Aurora Police Say Proper Procedures Followed At Chuck E. Cheese

AURORA, Colo. -- Aurora police have reviewed a weekend incident in which a man accused of stealing salad from a Chuck E. Cheese salad bar was hit with a stun gun twice by officers and said that proper procedures were followed.
The incident began at 4:05 p.m. Sunday when officers were called to the restaurant at 145005 East Exposition on a report of a larceny in progress.
Police talked to the Chuck E. Cheese manager who told them that a customer had refused to show proof that he had paid for food. The manager said the man was seen "loading" his plate at the salad bar.
The officers confronted Danon Gale, 29, who was at the restaurant with his children, aged 3 and 7. Patrons said the popular kids pizza parlor was packed with children and families at the time.
According to police, Gale was asked to step outside to discuss the incident.
"According to witnesses (Gale) refused to cooperate with police and a struggle ensued," said Larry Martinez, a police spokesman. He said that Gale became argumentative and shoved one of the officers, a fact disputed by another patron.
"One of the officers kept poking the gentleman in the chest," Felicia Mayo told the Rocky Mountain News.
She was there with her 7-year-old son. She told the newspaper that Gale told the officer, "You don't have to do that." She said Gale never put his hands on the officer who was confronting him.
The argument escalated until Gale was shoved into the lap of Mayo's sister, who was sitting two booths away, holding a 10-month-old baby. That's when police pulled out a Taser stun gun to subdue him.
"They beat this man in front of all these kids then Tased him in my sister's lap," Mayo told the newspaper. "They had no regard for the effect this would have on the kids. This is Chuck E. Cheese, you know."
Gale's two children were "screaming and hollering and crying" as Gale was tasered two times with the stun gun.
Police arrested Gale as his children and other customers and their children watched. They took him outside, leaving his children inside the restaurant.
Gale was arrested for investigation of disorderly conduct, resisting arrest and trespassing.
His two children were picked up by a relative.
The manager of the restaurant declined comment and Gale said he couldn't talk about it, after hiring an attorney.
An Aurora Police spokesman said that the sergeant on the scene wrote a report on the incident and forwarded it to his commander who determined that proper police procedures were followed relating to the use of the Taser.

Don't judge the police officers just yet-we don't know the whole story. One angry witness does not make a complete story.

The photo booth incident that resulted in a woman and her baby being beaten by teenagers happened the same week as this incident with the man fighting the police over a salad bar. However I think it was separate Chuck E. Cheese's in separate states.

Well, the balls that you jump in were no longer there, which is such a blessing because if I had seen them I might have gotten sick due to the fact that some kid threw up on me in those back in 1986. Anyway I decided that I would stir up a little excitement due to all of the drama that has been going on in Chuck E. Cheese in the nation the last couple weeks. I went in with a microphone and proceeded to tell my story from 1986 and tell the customers about what has been going on the past few weeks. Well the employees did nothing but they looked like they wanted to throw me out because I kept preaching negativity about Chuck E. Cheese, eventually the manager told me to leave, so I respected him and left. But I also convinced a lot of the locals to abandon Chuck E. Cheese and I think I convinced them.

The man who was subdued with a Taser stun gun at an Aurora Chuck E. Cheese's restaurant in February has filed a notice of intent to pursue a lawsuit against the city, the police department and the officers involved.
Danon Gale, 29, is seeking $500,000 damages stemming from the Feb. 27 incident in which he is accused of becoming belligerent after he couldn't prove he had paid for food from the salad bar.
When police responded to a call from restaurant employees, they asked Gale to step outside, but he allegedly pushed one of the two officers. The two officers tried to put Gale in a wrist hold, but he allegedly began to struggle with them so they used the Taser on him twice, reports said.
Aurora City Attorney Charlie Richardson couldn't comment specifically about the notice but said the incident is under internal investigation.

officer-that is assault on a police officer-and then began struggling with them, so they used
a less-lethal means of subduing him(the taser). They very well could have shot and killed
him and then you all certainly would have been all over the officers for that, am I right?

Danon Gale Pleads Not Guilty

AURORA, Colo. -- A man Tasered at a Chuck. E. Cheese restaurant after allegedly stealing from a salad bar is facing more charges stemming from the incident.
Danon Gale, 29, was arraigned Wednesday on charges of disturbing the peace, disobeying a lawful order, obstruction of police and resisting arrest.
He pleaded not guilty to the charges and his trial was set for Aug. 16.
Prosecutors say witness interviews produced more information about the dispute.
The manager of a Chuck. E. Cheese restaurant called police Feb. 27, claiming Gale hadn't paid for access to the salad bar from which he was eating.
Officers say Gale became confrontational and started a struggle.
But some witnesses accuse police of provoking Gale, and using unnecessary force.
Why can't Gale just admit that he was wrong?
