(CBS) LOS ANGELES A Los Angeles judge has ordered Britney Spears to turn over her two children to former husband Kevin Federline this week until further court order.

L.A. County Superior Court Judge Scott Gordon Monday issued an order stating that Kevin Federline, the boys' father, "is to retain physical custody of the minor children on Wednesday, October 3, 2007 at 12:00 p.m. until further order of the court."

Spears, 25, and Federline, 29, are the parents of Sean Preston, 2, and Jayden James, 1.

Spears was charged last month with misdemeanor counts of hit and run and driving without a valid license in connection with a parking lot crash in August.

Spears has never had a California license for all the years she's lived in L.A., TMZ.com reported.

She also checked in and out of three addiction treatment centers earlier this year and shaved off her hair in February. About that time, Federline asked for an emergency hearing regarding custody of the boys, but later canceled it.

The couple wed Oct. 6, 2004. The marriage was Spears' second, coming eight months after she ended a 55-hour Las Vegas union to a childhood friend.

The singer, known for such hits as "Oops ... I Did It Again" and "Toxic," first found fame as a member of "The New Mickey Mouse Club" in the 1990s.

She recently performed at the MTV Video Music Awards in what was billed as a comeback appearance that was widely panned.

Federline, once a backup dancer for Spears, is guest starring on CW's "One Tree Hill." He has two other children with actress Shar Jackson.

She has NEVER had a drivers' license since living here in CA???? So, those times she drove around with her child in her lap, the time she had her child in the backseat and wasn't properly restrained, where there is clear and convincing proof she was DRIVING, and children's social services were called out to her home, no one ever decided to check her ability to drive? No one ever checked to see her driver's license? What am I missing here?

LOS ANGELES (Reuters) - Britney Spears' troubled personal life upstaged her bid for a career comeback on Monday as a judge ordered the pop star's ex-husband to take sole custody of their two children later this week.

No reason for the decision was contained in the court order that was made public. Representatives for Spears and her former spouse, Kevin Federline, a dancer and aspiring rap performer, were not immediately available for comment.

The same judge, Los Angeles Superior Court Commissioner Scott Gordon, ordered Spears two weeks ago to undergo random drug testing and to hire a parenting coach after finding evidence of "habitual, frequent and continuous use of controlled substances and alcohol" by her.

His latest order stated that Federline "is to retain physical custody of the minor children on Wednesday ... at 12 p.m., until further order of the court." Gordon also set another hearing in the matter for Wednesday.

The ruling came as Spears, whose recording career had been on hold since she married Federline three years ago, was returning to the pop charts with her new single "Gimme More."

Spears, 25, and Federline, 29, divorced in July but have remained embroiled in a bitter battle over custody of their two sons, Sean Preston, 2, and Jayden James, 1.

Before this week, they had shared 50/50 custody of the boys, but Federline's lawyer, Mark Kaplan, told reporters in August that his client was seeking greater control of his sons to keep them "isolated from risks."

Adding to Spears' legal woes, the singer was charged on September 21 with leaving the scene of an accident after police said she ran into a parked car last month. She also was charged with driving without a valid license. Published photos and TV footage taken in recent days have shown Spears driving with her two sons in her car.

Since filing for divorce last November, Spears has made headlines with a steady stream of erratic behavior -- shaving her head before entering rehab, firing various staff and stripping down to her underwear for an impromptu ocean swim in front of photographers, among other incidents.

Earlier this month, her highly anticipated comeback appearance at the MTV Video Music Awards was widely panned as an embarrassing flop, though "Gimme More" has been climbing the radio charts.

Since Thursday, the song, a single from her upcoming untitled album, has ranked as the most downloaded track on Apple Computer's iTunes online music store.

The song appears poised to break onto Billboard magazine's Hot 100 singles chart later this week with what could be Spears' highest ranking since her debut 1999 hit "... Baby One More Time."

Hopefully this will turn her around. She needs to take a good look at herself once and for all, cut off the bad influence around her and party less. It's okay to party but she needs to realize she is now a mother of two little kids and her party hard days should be over.

I seriously doubt she will try to kill herself though... okay maybe I do a little.

It's an unfortunate situation, particulary for her children. I hope Britney gets the help she needs, and turns her life around. Children need their mother, but she's not much good for anyone until she straightens herself out. I'm rooting for her. I'd love to see her get back on track, professionally, but more important, personally.

I have never really cared much for Britney's music, but I do think it's time the media lays off her. Yes, she is a trainwreck and people are interested, but it's her life we're dealing with. Sharon Osbourne said yesterday on the Ellen DeGeneres show, and I agree with her, that Brit is just getting around to living the teen years that she didn't get to enjoy at the time because she was too busy recording, touring, making videos, etc.. I agree totally that her priorities are out of wack but I think it's better to try and wish her to get the help she needs because she has two little ones who heed her to get better. Do we really want Anna Nicole to happen again?

the part I find disgusting is that since Anna Nicole happened (I do believe media played a big part in her demise, she needed time away to grieve for her son as well as time to take care of her new baby but the media just kept picking at her and then she dies and the media wonders what went wrong), the media has been pimping Britney, Lindsay and Paris up even worse hoping one of them is going to fall. I am not a fan of any of those three but I do think the media can stand to lay off them a bit during times of crisis instead of constantly picking at them until they die.
