PROSTITUTION
Prostitution was a European import to North America, for the concept was foreign to Native American culture. Compared to England, the American colonies had few prostitutes, and most of them were confined primarily to the waterfront neighborhoods of seaports. During the eighteenth century, Boston and New York had the most prostitutes owing to the large numbers of soldiers stationed in those ports, the economic dislocations resulting from colonial wars, and the presence of many impoverished unmarried women.
Prostitution became a social and political issue only after 1810. In the ensuing century, virtually all American cities and numerous towns experienced noticeable increases. Rapid, unplanned urbanization, an expanding transient male population, low female wages, and discrimination against women contributed to the rise. In addition, landlords often preferred to rent their properties to prostitutes because they were more lucrative and stable than working-class tenants. Common law tradition never implicated the owners of houses of prostitution. Indeed, until the twentieth century, no statutory definition of prostitution existed in most American communities. It was treated as a form of vagrancy and a simple misdemeanor. Because of arbitrary, weak, or corrupt municipal law enforcement, most prostitutes plied their trade unpunished. The Victorian ideologies of women's separate sphere and the double standard for sexuality divided females into two groups: "respectable" women, supposedly passionless and sexually repressed, and "unrespectable" women, irredeemable and available for purchase.
Nineteenth-century prostitution was structured around three subcultures. First, about 5 to 10 percent of young females in large cities engaged in prostitution at some point, earning twice as much in an evening as factory or service employment would bring in a week. Most were single, in their teens or early twenties, native-born, and recently arrived in the city. The majority worked only for short periods, eventually securing more socially acceptable employment or marrying.
Second, a prominent "sporting male" subculture encouraged men to hire prostitutes. As factory work replaced the craft system, and the unregulated boardinghouse replaced the hierarchical artisan household, young males enjoyed greater freedom, and rigid sexual controls quickly vanished. Male leisure institutions after 1820 provided a social niche separate from the family and more "feminized" entertainments. Prizefighting, heavy drinking, and sexual aggression were admired. This rough masculinity and the increasing commercialization of leisure produced a distinct male world with its own promiscuous sexual norms. The worst elements in this fraternity were the pimps, who first appeared in New York after 1835.
The third subculture, part of an underground economy, was that of the brothels, which numbered in the hundreds in Chicago, Philadelphia, and St. Louis. By the time of the Civil War, New York had over five hundred, many advertising in newspapers and guidebooks. There were proportionate numbers in Austin, Louisville, Omaha, Richmond, San Antonio, and Spokane. Periodic arrests and raids everywhere were so common that they constituted a form of taxing and licensing. This de facto regulation of prostitution extended to other leisure institutions. Antebellum theater proprietors routinely permitted prostitutes to solicit in the "third tier" of their establishments. Concert halls, saloons, cigar stores, restaurants, and cabarets supported prostitution to attract patrons.
Sex, or "red-light," districts were well known before 1850 and later. New York's Five Points and the Tenderloin, San Francisco's Barbary Coast, New Orleans's Basin Street and Storyville, Chicago's Levee, and even the Alley in Boise, Idaho, were nationally known for the promiscuous sexuality they promoted. By the late nineteenth century, prostitution was a multimillion-dollar business, with organized networks of madames, landlords, doctors, and municipal officials.
The growth of prostitution was countered throughout the century by antiprostitution movements frequently linked to temperance and "moral purity" crusades. Reformers, church leaders, and women's societies sought to assist prostitutes and close down brothels, but their efforts were sporadic and ineffective.
After 1890, urban antivice crusades grew increasingly popular, with ministers decrying municipal tolerance of prostitution. Progressive reformers and federal officials followed, attacking "white slavery," proposing programs of protection and prevention, and sometimes recasting prostitutes into public enemies. Between 1900 and 1918, more than forty vice commissions recommended eliminating urban sex districts. In 1909, Iowa was the first of some thirty states that passed red-light abatement laws permitting citizens to obtain injunctions and close buildings promoting commercial sex. Prostitutes were treated more coercively with the creation of special courts, police vice squads, and the introduction of social workers in prisons.
Congressional legislation in 1903 and 1907 outlawed the importation of prostitutes and permitted the deportation of immigrant prostitutes. The Mann Act of 1910, which made the transport of women across state lines for "immoral purposes" illegal, resulted in 1,537 convictions by 1916. The Commission on Training Camp Activities led by Raymond Fosdick during World War I closed the sex districts in the nation's leading ports.
By the 1920s, the era of the brothel and open prostitution had ended, and significant changes emerged over the next four decades. Municipal officials grew less tolerant of the sporting male subculture. Prostitution became a clandestine activity; prostitutes no longer advertised but conducted their business in tenements, dance halls, massage parlors, "call houses," and even taxicabs. During Prohibition, prostitution developed closer ties with the alcohol trade and organized crime. The famous New York madame Polly Adler, for example, was protected by gangsters. Finally, increasing state repression and bureaucratic intervention ranging from the fbi in World War II to the congressional Kefauver committee in 1950 and 1951 forced many prostitutes to work alone.
None of this, however, suppressed America's appetite for the subject. Public titillation was fed by the periodic attention given to celebrity madames, like Polly Adler and San Francisco's Sally Stanford, who was even elected mayor of Sausalito, California, in 1976.
After 1965, prostitution entered a new period of openness and publicity. One study in 1968 found 95,550 arrests for prostitution nationwide and estimated that every day 286,650 men visited prostitutes. Sporadic attempts have been made over the years to legalize prostitution on various grounds, and in 1971 Nevada became the first state to do so (in its smaller counties).
Prostitutes themselves grew more assertive. In 1973, San Francisco's Margo St. James, a college-educated prostitute, founded the first labor organization for prostitutes known as coyote (Call Off Your Old Tired Ethics). Similar organizations followed in other states. St. James and her supporters defended prostitution as a privacy issue, demanding that it be accepted as legitimate women's work, but feminist and other groups attacked this libertarian view, charging that prostitution was an exploitative extension of women's dependency on men. By the end of the 1980s, however, growing fears regarding the aids epidemic threatened prostitutes with even greater regulation and discrimination.
