In 1985, Sal Guardado began seeing Sally. Sally immediately fell in love with Sal and after a few weeks, they had moved in with Sally's aunty Lidia. A few weeks after they had moved in, Sal's behavoir began to change and he became more aggressive. At one stage, he shouted at Sally's sister for not letting him use the van that she borrrowed from a friend.

A few months later, Sally was dropped off home by a male friend, which made Sal jealous. They began to argue. Sally's aunty arrived home midway through the argument. Sal then asked Lidia to go and buy cigarettes. When she returned the house appeared to be empty, so she sat down and began to watch TV. As she was watching TV, the bedroom door slowly opened and Sal came out and began to strangle Lidia. He then began to hit Lidia over the head with a bowling ball. Lidia suffered a concussion and lacerations.

Lidia awoke 45 minutes later, feeling disorientated. She went into the bedroom and found Sally dead and covered up on the bed.

The family later found out that Sal had a criminal history.

Any news/updates on this story?

I think he's either in Miami or most likely Mexico..........and if he has indeed slipped south of the border and not reared his ugly head in this long.....part of me wonders whether he'll ever be caught

I caught this segment as well. This case really angered me because Sal was so irrational and Dr. Jekyll/Mr. Hyde, if you will. In a way, he reminds me of the pharmacy student who killed his girlfriend because she wouldn't pull strings to get him back into the pharmacy program he was enrolled in (another segment--Richard Bockledge, perhaps?) Anyway, I found the men similar because they both showed very irrational and selfish patterns of behavior. I doubt that Sal even believes he did anything wrong in this case. For the sake of the aunt and Sally's family, I do hope they catch this guy.

Yeah, that was awesome. I was glad to see that Andrew Luster was caught. It was even better after I learned that Dog, the Bounty Hunter was behind it.

The only crappy part of that whole thing is that Dog got in trouble for it, since bounty hunting is apparently illegal in Mexico.

Wow, so this guy is still out there then. Isn't he Mexican? I'll bet he's somewhere in a sparsely populated place that he can blend in like Mexico City or something.

Well I agree Guardado probably is in Mexico. Although knowing the state of our border he probably is commuting back and forth with little worry of being caught. Even if he was caught in Mexico, Mexico would refuse to extradite him until prosecutors promised not to seek the death penalty.

Under California sentencing guidelines in effect in 1985, Guardado could either get the death penalty or 25 years to life. Although the prosecutor's might try to plead him down to 2nd degree murder which carries a 15 year to life sentence. It would be hard but not impossible to prove that he pre meditated this vicious and senselsss murder. California sentencing laws have changed little since 1985 so they are basically the same except now there is LWOP and that wasnt added to the rule in California until the late 1980's.

I still can't believe they never caught this guy. He was a deadbeat without any money, and he was still able to flee the city? I was under the impression he couldn't scrap together bus fare.

He's got a few sets of charges against him....would the attack on Lidia be considered assault or attempted murder?

kadrmas15

Well, I believe he has a warrant out for his arrest for 1st degree murder as well as attempted murder and assault with a deadly weapon the latter two charges being for the attack on Lydia. Well, my guess is that Guardado went to Mexico, even if he could have got on an Amtrak train he could have got down to the San Diego area and then easily got to the border from there. My guess is after he killed Sally and knocked out Lydia that he rummaged through the house looking for money or anything that had any value so that he could pawn it off for money. He probably commutes back and forth between California and Mexico. It would not surprise me if he was living in the Bay Area to this day. He probably figures that because nearly 24 years has passed since the crime that the police are not looking for him anymore.

I doubt he could have made it to Mexico without getting caught because it said in the program that the police were hot in his trail especially since they had the FBI working with them so they would have had the airport, bus station and train station watched in case he tried to flee that way and probably alerted border patrol as well. My guess is that he fled on foot to some nearby friend's place to get help escaping as he had no way of moving fast. Plus, there was a reported sighting of him just months after he disappeared that he was back in SF at a fast food place so he probably is still in NorCal or somewhere in the Bay Area and being housed by gang members or deadbeat friends.

kadrmas15
04-03-2009, 08:40 PM
Well I tend to disagree. It is actually pretty easy to get into Mexico. I mean these days fugitives get into Mexico despite being wanted, back in 1985 I imagine it was even easier for fugitives to get into Mexico. If the sighting was true that Guardado was seen at a fast food restaurant in San Francisco a few months after the murder than all that means is he was in San Francisco. Where did he hide for months after the fact? If he had enough money he could easily get on a bus or an Amtrak Train and take it from San Francisco down to San Diego and easily cross into Mexico. I believe the bulletin also said Guardado had ties to south Florida and Puerto Rico. Honestly Guardado could be anywhere, he could be in San Fran living right under the police's noses it is possible. I mean it is really a crapshoot to determine where Guardado is. It would not surprise me either if he has killed since this time. I mean before the 1985 murder of Sally Garrity and the attempted murder of her aunt, he had served 5 years of a 10 year sentence for the attempted murder of another girlfriend.

I have thought of trying to get this case profiled on AMW. I might be pro defense, but this guy, Sal Guardado, if still alive, has no business being out on the streets. It is kind of like with Richard Baer and various others. Baer, I think Baer is still alive, they have come close to getting him over the years but he has always been able to narrowly avoid capture. The same would be true with Guardado. I bet he would be found if he was profiled because he is probably living right out in the open because he thinks after 25 years no one is looking for him anymore.

kadrmas15
02-20-2010, 07:51 AM
But even if Guardado was arrested, I doubt he would face the death penalty. Looking at the case, none of the special circumstances would fit. So, my guess, Guardado would face a maximum of 25 to life for first degree murder of Sally, plus whatever sentences are appropriate for the other charges.

I have thought of trying to get this case profiled on AMW.

Kadrmas15, Don't think of doing it. DO IT! In fact, I highly recommend that you contact America's Most Wanted and ask them to profile Sal Guardado. The AMW web site instructs that you must write to them in order to have a case considered for the show.

Make sure you include the relavent details on the case such as: the name of the fugitive; the name of the murder victim; the date of the murder (in this case, it was in 1985); and the city/town state the crime took place.

Of course, it should be noted that since AMW gets a lot of mail, there's no guarantee that your story idea(s) will eventually be accepted. But you'll never know for sure, unless you write to them. (Better to try and fail than never to try at all.)

Yes Kane, I will write a letter to AMW and get it sent out tomorrow or Wednesday. I might be pro defense but Guardado, this guy has been running around way too long and if he is alive, he needs to be held accountable for what he did. I mean, he is clearly a very violent individual and I have a hard time believing he has stayed out of prison the entire time he has been on the run.

But yes the details, I will have to watch the UM segment to remember all of them. He murdered Sally Garrity and if I remember right, this is occurred on May 13th, 1985 in San Francisco, California? What is weird is the SFPD seems to have given up on finding this guy. However if AMW were to profile him, it might flush him out of hiding.

AMW has profiled a few other cases profiled on UM over the years, Richard Baer who was arrested for murder but escaped from the county jail in North Carolina in 1985 and has been on the run ever since, although many believe he is still alive and in fact it was even rumored, I guess callers to AMW had said that he is still hiding in rural North Carolina and in fact has lived at times as a woman to conceal his identity.

Also, William Jordan, the guy who along with Anthony Prevatte, murdered that guy in 1973 in Georgia. Jordan, another one, sentence to life in prison but yet allowed to work at a minimum security 'honor' prison that at that time had only a short fence, like the height of a fence in your back yard. Gee, no wonder Jordan went on the run in 1984 and has yet to be recaptured. Unlike Baer who has come close to being caught over the years, Jordan has been seen periodically but has kept a much lower profile. Did you also know that William Jordan and John Mooney escaped from the same prison?

He would be lucky to have not spent even one day in jail during his time on the run. It's not impossible for him to have been arrested and in jail for an unrelated crime under an alias. And yes, if he is Sally's killer, then he needs to be held accountable. Thankfully, there is no statute of limitations on murder. And I don't like to see even one murderer escape justice.

But yes the details, I will have to watch the UM segment to remember all of them. He murdered Sally Garrity and if I remember right, this is occurred on May 13th, 1985 in San Francisco, California? It might have been later in May, but I'm not sure. However, I am sure the murder occurred in May of 1985.

If you have mailed a letter to Americal's Most Wanted, as you said you would, then you made a wise decision. In fact, to set a good example, I mailed a letter to AMW this morning, asking them to do a segment on the Original Night Stalker (which UM profiled in 2002).

Did you also know that William Jordan and John Mooney escaped from the same prison?

It's been a long time since I've seen those segments. But I knew they both escaped from a Georgia prison. I just didn't remember where in Georgia.

kadrmas15
03-15-2010, 06:35 PM
Yes, William Jordan and John Mooney both escaped from Wayne State Prison in Odum, Georgia. That is Wayne County, Georgia which is in the southeastern part of the state, very rural there, almost a no man's land, but there is basically nothing around that prison. That county only has about 25,000 residents, 9,000 of whom live in Jesup which is the county seat and the largest city in the county. Odum, the town where the prison is near, is a small town of about 400 people. There is basically nothing around Odum, it is about 15 miles to even get to Jesup and there are no towns closer to Odum than Jesup. So for someone to get out of that area, they would need someone to pick them up as the general public even back then was discouraged from picking up hitchhikers due to the possibility of them being a prison escapee. Odum is about 70 miles north of the border with Florida and about 50 miles southwest of Savannah.

John Mooney escaped from Wayne State Prison in 1980, William Jordan escaped from that same prison in 1984. Mooney escaped by smuggling himself out, but Jordan, despite being a lifer was working outside the prison fence and there were times where he was spending hours either completely unsupervised or at least he was not under direct supervision. One day, Jordan simply drove the maintenance truck and drove away. Wayne State Prison opened in the late 1960's and had basically not been renovated at all since that time. Security was eventually tightened up somewhat, as in higher fences with chain link at the top and rules were changed eventually so that lifers were not allowed to work outside the prison fence unless under direct supervision as in armed guard. Wayne State Prison was closed by the Georgia Department of Corrections in October of 2008.

It took me a little longer than I had planned to send the letter off to AMW mostly because I wanted to make sure I had as many facts as possible about the case. I mean to me, if Guardado is still alive, it would not surprise me if he was living out in the open somewhere. I think so much time has gone by that he does not think he is wanted anymore or that the police are no longer looking for him.

Guardado did have charges filed against him back in 1985 that remain on the books today, he just has not been caught. Back then he was charged with first degree murder, attempted first degree murder and assault with a deadly weapon. Now because the charges filed in 1985 remain on the books, if Guardado was caught he would face the charges under 1985 laws. This occurred in San Francisco County, so even though California has the death penalty, it has been almost 20 years since a person has been sentenced to death in San Francisco County. Last time was in 1991.

Looking at Guardado's case, the 'special circumstances' that if found to be true would make the case death penalty eligible and Guardado would either get death or LWOP but no special circumstances were filed in this case. Thus if convicted of first degree murder, Guardado would get 25 years to life with another year tacked on for the weapon enhancement as Guardado strangled Sally with I believe a telephone cord although it was speculated that he might have strangled her with a dog leash. At that time, for attempted first degree murder, the maximum sentence in California was 12 years whereas now you can get up to 25 years to life for attempted first degree murder. Assault with a deadly weapon, would get him a few years.

It is also unclear whether these convictions would count as strikes? Guardado did have a lengthy criminal background but it is not clear if crimes that occurred before the three strikes law went into effect would count as strikes afterwards? Guardado I believe had at least two violent felonies on his record. I am not sure if arson would be a strike crime but he had previously been convicted of attempted murder, so that would be one strike right there. In fact he had been sentenced to 10 years in prison for attempted murder and arson, he was released after serving 5 years.

My guess, if Guardado were caught, he would probably plead out. I mean this case has drug on a long time, so they would probably offer him a plea bargain to 2nd degree murder for a fifteen year to life sentence in exchange for the dropping of the other charges. But because the case has drug on for a long time, it presents a problem in terms of witnesses disappearing, moving, dying, memories fading. But yeah, I would say, Guardado would probably plead out if he was caught.

What disturbs me though is that the San Francisco Police Department seems to have basically given up on looking for this guy. Looking at their fugitive list, they basically do not seem to have anyone on there from before 2001. So I think the SFPD needs to get on the ball. I have even thought of trying to contact the SFPD and see if they are even still investigating this case?

I actually have had prior contact with the new SFPD Police Chief George Gascon. I like Gascon although I disagree with his passive approach approach on illegal aliens. But other than that he is a good chief. He turned the Mesa, Arizona Police Department around in the 3 years he was Chief there before leaving for San Francisco last summer when he was appointed Mayor Gavin Newsom. The SFPD also has a lengthy history of trouble so hopefully Gascon can turn that Department around? Anyway, I can try reaching out to Chief Gascon and see if I can have him look into it. A long shot but worth a try. I wrote him while he was Chief of Police in Mesa and he sent me a personal lengthy response to my questions and an autographed photo.

Kane, good for you on writing a letter to AMW on the original night stalker. I like that AMW focuses on current cases but I feel sometimes they need to focus on the old cases too. The original night stalker, that is a guy that I think if he is still alive that he is still free. They have his DNA but no one, at least not in the California Department of Corrections whose DNA has been tested, none of them matched the samples, that includes everyone on California's death row. But I think if AMW aired it, they might get that break they need, it certainly can't hurt.

Looking at that case, it has always fascinated me. It has also fascinated me how so many of these law enforcement agencies bungled the case. I mean in Sacramento County, holding a town hall meeting? I mean I get why they did that but that said, all that did was further build up this guy's already massive ego. I do believe he was in the audience that night, I mean that is actually fairly common for a killer like that to place himself in a situation where he would be seen but that no one would know he was the killer. But the guy who was going off about how he did not believe that these women could be raped when there was a man with them in the house and then he and his wife about a month later become victims? I just think that is more than coincidence. I think the EAR was in the audience and followed that couple home and stalked them over the coming weeks until it was time to make his move.

Or in Ventura County, California where they busted the wrong guy, although I will admit, he on the surface did look very right for the crime and he was actually charged and spent 4 months in jail. In fact, the charges were only dropped after it was revealed his blood type did not match as at that time all they could really do is test blood types. But I still remember reading too about how the EAR once escaped from a Sacramento county Sheriff's Deputy on a bicycle? That was the closest he ever came to being caught and that was in 1977.

It seems that is a common MO for this guy is riding to and escaping from the scene on a bicycle. So that tells me he does not live all that far from the places where he was committing these crimes. A killer like this tends to commit crimes in areas that they feel comfortable with and are usually within only a few miles of their home.

There was speculation that the EAR was in the U.S. Air Force during the mid to late 70's. This does coincide with the rapes in Contra Costa County as Travis Air Force base is in nearby Solano County. The base itself is about 20, 25 miles north of Contra Costa County. The base is about 30 miles or so southwest of Sacramento. Now granted the killer surely had a car but I think he parked the car at an alternate location and rode a bicycle to the scenes of his crimes as it would be easier for him to get in and get out undetected.

The Air Force theory also plays true in that when the killer shifted his focus to Santa Barbara and Ventura Counties, there is an air force base, Vandenberg Air Force Base which is not far from there. Vandenberg Air Force Base is about 250 miles south of Travis Air Force base. Now Vandenberg AFB is about 80 miles north of Ventura. Goleta, California which is a suburb of Santa Barbara where the Santa Barbara County attacks occurred is much closer to Vandenberg AFB. Goleta is about 25, 30 miles south of Vandenberg AFB.

Now when he moved to southern California, as in Orange County, if he was still in the Air Force this would also make sense in terms of the possible Air Force connection. Los Angeles Air Force Base in El Segundo, California is just a stones throw south of Los Angeles International Airport. El Segundo is about 35 miles away from Irvine where two of the Orange County murders occurred. El Segundo is about 45 miles from Laguna Niguel where the murder of the couple occurred.

Now in relation to other Air Force bases, there was an Air Force Station in Cambria, California that was about 50, 55 miles north of Vandenberg Air Force Base, Cambria Air Force Station was in San Luis Obispo County and it closed in 1979. It is also possible he was assigned to Mather Air Force Base, Mather Air Force Base was only 12 miles east of the Sacramento suburb of Rancho Cordova where many of the EAR's attacks occurred, including his first attacks. Mather Air Force Base was closed in 1993. McClellan Air Force Base is another possible one, McClellan Air Force Base was located just 7 miles northeast of Sacramento. McClellan Air Force Base was closed in 2001. In terms of his attacks in the OC it is also possible he was assigned to Norton Air Force Base in San Bernardino, California about 40 miles north of Irvine and Laguna Niguel. Norton AFB closed in 1994.

Thanks, Kadrmas15. :)

Although America's Most Wanted has profiled a good number of old cases (including the Zodiac Killer and the Grim Sleeper, who first struck in the '80s), I agree they profile current cases more commonly than the old ones. But I can't fault them for that. Obviously, many current cases are among the more urgent ones, especially when it's a fugitive who is on the run with a child who may not be necessarily with him/her voluntarily.

I felt that it couldn't hurt to recommend doing a feature on the Original Night Stalker. The worst that could happen is they decline the offer. Since the show gets large volumes of mail, it is impossible for them to accommodate every story suggestion. But if enough people write to AMW suggesting they featurer the Original Night Stalker case, maybe they will eventually do a story on it. But if for whatever reason they don't cover the case, then at least we tried.

It is entirely possible that an AMW viewer has information that could lead to an arrest in the Original Night Stalker case - and doesn't even know it yet!

Kadrmas15, in a follow-up to a previous post, the date of Sally's murder was May 23, 1985. Therefore, you were only ten days off when you thought it was May 13. But you were actually correct when you thought the date in May had the number 3 in it. ;)

One of the investigators involved the case was Insp. Jeff Brosch of the San Francisco Police Department (as I learned from the UM segment). I don't know if he is still currently with the department, but I thought I'd mention that.

In fact, if you were to submit a story suggestion to America's Most Wanted, I would recommend mentioning names of anyone involved in the investigation of the case in question. That kind of information should be helpful. You don't have to acquire every name, but if you are able to find only one or two names, then that should be good enough. Even if you're not sure of their current status (i.e., still with the police department, retired, living, deceased, etc.), mention their names anyway.

kadrmas15

Hey Kane, Jeff Brosch retired from the SFPD back in the late 1990's. He did move over to the Alameda County District Attorney's Office in Oakland where I imagine he was kept busy an investigator for them on homicide cases. I have been trying to determine if he still works for Alameda County? His wife died in 2006.

I wouldn't be shocked if he felt/feels justified after having murdered Sally, as well as having attacked Sally's aunt some time afterward. From his jealousy to his belligerence, he's/he was a twisted individual and only an idiot finds it difficult to realize why one has grown disgusted with you (especially after you've displayed how ignorant you truly are), and basically wants nothing more to do with you and rightfully so.

For me alarm bells started ringing when I read the description of him having a part time job and then taking out a loan for the engagement ring ! How was he going to pay it back ? Starting a marriage on debt ?

I also feel they moved in together way to soon ...... I am not blaming the victim but I felt she should have taken things slowly - its just that men and women get into such situations when they reach that dodgy age were they feel they need to start settling down and this pressure from themselves to find "the one" or the person of their dreams leads them fall in love too quickly and fail to see the red flags displayed by their lovers - this is an all too familiar scenario and I bet there loads of people in all 50 states in similar relationships - its unfortunate in this case it lead to murder.

I doubt this guy is a major priority for investigators which is why we havent seen an age enhanced image of what he might look like. I also supsect his friends helped him hide or escape ........

watching episodes like this is also an educational experience in the sense that it helps the viewer learn that when getting into relationships they should be aware of red flags that their suitor may show and they should never ignore them in the name of love ........its unfortunate what happeneed to Sally , its also amazing how this guy has managed to to be elusive all this time. ...

I also think were ever this guy is or went to he has been involved in domestic violence of some sort over his irrational jealousy and it is quite likely some other woman has been a victim of this perp......

In Murderers Among Us and in a news article I read once on Newsbank a long time ago, Sally's sister Sherri recounted visiting a Burger King somewhere in the Bay area some months after Sally's murder and seeing someone she was certain was Guardado when she stepped outside. I think it could've been him. The way I figure it, at the time Sal didn't have much money nor his own means of transportation to really haul it out of there in a timely manner.

Just out of curiosity did she try to approach him or was he gone rather quickly? I agree that considering how little money he had and no way of transport he was probably in California, the bay area specifically, for a while.

IIRC, she said she was so sure it was Sal standing outside the restaurant, she was too frightened to approach or otherwise react to him, so she left immediately and called the police. Obviously, whomever was there that day wasn't by the time LE arrived.

I take that back--it was actually a Popeye's, not a Burger King, that Sheri saw Sal at.

Wow, that's pretty eerie, Meg.

I'm somewhat surprised he hasn't been caught, but then again, he probably went to Mexico.

I read Murderers Among Us and was shocked to discover that Sally had a child. I think UM did not mention it because her sister (interviewed in the segment) raised her child instead. I think this somewhat explains why Sally was so captivated by Sal. She thought she met a responsible man who would stick around and be loyal (pretty sure the father of her child did not stick around, if I recall correctly, and she'd had trouble finding the man of her dreams). It may still be hard to imagine her falling for him so hard within a week or so, but that sheds some light on her background.

I thought so too. I screamed at the tv last week when I watched this segment. It's crazy that some people got caught before the show aired, based on a promo, and then you have people like this who are never seen again.

The one with the needle.

Seriously, though.

It's from the Marie Hilley segment, which was part of the "Diabolical Minds" episode of Unsolved Mysteries. Marie Hilley was a woman who poisoned two husbands to death and almost killed her daughter by poisoning them with arsenic. She wanted to collect insurance money in all cases.

She was caught and brought to justice before escaping and dying of hypothermia. You can find a more in-depth page on her on Wikipedia.

No. She escaped from custody and was outside in the elements for about four days. She died of a heart attack that was likely brought on due to hypothermia.
