urine sample.

There's no honor system when it comes to matters like this.
