LOS ANGELES (Reuters) -- The 20-year-old son of Anna Nicole Smith died suddenly in the Bahamas on Sunday, three days after the former Playboy Playmate gave birth to a girl, Smith's attorney said.

A statement from Howard K. Stern, Anna Nicole Smith's attorney, did not provide any details of Daniel Smith's death, and he declined to comment when contacted by Reuters.

"We have yet to learn the cause of death but do not believe that drugs or alcohol were a factor," Stern said in the statement. "Anna Nicole is absolutely devastated by the loss of her son. He was her pride and joy and an amazing human being."

Daniel Smith was in the Caribbean nation where his mother, 38, gave birth to a healthy girl on Thursday, Stern said.

He appeared in "The Anna Nicole Show," a reality TV series that aired on the E! cable channel.

Since being named Playboy's Playmate of the Year in 1993, the former Vicki Lynn Hogan from Mexia, Texas, has never been far from the public spotlight. In 1994, she married wheelchair-bound oil tycoon J. Marshall Howard, 89, after meeting him at a strip club.

His death, after 14 months of marriage, triggered a legal battle over his estate between Smith and his son, E. Pierce Marshall. Earlier this year, she won a U.S. Supreme Court decision giving her another chance to collect millions of dollars. Pierce Marshall died in June.

Smith has not said who fathered her second child.

I can't help but to think alcohol or drugs were involved somehow. I always felt so sorry for him when I'd see him on her show.

And this is the first I've heard that she was even pregnant again, let alone gave birth? Let's see, trying to think of really, old billionaires currently taking mass doses of Viagara that could have stepped up to the plate here......

- While members of the press were rushed into the conference room, hospital staff hustled the baby out into a waiting van, while Anna Nicole Smith's lawyer, Howard K Stern, rushed to the hospital parking lot at the same time.

- The new mother was never seen, as she was reportedly whisked out of a backdoor exit. Photos of the baby wrapped in a pink and white blanket could not be taken, as all cameramen were diverted into the hospital conference room.

- Daniel's lifeless body was then taken away in a hearse through a side exit.

That is horrible news. As one of Anna Nicole's biggest supporters, I certainly feel for her right now and pray that she and the rest of her family is able to get through this. I especially feel bad for the daughter who will never get to meet her brother...

Earlier, Her Majesty’s Coroner Linda P. Virgill said at least one other person was in the hospital room when Daniel Wayne Smith died. She refused to elaborate.

Virgill scheduled the inquest for the week of Oct. 23, saying it “is the right course of action.” If jurors at the inquest decide a crime took place, the case would be sent to the attorney general’s office, authorities said.

I'm reading a lot of speculation that her lawyer/advisor was the third person in the room. A man named Howard K. Stern (not that Stern). I'm wondering if her son died from drugs and the authorities will go after the person who supplied them.

From all the news reports it seems like they're trying to place blame on him. Whatever it is, I hope for Anna's sake that it wasn't drug related. That would probably be even harder to cope with. Its a really sad situation.

Lawyer Says Smith Tried to Revive Son


NASSAU, Bahamas (AP) - Anna Nicole Smith frantically tried to revive her stricken son and had to be sedated after he died, her attorney said Wednesday. Authorities termed the death "suspicious" and said criminal charges could be filed.

Daniel Smith died Sunday while visiting his mother, a reality TV star and former Playboy playmate, in her hospital room three days after she gave birth to a baby girl.

"The devastation and grief over Daniel's sudden death coupled with the sedation has been so extreme that Anna Nicole experienced memory loss of the event," attorney Michael Scott said.

The chief inspector of the Bahamas coroner's office on Wednesday called the death of the 20-year-old Smith "suspicious" and a formal inquiry that could lead to criminal charges was scheduled for next month.

Police also revealed that a third person was in the hospital room at the time of the death.

But Scott said that the third person was another one of Anna Nicole Smith's attorneys, Howard K. Stern.

He said Anna Nicole Smith and Stern continued efforts to revive Smith even after he had been proclaimed dead by staff at Doctors Hospital in Nassau.

"Anna Nicole was so distraught at the loss of Daniel that she refused to leave his side and it was necessary to sedate her in order to check her out of the hospital," Scott read from a prepared statement.

He said she suffered memory loss and that it "was necessary for Howard to tell Anna again that Daniel had passed away," he added.

Authorities said they believe they know what killed Smith but were waiting for a toxicology report to confirm the findings.

Anna Nicole Smith, who went to the U.S. Supreme Court this year to sue for an inheritance, was in seclusion in the Bahamas with family and friends, Scott said. The identity of the newborn girl's father has not been publicly disclosed.

"You would expect any parent who sustained this kind of loss" to seek seclusion, Scott said.

A jury inquest, which will be open to the public, is scheduled to start Oct. 23, and Anna Nicole Smith will be required to attend, coroner Linda P. Virgill said.

"Whenever there is a suspicious death we would have an inquest to determine how the person died," Bradley Neely, chief inspector of the coroner's office, told Associated Press Television News.

The autopsy and toxicology reports will not be made public until the inquest is held, to avoid prejudicing the jury, Virgill said.

Jurors will meet in a courtroom inside a weathered, pink-pastel judicial building in the seaside capital, Nassau. If the inquest, which will be open to the public, determines a crime was committed, the case would be sent to the attorney general's office.

Virgill said there was no sign of physical injury to Smith, who was seen helping make his 38-year-old mother comfortable before he died. Anna Nicole Smith noticed him slumped in a chair Sunday morning and called for help. Hospital staff unsuccessfully tried CPR and other measures to revive him.

Scott dismissed media reports that Anna Nicole Smith's son had antidepressants or other drugs in his system.

"It's sheer speculation. It's irresponsible speculation, may I point out," he told reporters.

Ferguson, the assistant police commissioner, told the AP that no drug paraphernalia or traces of illegal drugs were found on Daniel Smith, in the hospital room or near the room.

Police believe Daniel Smith went directly to Doctors Hospital in Nassau after arriving in the Bahamas by plane, Ferguson said.

Daniel Smith was the son of Anna Nicole and Bill Smith, who married in 1985 and divorced two years later. The son had small roles in her movies "Skyscraper" and "To the Limit." He also appeared on the E! reality series "The Anna Nicole Show."

Anna Nicole Smith married Texas oil tycoon J. Howard Marshall II in 1994, when she was 26 and he was 89. He died the following year.

She then feuded with Marshall's son, Pierce Marshall, over her entitlement to the tycoon's estate before he died in June at age 67. Smith won a $474 million judgment, which was cut to about $89 million, and eventually reduced to zero. In May, the U.S. Supreme Court ruled that Smith could continue to pursue her claim in federal courts in California, despite a Texas state court ruling that Marshall's youngest son was the sole heir.

Latest report today is that anti-depressants WERE found in his system (2nd autopsy). Sounded like he had been on them for about 6 weeks. Still waiting for remaining toxicology reports. Could be he took or drank something else and had a bad reaction.

I don't understand why doctors are handing out these anti-depressants so easily. I thought they were supposed to be for long-term chronic depression that had no real base (in other words, you don't know why you're depressed). The article I read said he was upset over the breakup with a girlfriend. To me, if he was given the pills for that, then the doctor needs to be looked at. Everyone gets down and depressed from time to time. You don't need to run out and get a little "fix-it" pill for everything. Afterall, look at what the consequences can be.

Yea, exactly. I'm not on ANY prescription drugs AT ALL. I've had 'em over the last few years, mainly painkillers. But the last time I was on a regular prescription medication was 12 years ago. Times have changed sooooo much... I don't like this. At all. If I EVER have to be regularly prescribed some medication, you can count on me grilling my doc to hell and back.

When I worked on the college newspaper last year, one of the editors did a feature story on prescription meds- apparently docs are overzealous with prescribing meds, even when they aren't needed, because they get a lot of free things if they do so, such as a free trip somewhere. :mad:

It appears that they've ruled out most everything, except drugs. The toxicology report will most like provide the mystery of what killed him. I think it's drug related. Either an accidental overdose or a fatal drug interaction.

No Cause of Death Given for Smith Son

NASSAU, Bahamas (AP) - Authorities issued a death certificate for the son NASSAU, Bahamas (AP) - Authorities issued a death certificate for the sonof Anna Nicole Smith but left the cause of death undetermined pending toxicology tests, a lawyer for the former reality TV star's family said Thursday.

Attorney Michael Scott said the document will let the former Playboy playmate bury her son, Daniel, who died Sept. 10 at his mother's hospital bedside in the Bahamas.

Filed on Wednesday, the death certificate lists the cause as "pending chemical analysis," said Chief Magistrate Roger Gomez.

"It is not unusual in instances where the cause of death cannot be determined to issue a death certificate," Gomez told The Associated Press. "This is not a matter of special treatment being given in this particular case."

Scott also said Thursday that Smith, 38, planned to file documents registering the birth of her 2-week-old daughter, but he declined to reveal the girl's name. He added that Anna Nicole Smith has been granted permanent residency in the Bahamas, where she came to avoid media scrutiny during her pregnancy.

She is gradually recovering from the death of her 20-year-old son, he said.

"She's much better," he told the AP. "You never get over that, you get through it. Time is the catalyst for that."

It will likely be two weeks before pathologists receive test results, said Scott, who is the attorney for Daniel Smith's estate.

Authorities say there is no evidence of homicide or suicide. A private examiner hired by the family, Cyril Wecht, said in an interview from his Pittsburgh office that the son was taking a low dose of the antidepressant Lexapro at the time of his death but he did not know whether it was a factor.

We'll have to see if it proves to be an accidental drug-related death due to a couple of drugs in his system," said Wecht, who added that blood tests have ruled out the presence of alcohol and some drugs including cocaine, opiates and amphetamines.

Scott criticized the Bahamas' head coroner, Linda Virgill, for labeling the death "suspicious" last week and saying that her office knew the cause of death before toxicology tests were complete.

"Unless she's psychic or God, unless the pathologists know the cause of death, how does she?" said Scott, adding that some in the Bahamas worried the highly publicized case was affecting the island chain's image.

"We are all aware of what happened in Aruba. We are all aware of what happened to Natalee Holloway," he said, referring to the high-profile disappearance last year of an Alabama teen. "We don't want that to happen in this jurisdiction."

Virgill declined to comment Thursday when reached by the AP.

Gomez announced an overhaul of the system for medical inquests Wednesday in part because of complaints of preferential treatment that arose when Virgill scheduled an inquest just three days after Smith's death - despite a backlog of other cases.

Larry Birkhead, a photojournalist who claims to be the newborn girl's father, said he regretted missing the birth as he was shown photos of the girl by a correspondent for TV show "Entertainment Tonight."

"It just seems like I should have been on the other side of this picture," Birkhead said.

Smith's camp has been silent on the identity of the girl's father.

HOLLYWOOD - Distraught former Playboy Playmate Anna Nicole Smith was forced to sell photos of her son Daniel taken the night before he died in order to pay for his funeral expenses.
The family portraits were taken in a hospital room in the Bahamas two days after the birth of Anna Nicole's daughter and hours before her 20-year-old son was found dead.

Photo agency Getty Images sold the photos to In Touch magazine for $400,000 after a fierce bidding war.

According to In Touch executive editor Dan Wakeford, "We purchased the photos, beating the competition.

"The photos were extremely emotive, and our readers are incredibly intrigued by this story."

Wakeford says the images show "a perfectly healthy young man."

While it is unclear what portion of the proceeds will go to Anna Nicole, a source tells Us Weekly magazine that the devastated star sold the pictures in order to pay for her son's funeral.

The source says, "She needs the money."

Getty Images claims that a portion of the profits from the sale of the photos will go to a charitable foundation to be set up in Daniel's name.

His body remains at Butler's Funeral Home in the Bahamas and won't be released to the family until the investigation into his death is complete.
